Reference the onsite meeting held March 6, 2014 with you, representatives from the NC Division of Water Resources and NCDOT/Natural Environment Unit to discuss discrepanciesbetween the NWPverification,theapprovedmitigationrestorationplantitled “Onsite Stream Restoration, Planting and Monitoring Plan” datedFebruary 13, 2009andpost construction as- built conditions. The discussion centered on the need for recalculationsinavailable streamcredit,buffercredit, andmonitoring regimespost construction.Thediscrepanciesinstream creditwerearesultof initialcreditsbeingcalculated to includestream reachesoutside of the NCDOT/ROWand are subsequently unavailable for use by NCDOT. Following the discussion on March 6, 2014, thisoffice received correspondence dated March 13, 2014 requesting modification of sections ofthe restoration plan accompanyingthe NWP application; and theNWP conditions incorporating the restoration plan bythe following reference: “Stream and buffer restoration will be accomplished in accordance with the submitted restoration plan.” As such, the following sections of the “Onsite Stream Restoration, Planting and Monitoring plan”are hereby modified to reflect changes agreed upon: Section 1.0 -Streamcreditsof160LFreferencedintherestorationplanare amendedto reflect 100LF of proposedcredit following successful monitoring. Section4.1-Vegetativemonitoringrequirementsareamendedtostatevegetation counts bereportedfor5years. Section4.2-Streammonitoringrequirementsareamendedtostatethatonecrosssectionwill beestablishedwithinthestreamrestorationsiteand monitored for 5 years. Section4.3-Asurfacewatergaugewillbeinstalledand monitored for3yearsor until two bank full events occur in separate monitoring years. Ifmonitoringrequirementsand anon-sitereview withStateandFederalenvironmental regulatoryagenciesare successful,NCDOTmayrequest closeout.Theproposedstream mitigationcreditswouldbeavailableto mitigate forstreamimpactsassociated with other NCDOT projects requiring a DA permit within the same HUC; contingentuponsuccessful monitoringandagency approval. It is understood that allconditions of the original permit and applicable modifications remain valid.
