Also, I need to you to read and sign the attached Catawba Riparian Buffer Form. I've attached it in two formats. Please fill out and return to me whichever one works best for you. Also, I need to know how far ABOVE and BELOW full pond (the 760' line) the rip rap goes. That information has to go into any approval letter (once the trees are planted). Hi Dee, So yes you can plant those, but they have to meet the condition in the letter you received. They have to be at least 3" in diameter at breast height and at least 8'-io' tall. Flowering and Silky Dogwood should both be on the list. Weeping Willow isn't native to the US, but has naturalized, so it should do ok along the shore. I will plant 10 trees on both sides of the 50' buffer only leaving the center 100' clear. For a total of 20 trees. I will have these trees planted as soon as we know where the septic is located on the property. Can I plant dog woods and a weeping willow as part of my options? They weren't on the list. Thank you! Hello Mr. Perez, We're you able to view the pictures and video that I sent to Mr. Johnson? Clearly there were no trees between the shoreline and the trailer and I shot a video of the shoreline showing there were no trees. I believe the aerial is misleading as it is shot so high you can't see anything but shadows. If you look at the aerial you sent there are shadows of trees that are same length as my boat dock. Obviously there aren't trees in the water but your picture gives the visual that the trees are there. Therefore it is the same visual for my shoreline. The trees are well past the 50' buffer but their shadows make them appear much lower on the land. My pictures are more accurate than an aerial that was taken during the afternoon when the sun is at an angle. Would you please look at your aerial again and see the shadows to the left of my dock. Impacts not indicated in the application is a violation of the Buffer Rule. Site specific work should be provided in the application. [15A NCAC 02H .0506 and 15A NCAC 02B .0243(8)] Trees are not allowed to be removed from Zone 1 of the Buffer (within 30 ft of the full pond elevation), unless approved. Exception, those trees that are severely undermined along the immediate shoreline can be removed. Minimal shaping and sloping along the immediate shoreline is allowed. [15A NCAC 02B .0243(6)] Benching and grading in the buffer is not allowed. Excessive disturbance of ground cover. [15A NCAC 02B .0243 (6)] Beaches, impervious patios, impervious walkways, etc. are not allowed in the buffer unless specifically approved by the Division. There are limitation on size for decks. [15A NCAC 02B .0243(4) and (6)] Work to be conducted from land must indicate an access and indicate any trees that are to be removed. The work corridor should be described. The approved access corridor shall be restored. Staging, spoil, construction material must be outside the buffer. [15A NCAC 02H .0502 and 15A NCAC 02B .0243 (4), (6), (8)] Stormwater cannot be piped or channeled for direct discharge to the lake. All constructed stormwater discharges must be at the natural elevation and discharged prior to entering the buffer directed as diffuse or sheet flow at non -erosive velocities to the lake.
