Thanks for the quick reply. Historically DWQ has not required an approval fro a trail in the buffer with mulch since the mulch is pervious and if not forest vegetation was removed, but since the pier needs approval and I will bet they will at least have to cut some brush I will include the trail as an impact due to potential clearing but not as an addition of impervious. Mulch does not do any nutrient (nitrogen) removal, so it is considered an impact because the function of the buffer is taken away. You're correct in that piers generally do not have buffer impacts unless vegetation is removed to install it. Since it's an allowable use as well, you would just include that on the PCN with the trail. It sounds great that you're steering the developer towards applying for all of the piers at once since that is something we would ask for and would potentially put the project on hold for. Also, I do not do Express Review. Lia Myott is our Express Review Coordinator. If she isn't booked, I'm sure she'd be happy to accept the project into Express. In reference to the Flowers project, I would like to have Ian and potentially Cyndi in the meeting as well. August is looking fairly booked, so my first available date (and I believe Ian and Cyndi are available as well) is September 4th. Let me know if this date works for you. Basically I want to be sure we are on the same page: the pier over the water area has no buffer impacts and does not need a 401 because they are driving pilings so no 404 is required. If we agree I also advised the developer that rather than do the piers for each lot one at a time it would be in his interest and would save DWQ time if he applied for all at once. Because they are trying to meet a deadline for the parade of homes this fall they will need to go express because they did realize they needed an approval at all. Second I guess we need to set up a meeting to discuss the Flowers buffer application we submitted last week.
