On November 24, 2021, DCM circulated a field investigation report (FIR) for applicant Daniel Furr, to include installation of an 8' x 65' floating dock and two 14' x 14' boatlifts at the subject address. Based on comments received from several review agencies during initial review (pertaining to floating docks in shallow bottom habitat area), Mr. Furr has decided to amend his request to include the following: On January 27, 2022, DCM staff met with Mr. Conway and Mr. Furr on -site to re-evaluate water depths surrounding the existing platform, and in the area of the proposed development. The date was chosen as the tide was reportedly neutral (0.0') and water and wind conditions were favorable for accurate representation of low water. During the site visit, DCM staff measured depths between -2.0' and -2.6' normal low water at a distance of approximately 25' and 65', respectively, from the end of the existing platform. Due to these observations, the applicant has decided to extend a 6' x 16' fixed finger pier from the end of the existing platform, which would connect by ramp to an 8' x 50' floating dock. Overall, the floating dock would be shortened (by approx. 15' near shore) and the portion previously proposed within waters less than -2/0' (NLW) would be eliminated. The boatlifts would remain, as initially proposed, near the end of the floating dock, where water depths approximate -2.6', NLW. The terminal end of the floating dock would remain as previously designed with no additional encroachment waterward toward the channel. The applicant has submitted a revised MP-4 form and three site plan drawings, all dated revised 3/10/22. Based on the information provided, regarding revisions to the Major permit application request (plans and documents), it appears the development plan would remain consistent with DCM's Rules concerning the Estuarine Waters and Public Trust AECs. At this time, this office has no objection(s) to these changes. By copy of this memo, DCM is requesting that the USAGE, NOWRC, NCDWE, NGDMF provide any comments that your agency may have on the proposed project to Cameron Luck of DCM's Morehead City office, as soon as possible.
