Hi Mr. Wojoski:
Thank you for your prompt reply yesterday. The Town would like to take this opportunity to respond
to one of the points raised in your reply.
With regards to the dredging of Area "A", and the concern that the dredging of this area might not
comply with DWR's rules on avoidance and minimization, the Town has discussed this issue
internally and with our project engineering team (Moffatt and Nichol). While we do believe that the
dredging of Area "A" will help to maintain the somewhat limited access (and reduce existing dangers
to navigation) to North Jinks Creek and the AIWW that have existed in the past, we are concerned
that pursuing the dredging of Area "A" at this time will lead to delays in rapidly obtaining a permit
modification for the dredging of Area "B". Any such delay in obtaining this permit modification will
represent an additional cost to the Town, as we are currently paying the dredge contractor a daily
standby fee until approvals are received to resume dredging.
Therefore, the Town requests that at this time the dredging of Area "A" be formally removed from
our current modification request. Consequently, our modification request is now for the dredging of
Area "B" only.
By copy of this correspondence, the Town also requests that the dredging of Area "A" be removed
from the modification requests currently being reviewed by the Division of Coastal Management and
the U.S. Army Corps of Engineers. We also would respectfully request that all agencies move
forward as quickly as possible with issuance of the needed approvals to dredge Area "B".

Hi Lisa —
DWR is reviewing the request to modify the dredge template in order to issue a modified 401 Water
Quality Certification. Yesterday, we met with the state resources agencies and coastal management
to review the modifications. An outstanding concern in the 401 review is the need to dredge the
"Area A" shown on the attached plans. It appears it doesn't satisfy our rule requirement for
avoidance and minimization. Outside of that concern, we are reaching out to ACOE to ensure
coordination. I believe those are the only two items/issues left for DWR to resolve before modifying
the Certification, and I'm hopeful we can issue a modified certification early next week. I've copied
John Perry from our Wilmington Regional Office who is handling the project in Holley Snider's
absence, in case he has anything additional to add that I've missed.

Can you tell me if you have any updates regarding the water quality certification for the additional
dredging of the South Jinks Creek project request that is being consider now. Rapid response to this
issue is critical to allow for adequate time to perform the dredging within this environmental
window.
