Thanks for your call and for sending this letter so I can read it and give you a more thorough response.
This letter was issued in 2013, so that tier monitoring relief extended the rest of that permit cycle. When the new
General Permit was issued in 2019, it was fine to continue semi-annual monitoring as per the permit. However, if the
site has had more exceedances recorded since then you should be following the tier responses if needed. The 2013
letter doesn't remove the obligation to respond to exceedances since August 1, 2019. In other words, things sort of
"started over" for your site on August 1, 2019 with the new permit.
We didn't talk about what the sampling results have looked like since then, so if you need to follow the Tier responses in
the permit for any results over the benchmark, please do that. The count of exceedances for triggering Tier 3 (any 4)
starts over at the beginning of the permit cycle. If you need to contact the Mooresville Regional Office again to address
Tier 2 or Tier 3, or to request relief from more frequent monitoring again, Zahid Khan is copied above.

Mecklenburg County, North Carolina
The Mooresville Regional Office is in receipt of your letter dated November 25, 2013 requesting a waiver for
-.he Tier 2 Monitoring associated with your stormwater permit. The facility has implemented several strategies to
try and alleviate benchmark exceedences, as described in the attached inspection report. Significant reductions
have been made in the metal concentrations of the stormwater discharge. The facility has been sporadically in
compliance with the benchmarks after the tiered responses and, as discussed during the inspection, you will
install/maintain additional floc logs for aid in settling in an effort to further reduce metal concentrations. Therefore,
the Division grants Southern Metals Company a waiver of additional sampling associated with the Tier 2 response
of the site's stormwater permit (NCG200347). Please be advised that semiannual sampling must still be conducted,
as described in Section B-Analytical Monitoring Requirements -of the permit. Please place this letter with your
stormwater pollution prevention plan as documentation for the waiver of the tiered response.
