Good morning All,
The DWR objects to the disposal of the spoil material at the requested location of 1400 Point Harbor
Road based on an unresolved Notice of Violation issued for uncontained spoil material resulting in
wetland fill at the above listed address.
The DWR does not object to the requested change in excavation methodology to bucket to barge.
However, the applicant is cautioned to minimize handling of wet material adjacent to and over open
waters to prevent the potential for spoil material to be released from the bucket/clamshell to open
waters resulting in a violation of water quality standards.
