Box 655 Tabor City, North Carolina 28436 Subject: Issuance of NPDES Permit NC0026000 Tabor City Wastewater Treatment Plant Columbus County Dear Mayor Baxter: The Division of Water Quality (the Division) hereby issues this final permit for the subject facility. This permit is issued to the Town of Tabor City pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994, or as subsequently amended. Revising BOD5, Fecal, and Ammonia (NH3 as. N) Limits. In cooperation with the EPA region 4, the Division has added ammonia Weekly Average limits to permits across the state. Because Tabor City is a majordischarger,` Weekly Average limits are calculated as "Monthly Average values times three." This corresponds to. new Weekly Averages of 6.0 mg/L (summer), and 12.0 mg/L (Winter). Also note that the Division listed BOD5 and fecal limits in your previous permit in error as Daily Maximums. These limits have been revised to Weekly Averages consistent with municipalities statewide. Concerning Mercury — Correction to the DRAFT Permit. Following discussions with EPA Region 4, an effluent limit of 12 ng/L (Weekly Average) for Total Mercury has been added to this permit because effluent data demonstrated reasonable potential to exceed the mercury water quality standard. This permit includes a two-year compliance schedule before the mercury limit becomes effective, although monitoring commences on the permit effective date. The compliance schedule provides time for the facility to evaluate effluent mercury concentrations as well as time to investigate any potentially significant sources of mercury. Effluent limits and monitoring may be deleted or modified by the Division in the future, upon written request by the permittee, if the permittee provides new data (recommended minimum 6-month period) that show either: a) no reasonable potential for the effluent to exceed 12 ng/L; or b) that the facility does not discharge mercury at concentrations above potable source -water (intake) concentrations [compare WWTP effluent mercury to WTP mercury sampled upstream of the potable -water intake]. NOTE: If the permittee does not submit such data and does not request a mercury re-evaluation, the mercury limit will become effective on July 1, 2007, two years from the permit effective date. Annual Priority Pollutant Analyses --Correction to the DRAFT Permit. The permittee must provide Priority Pollutant Analyses (PPA) annually in compliance with statewide requirement of all municipal discharges [see permit Special Condition A. (4.)]. The PPA requirement was omitted from the DRAFT permit in. error. As part of this renewal, the Division conducted Reasonable Potential Analyses (RPA) on contaminants of concern. These include potential toxicants and metals considering Significant Industrial Users (SIUs), previous effluent monitoring, and this facility's Pretreatment Program. This RPA evaluates "reasonable potential" for parameters to exceed North Carolina's instream Water Quality Standards. Having concluded its review, the Division offers the following comments and changes to your previous permit (see table). Table 4. Total Residual Chlorine (TRC). Finally, the Division has added a TRC limit to your permit, in keeping with the newly adopted statewide standard for chlorine. This limit is 17 µg/L considering your discharge under "zero flow" receiving -stream conditions (7Q10 and 30Q2 = 0.0 fps). Town of Tabor City must comply with this permit limit by January 1, 2007, 18 months from the permit effective date. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within thirty (30) days after receiving this letter. Your request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and must be filed with the office of Administrative Hearings [6714 Mail Service Center, Raleigh, NC 27699-6714]. Unless such a demand is made, this permit shall be final and binding. This permit is not transferable except after notifying the Division of Water Quality. The Division may require modification, or revocation and re -issuance of this permit. Mercury monitoring is required immediately. The effluent limit takes effect on July 1, 2007 unless the Permittee requests a compliance review supported by new data. Permittee shall report mercury using sample -collection criteria and test methods established by EPA Test Method 1631 [see A. (2.)]. 5. Chronic Toxicity (Ceriodaphnia) at 90 %; quarterly during March, June, September, December; see A. (3.). 