coverage. All other terms and conditions contained in the original certificate remain unchanged and in full
effect. This modification is issued under the requirements of North Carolina General Statutes 143-215.1
and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and
regulations promulgated and adopted by the North Carolina Environmental Management Commission, and
the Federal Water Pollution Control Act, as amended,

concrete block kilns from a facility located at the

to receiving waters designated as the Swannanoa River within the French Broad River Basin in accordance
with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and IV
of General Permit NCG500000 as attached.
This certificate of coverage shall become effective September 13, 2008.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

Dear Mr. Bennett:

In a letter dated July 16, 2008, CEMEX Construction Materials Atlantic, LLC (CEMEX)
informed the NCDENR — Division of Water Quality that the name of CEMEX Construction
Materials, L.P., would change to CEMEX Construction Materials Atlantic, LLC on August 1,
2008 as permittee for the facilities listed in Attacment I.
A phone call from your office on July 23, 2008 informed CEMEX that in order to
complete the name changes; the "Surface Water Protection Section — Permit Name/Ownership
Change Form" needed to be completed for each facility listed in Attachment 1.
Attached to this document, please find the "Surface Water Protection Section — Permit
Name/Ownership Change Form" completed for each site currently permitted (Attachment 2). All
forms have been signed by the Atlantic Region President Mr. Roy J. Schorsch. Additionally, the
name CEMEX Construction Materials Atlantic, LLC was officially listed with the North Carolina
Secretary of State on August 26, 2008.

This letter serves as notification to the NCDENR — Division of Water Quality that the
name of CEMEX Construction Materials, L.P., as permittee for the facilities listed in Attachment
1, will change to CEMEX Construction Materials Atlantic, LLC effective on August 1, 2008.
This change is a result of CEMEX, Inc., the parent company of CEMEX's U.S. operations
("CEMEX"), restructuring its U.S. operations on a regional basis.
On August 1, 2008, CEMEX Construction Materials, L.P. ("CCM"), a Texas limited
partnership and subsidiary of CEMEX, will be converted into a Delaware limited liability
company and renamed CEMEX Construction Materials Pacific, LLC ("CCMP"). Under
Delaware law, CCMP will be treated as the same entity as CCM with all of the rights, liabilities
and assets of CCM prior to the conversion. As part of the restructuring, CCMP (f/k/a CCM) will
transfer the facilities that are subject to the permits listed in Attachment 1 to its affiliate CEMEX
Construction Materials Atlantic, LLC ("CCMA"), a Delaware limited liability company and
subsidiary of CEMEX.
Please confirm that this letter notification is sufficient to change the permittee name to
CEMEX Construction Materials Atlantic, LLC. If additional information is required, please
provide the instructions and/or specific forms that are required to complete this name change
process.
