In accordance with your application, the Division hereby forwards your Certificate of Coverage to
discharge under the subject NPDES general permit. We issue this permit pursuant to the requirements of
North Carolina General Statue 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection agency dated May 9, 1994 (or as subsequently amended).
We include the following information with your permit package:
• A copy of the Certificate of Coverage for your treatment facility
• A copy of General Wastewater Discharge Permit NCG500000
• A copy of a Technical Bulletin for General Wastewater Discharge Permit NCG500000
If any parts, measurement frequencies or sampling requirements contained in this general permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the Division
of Water Quality. The Division may modify, or revoke and re -issue this certificate of coverage. This
permit does not affect your legal requirements to obtain other permits required by the Division of Water
Quality, the Division of Land Resources, the Coastal Area Management Act, or any other Federal or
Local government.

16Aug05 — Keith Haynes (ARO) e-mailed to ask, "Staff Report or email"
Joe responded: Keith, I understand that the applicant was to have contacted and
met with ARO prior to applying, and should have added the name of the DWQ rep. to his
application. I don't see it. In the absence of this info, I guess I need some assurance that
someone has looked it over and is "warm and fussy" with what/how/where they propose
to discharge. I wont visit the site.
I know RRO must generate staff reports because concurrent local DEH approval quires
them. Is this not true in Asheville? (This is my first ARO g-permit.)
However you think it best to document the info is OK by me. You have my draft docs so
I don't need that info unless there are errors to be corrected.
And : Footnote to my last: DEH review and approval required only for SA or WS waters.
No worries - this is Class C.
18Dec07 — Joe contacted Permittee, Johnny Topia, of CEMEX (new owner) and asked
if he wants us to act on the application for COC. He said yes. I told him he should submit
a Change of Ownership form before New Year, and we would finalize the permit as
drafted (25Ju105), pending the Region's approval.
25Feb08 -- received new application from Permittee. Noted the Change of Ownership
form (to CEMEX of Charlotte, NC); plans to connect to local city sewer, perhaps within
the next six months.
10Mar08 — Joe generated draft docs and submitted to Gil for review.
11Mar08 — Gil returned file to Joe; generated final docs; submitted to Gil for signature
and issuance.

Dear Mr. Corporon,
As requested during recent conversations via phone, enclosed is an updated permit
application to discharge approximately 50 gallons/day of Kiln Steam condensate. This is
from our concrete block manufacturing facility located in Asheville, North Carolina. The
original application was submitted with date June 29, 2005 and a Certificate of Coverage
was assigned on letter dated July 25, 2005 (NCG 5000627), but the permit was never
finalized. Since then the Asheville block plant has changed owners to CEMEX
Construction Materials, LP.
We hope that the new application form with updated information in conjunction with the
ownership change form will provide the information needed to obtain the requested
Permit.

Alternative to a NPDES General Permit:
The Metropolitan Sewage District (MSD) of Buncombe County has approved CEMEX-
Asheville to discharge kiln condensate directly into the city sewer. The approval was
granted based on the condition that the discharge does not contain any constituents that
the MSD will not accept. A sample of the discharge was collected and analyzed per the
procedures and analytical methods required by the MSD.
Preliminary investigations revealed that two MSD sewer lines exist within close
proximity to the CEMEX-Asheville property. One line lies to the south, along the
Swannanoa River — across the Southern Railway easement. The other lies to the north,
across Meadow Road on the Dave Steel Company, Inc. property.
Further investigation has concluded that crossing the Southern Railway easement would
introduce costly logistical complications and likely increase the required time to complete
the project. Given this situation, crossing Meadow Road and working with the Dave
Steel Company proves to be the more practical alternative. CEMEX personnel are
currently in negotiations with Davis Steel Company, Inc. determining the best possible
scenarios which would allow a connection to the MSD sewer line. CEMEX is applying
for NCG500000 Permit Coverage because it is unlikely this project would be completed
within six months.