6. Variable: instream samples shall be collected upstream and downstream 3/week during the summer months of June, July, August, and September; samples shall be collected weekly during the rest of the year. Permit NC0026000 A. (2.) MERCURY REOPENER. The Division may re -open this permit to require mercury load limitations, mercury minimization plans, and/or source water characterization following completion of the Phase II Mercury TMDL for the Lumber and Waccamaw River watersheds. A. (3.) CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90 %. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of, March, June, September, .and December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure, performed as the first test of any single quarter, results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months, as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document (such as minimum control organism survival, minimum control organism reproduction, and/or appropriate environmental controls) shall constitute an invalid test and will require immediate follow-up testing, to be completed no later than the last day of the month following the month of initial monitoring. The permittee's 5-year NPDES permit expired August 31, 2004 and they have requested renewal from the Division of Water Quality (the Division). This Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to f / determine permit limits and monitoring conditions. j+a/(// FACILITY RECORDS REVIEW Facility Description. The Tabor City WWTP (Table 1) is a 1.1 MGD publicly owned treatment works (POTW) utilizing a Grade III activated sludge wastewater treatment facility to treat domestic and industrial wastewater. The Tabor City treatment system utilizes: an influent pumping station; Parshall flume; mechanical bar screen; mechanical grit removal; dual -train activated sludge extended - aeration plant utilizing mechanical surface aerators (one basin operated as an equalization basin); dual clarifiers operated in series; four each, Waterlink Super sand filters (currently bypassed); gas chlorine / sulfur -dioxide feed system; chlorine contact basin; aerated sludge -holding basin; effluent sampler; ultrasonic flow meter; and a back-up power generator. Wilmington Regional Office (WiRO) conducted an annual facility inspection and Jim Bushardt prepared a Staff Report dated May 6, 2004. The WiRO staff found the facility in good condition and in compliance with the permit. They recommend that the NPDES Unit renew the permit in accordance with the basin plan. Division Records and Permittee's Renewal Application. The current permit expired on August 31, 2004, and the Division received a timely request to renew the permit from the permittee's (Standard Form 2A) March 2004. COMPLIANCE REVIEW Waste Load Allocation (WLA). The Division prepared the last WLA for the receiving stream in June 1994 and developed effluent limits and monitoring requirements considering an in -stream waste concentration (IWC) of 90 % at 1.1 MGD, considering zero -flow stream conditions. The Division views these limits and monitoring requirements appropriate for renewal except as outlined below (see Permitting Approach Summary). Verifying Existing Stream Conditions. This facility discharges under zero -flow stream conditions to an unnamed tributary of Grissett Swamp [Stream Index No. 15- 17-1-(5)], a Class C Swamp waterbody located within the Lumber River Basin. While not formally listed as "impaired" [not on the Division 303(d) list], Grissett Swamp contributes as one of 11 drainages within the Lumber River Basin with fish advisories for mercury. Concerning Mercury. Beginning in September 2003, the Division recommended that Moore County begin monitoring Quarterly for mercury using new EPA method 1631. The Division did not impose a permit limit. Conditions have not changed. To date, the Division has received 12 sample results using Method 1631 beginning in February 2004. Per agreement with EPA, quarterly monitoring will continue without a permit limit until sufficient data have been collected to firmly evaluate reasonable potential. A note will be added to the cover letter stating that the permittee must continue this quarterly - monitoring using Method 1631. A "re -opener" clause has been added to the permit to emphasize the need to reevaluate should compliance questions arise. DMR Instream and Effluent Flow Data Review. The Division reviewed 22 months of DMRs (January 2003 through October 2004) noting monthly -average flows averaging approximately 0.612 MGD or about 56% of its permitted capacity. DMRs appear regular, thorough, and complete The Division contacted the Permittee to correct the database for mercury and the Permittee complied. Effluent Total Residual Chlorine (TRC). The permittee currently chlorinates and de -chlorinates its effluent but is un-restricted by a Weekly Average TRC limit. In accordance with statewide policy requiring TRC limit in all permits, and considering