Sullins Director Tune 24, 2009 Dee Freeman Secretary Subject: Replacement of Bridges 29 and 53 over Mingo Swamp on HvAry. 55, Harnett /Sampson Counties TIP Project B -3654, State Project No. 8.1451501 DWQ Project No. 090676 Dear Mr. Thorpe: The Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the aforementioned project. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: 1. The permit drawings do not include a plan sheet providing details of the impacts for the temporary detour on Bridge 53, site 2. (The plan sheet for site 1 was provided.) 2. Is there a valid Corps jurisdictional determination for this project? Information provided with the application indicates that the JD expired on January 16, 2008. Please confirm that the delineation as depicted has been approved or will be extended by the Corps of Engineers. 3. Will geotextile fabric be placed under the temporary fill material used in the detours? Though this is a fairly common practice, we found no reference to such a proposal in the application. 4. The PCN explains that "The temporary detours will be removed, graded back to natural contours, and replanted with native vegetation. A monitoring plan is not proposed due to loamy soils in the project area." Success of replanting may be dependent on the time of year the work is completed. Lacking a monitoring plan, what provisions will be made should the plantings fail? 5. Please indicate if the area under the temporary fills will be grubbed. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
