Emily Greer, Regulatory Specialist Wilmington District-Wilmington Regulatory Field Office 69 Darlington Avenue Wilmington, NC 28403 RE: SAW-2021-00250 Falls Mist SD NWP-Notice of Incomplete Application Dear Emily, This transmission is intended to address items 3 through 7 as reported in your email to Dana Lutheran and others of July 29, 2021. I am including a revised plan in this spirit. Please find below the subject items with highlighted response. 3. Using the scale on the provided permit drawings,the reported impact amounts still do not appear to be correct. Although the applicant has reduced the impact area, the Corps is still coming up with over 0.5-ac impacts. It is imperative that the Corps be able to verify impact amounts since the project is toeing the line of the NWP limits. If these are surveyed points,as stated,there should not be discrepancies in the measurements between the drawings or between what is being reported and what the Corps is measuring. Please provide scaled impact plan and profile drawings on separate pages and clearly define the impact boundaries. As presented in the most recent drawings, there is a gap between the yellow wetland impact and the darker gray stream impact boundaries, making it unclear as to which impact type this area belongs to. Furthermore, it is unclear if the impact area between the wing wall and the sheet pile has been captured or if the dissipater has been included in permanent stream loss totals (See Comment#4). Additionally,to verify compliance with regional conditions for culvert installation, please provide a cross-section with the required information from the view depicted in the attached. For the required information, please see our NWP 29 Regional Conditions. The wetland points are surveyed. The plan and profile drawing is to scale. The impacts are now correctly reported thereon and should be verifiable by any typical process. The embankment footprint has been reduced based on some allowances negotiated with the NCDOT and Pender County. The roadside ditch has been eliminated,the multi-use path and its shoulder have reduced widths through the wetland. The impact boundaries should now also be better clarified. The area between the wing wall and the sheet pile is included as well as the rip rap dissipator in both the permanent stream and the wetland impact totals. In the PCN and on the drawings,please separate stream impacts by permanent impact/loss and permanent impact, no loss. if applicable,please also parse out any temporary impacts. Providing these kinds of details could potentially be beneficial to the applicant. The plan and profile drawing now depicts the stream impacts as well as the temporary impacts. 5. The ornamental tree planting on both sides of the road crossing is unnecessary. It is unnegotiable that this must to be removed to assist in demonstrating adequate efforts to avoid and minimize. Additionally, a reduction in the 10'-wide Clear Zone and the 10'-wide sidewalk needs to be achieved. Otherwise, additional discussion and justification for not taking further steps to avoid and minimize this impact is required. The ornamental plantings are now specified to be omitted through the wetland crossing. The embankment section width has been reduced by thirteen feet through eliminating the roadside ditch and reducing the width of the multi-use trail and its shoulder. These reductions have been made to avoid and minimize the Pender County required collector road impacts. 6. To demonstrate avoidance and minimization,the applicant states that road slopes were reduced from 3:1 to 2:1; however,the provided drawings show a 3:1 slope. The embankment section as well as its associated footprint have been revised to reflect 2:1 sideslopes as prior stated and in effort of avoidance and minimization. 7. The applicant has not submitted enough information for the Corps to verify whether this is a single and complete project.There are no lot numbers, no stormwater information, no utility information, no identified attendant features,etc. Based on the absence of project details and the applicant's statement regarding the lack of approval by Pender County and that, upon approval by Pender County,there are reasonably foreseeable future impacts associated with the development of the project,the Corps is of the opinion that the applicant is seeking a Section 404 permit too soon in the process. The lots are now numbered,the drainage,the water,sewer extensions and delivery systems are now shown. No additional wetland impacts are proposed for these lots. 1 hope this addresses your concerns. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The project site is comprised of two parcels of land (Tract 1 and Tract 2, on the attached Project Area Map)that total approximately 92.45 acres. Access, into the property, is provided via an existing soil road, which is located on the on the south side of NC Hwy. 210, approximately 1.6 miles west of the intersection of NC 210 and NC 117. The upland portions of the property were historically farm land, thus several man made ditches are found within the project boundaries (see attached Wetland Boundary Sketch, within JD Request Packet). The ditches drain to Turkey Creek, which is a relatively broad, warm water stream, with abutting wetland floodplain, that drains, from north to south, to the Northeast Cape Fear River. The creek bisects the project property, from north to south (see Wetland Boundary Sketch). Currently, the upland portion of the property is mostly comprised of grasses and shrubs, while mature woody species line the ditches and wetland/creek feature. Single family and rural agriculture are the predominant uses, in the vicinity of the Project Site 4b. Once this is completed, the approved impact area will be cleared of woody and herbaceous vegetation, after which clean earthen fill will be discharged into the area and graded to the desired height and contour. Crush and run will top the fill, and the road will be paved. Sheet pile will be used to block the stream, at which time water will be diverted to a temporary diversion ditch, with downstream check dam. This will allow the for the installation of a 120' x 12' x 6' box culvert, with 12' x 8' rip rap energy dissipater. The pipe will be covered with clean earthen fill and crush and run and eventually paved. The temporary diversion ditch and check dam will be removed immediately after the pipe and dissipater have been installed. Water will be released slowly, to minimize erosion and down stream sedimentation.
