3a.Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:
The approximately 4.9-acre project study area is situated along the NW Cary
Parkway roadway corridor and is located within the municipal boundaries of the Town
of Cary in Wake County,North Carolina.The Town of Cary's proposed NW Cary
Parkway pedestrian bridge project runs perpendicular to Black Creek.Black Creek
flows south to north through the project study area with an existing greenway network
parallel to the right bank.The project study area and its vicinity primarily consist of
forested riparian corridors and greenways within North Cary Park,single-family and
multi-family residential developments,and institutional and recreational facilities.

4. Proposed Activity
Provide a detailed description of the proposed activity including its purpose and include the type of equipment to be used:
The project proposes to construct additional sidewalk and a pedestrian bridge over
Black Creek along the northern side of NW Cary Parkway to connect the 650-foot
gap in the existing pedestrian infrastructure along the project corridor and improve
pedestrian access in the Town of Cary.Currently,the sidewalk connects to the park
trails but does not continue along Cary Parkway across the bridge.The sidewalk
completion would improve connectivity between numerous residential developments,
areas of employment,parks,and greenways.The bridge would improve safety by
allowing pedestrians and bicyclists to cross over Black Creek separately from North
Cary Parkway.Equipment typical of greenway and bridge projects will be utilized,
including but not limited to excavators,bull dozers,and cranes.

Comments:
Kimley-Horn staff conducted a delineation of the project study area on July 21,2021.
One perennial stream(Black Creek)was identified within the project study area and
one intermittent stream(Stream S3)was identified within 50 feet of the project study
area.James Lastinger of the USACE issued a Preliminary Jurisdictional
Determination dated November 5,2021 (SAW-2021-01634).Rob Ridings of the
NCDWR issued a buffer determination letter(DWR#20211174)on July 29,2021.

Comments:
Unavoidable permanent impacts to the riparian buffer zones associated with Black
Creek will result from the proposed project.At Impact Site 1,permanent impacts to
riparian buffer zone 2 will result from the placement of riprap along a newly
constructed stormwater ditch.Riprap will be placed underneath and between NW
Cary Parkway and the proposed pedestrian bridge to protect the steep slope that ties
into the existing greenway from erosion.This impact is"Allowable Upon
Authorization"under the Neuse River Riparian Basin Buffer Rules Table of Uses
[Section(11)(cc)]for stormwater control measures.Additionally,Duke Energy is
permitting a powerline relocation within the existing NCDOT right-of-way easement
south of NW Cary Parkway.This will result in permanent impacts that are"Deemed
Allowable"under the Neuse River Riparian Basin Buffer Rules Table of Uses[Section
(11)(pp)]for Utilities—Non sewer aerial line Perpendicular crossings.
Additionally,temporary impacts to the riparian buffer zones 1 and 2 at Impact Site 1
will result from temporary construction access along the left and right bank of Black
Creek.This will allow crane access underneath the existing NW Cary Parkway
roadway bridge to construct the proposed pedestrian bridge.Temporary construction
access disturbing greater than 2,500 sqft of the riparian buffer is"Allowable Upon
Authorization"under the Neuse River Riparian Basin Buffer Rules Table of Uses
[Section(11)(ee)].A riparian buffer replanting/seeding plan is included in the erosion
control plans.
D. Impact Justification and Mitigation

1.Avoidance and Minimization
la.Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project.
Impacts to streams and riparian buffers have been avoided and minimized to the
extent practical. Impacts to streams in the project corridor were entirely avoided by
intentionally locating the pedestrian bridge alignment outside of stream and riparian
zones throughout the project corridor.To minimize impacts to riparian areas,the
stream crossing location was intentionally located where a perpendicular crossing
was feasible.Temporary construction access is proposed along both banks of Black
Creek within the project corridor,allowing the pedestrian bridge to be constructed
without impacting the stream itself.The proposed temporary work bridge will span the
stream from top of bank to top of bank,therefore no stream impacts will result from
the placement of this bridge.Additionally,the powerline relocation is located entirely
within existing NCDOT right-of-way,therefore Duke Energy will be able to relocate
their lines without the need of an additional easement.
1b.Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Impacts to streams and protected riparian buffers within the project study area will be
minimized to the extent practical throughout the construction process by avoiding
these features with equipment,materials,and access corridors where practicable.
Where feasible,staging and construction access routes will be located in upland
areas throughout the corridor.Silt fencing will be installed around the limits of
disturbance to help ensure that all construction equipment will remain within the
permitted areas throughout the construction process.Temporary sediment control
measures will be used to reduce stormwater impacts to receiving waters and
minimize runoff from the construction sites.

On behalf of our client,the Town of Cary,Kimley-Horn is submitting the attached
buffer authorization request for the above referenced linear transportation project
located in the Neuse River Basin.The project proposes to construct additional
sidewalk and a pedestrian bridge over Black Creek along NW Cary Parkway to
connect the 650-foot gap in the existing pedestrian infrastructure in Cary,Wake
County,North Carolina.
In total,the project proposes 2,101 square feet of temporary Buffer Zone 1 impacts,
1,692 square feet of temporary Buffer Zone 2 impacts,514 square feet of permanent