discharge to a "zero -flow" stream (7Q10 = 0.0 fps), a limit of 17 µg/L will be added to this permit. • DRAFT Fact Shcct Renewal -- NPDES NC0026t)00 Pate 2 Whole Effluent Toxicity (WET) Testing. The Division reviewed Tabor City's quarterly Whole Effluent Toxicity records from January 1997 through September 2004 (32 quarterly tests). Tabor City fail its WET test in March and June of 2002 prompting the Division to require metals monitoring in the previous. The discharge failed again in June 2004, but subsequent mandatory WET tests (July, August, and September) passed indicating that toxicity issues have been resolved. No violations have been reported since September 2003 through November 2004. Notices of Violation (NOVs) and Penalty Assessment. Division records for the time -period January 2001 through September 2004 show permit limit violations in May, August, and October of 2003 for BOD-5. All proceeded to fine enforcement. In June 2002, the permittee saw an NOV for ammonia that also proceeded to enforcement. Toxicant Chronic and Acute Impact — Pollutants of Concern (POCs). To establish POCs, the Division reviewed the permit application, discharge monitoring reports (Jan 2003 through Sep 2004), pretreatment data, and the Basin Plan. The Division then used the standard Reasonable Potential Analysis (RPA) to calculate a maximum predicted concentration for each POC. Each maximum was then compared to the POC's freshwater Chronic Standard (Table 2) and also to its Final Acute Value (%2 FAV) for freshwater (Table 3). If by the above method, a POC showed reasonable potential to exceed its %2 FAV, the Division included a permit limit as a Daily Maximum to protect the receiving stream against acute toxic affects. Similarly, if the maximum exceeded the chronic standard, a Weekly Average limit was added to the permit. Findings and draft permit changes are summarized below (see Renewal Summary, Table 4). The assistance provided during the inpection by Ms. Moore is greatly appreciated. She has reconfigured the treatment train to lessen storm -related flow surges through the plant and to maximize sedimentation detention time. The facility site review revealed that the grounds were well mantained; but solids accumulations were found on both clarifier weirs and solids accumulations were found within the chlorine contact basin. The solids accumulations in the chlorine contact basin were determined to have been caused by storm -related plant flow surges and because the filters were being bypassed. The ORC appears to be doing everything possible to maintain effluent limits compliance. However, it seems obvious that collection system remediation is neccessary and the plant flow surges may be hampering the filter operation. A review of influent flow values taken over the period September 2003 to February 2004 indicate significant flow variation by comparing maximum and minimum daily flow values. These results show that the Town has an inflow/infiltration problem. The Town is encouraged to take the needed remediation steps to abate or control collection system I/I to levels. that the treatment plant can tolerate. Leonard, Jr. Town of Tabor City Post Office Box 655 Tabor City, North Carolina 28463 Subject Notice of Violation Town of Tabor City NPDES Permit No. NC0026000 Columbus County Dear Mr. Leonard: A permit renewal inspection was performed on April 21, 2004 at the Town's wastewater treatment facility. An inspection summary is enclosed for your convenience. This letter is to inform you that the Town is in violation of North Carolina General Statute 143-215.6A(a)(2) and Permit Condition C.2 for bypassing the filters and allowing sludge to accumulate within the chlorinecontactbasin. These actions are not considered to represent proper wastewater treatment plant operation. Sludge removal is anticipated to create temporary effluent limit exceedance for several permitted parameters. In addition, S&B Maintenance does not have permitting authority to remove sludge from the Town's wastewater plant unless the sludge is land applied in accordance with the Town's land application of residuals permit. Also, the mechanical aerator within the sludge holding tank was not functional. Please be advised that violation of the plant operation and maintenance clause within Permit No. NC0026000 may cause the assessment of a civil penalty of up to $25,000 per violation in accordance with North Carolina General Statute 143-215.6A(a). It is requested that you provide a written reply addressing cause and corrective actions concerning the filter bypass/chlorine contact basin sludge accumulation and the malfunctioning sludge aerator within 15 days of the receipt of this letter.
