Dear Mr. Roden -Reynolds and Mr. Johnson:
NRP Holdings, LLC has authorized NRE Environmental, LLC (NRE) to provide Clean Water Act Section
404/401 permitting services for the approximately 11-acre Sugar Creek Affordable Apartments site
(Project) located 1.14 miles south of Interstate 85 along the east side of W Sugar Creek Road and just
north of the intersection of N Tryon Street and W Sugar Creek Road within the City of Charlotte in
Mecklenburg County, NC (Attachment 1). Authorization for the Project was issued on November 19, 2021
for a Nationwide Permit No. 29 and on December 20, 2021 for Water Quality Certification No. 004566.
NRE is submitting a revised Pre -Construction Notification with impact table and drawings pursuant to
Nationwide Permit No. 29 and Water Quality General Certification No. 4139 for proposed minor
modification to permanent impacts to the jurisdictional waters of the U.S. associated with developing an
affordable residential housing development on the Project (Attachment 2).
The NWP 29 approved impacts for this project that included 279 linear feet (If) of permanent stream
impact, 60 If of temporary impacts and 0.16 acre of riparian wetland impact. A minor modification to the
proposed project plans has required the addition of rip rap apron to the proposed culvert at impact S1,
which slightly alters the impact to jurisdictional streams but is within the NWP and WQC thresholds
(Attachment 3). This modification has changed the original S1 impact from permanent impact of 122 If to
a new permanent impact of 98 If for the culvert. In addition, the modification adds permanent impact of
28 If with no loss of waters (for the rip rap) that has been added to the drawings as impact S7. Total
impacts for the Project with the modification are now 255 linear feet for permanent impacts, 28 LF for
permanent impact with no loss of waters, and 60 LF for temporary impacts to jurisdictional non -wetland
waters, plus 0.16-acre wetland impact. There are no other changes to the Project.
Based on these modifications, we request reissue of the approved NWP and WQC with revision to
required mitigation credits from 279 to 255 for linear impacts to warm water streams.
