The Division has reviewed your request for modification of the subject permit (NC0050342).
Your request to establish the effluent sampling location for Outfall 001 composite sampling at
the parshall flume immediately below the chlorine injection point has been approved. The
additional request to allow you to collect 002 effluent monitoring samples at the metering flume
(via grab samples) for all parameters except fecal Coliform bacteria, total residual chlorine,
temperature and dissolved oxygen has been approved.
In addition, we have corrected language of the Whole Effluent Toxicity Test Procedure in
accordance with the latest amendments to the established protocol for Muddy Creek WWTP
and Archie Elledge WWTP. Please find enclosed one revised Effluent Limitations and Monitoring
Requirements page for outfall 001 and one revised Effluent Limitations and Monitoring
Requirements page for outfall 002 and two revised Special Condition pages . These pages
should be inserted into your permit. The old pages may then be discarded. All other terms
and conditions contained in the original permit remain unchanged and in full effect. This
permit modification is issued pursuant to the requirements of North Carolina General Statutes
143-215.1 and the Memorandum of Agreement between North Carolina and the U. S.
Environmental Protection Agency.
If any parts, measurement frequencies or sampling requirements contained in this permit
modification are unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this letter. This request must be a
written petition conforming to Chapter 150B of the North Carolina General Statutes, filed with
the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina
27611-7447. Unless such demand is made, this decision shall be final and binding.

1. Sample Locations: I — Influent, E — Effluent, U — Upstream at idols Dam; D — Downstream 0.26 miles below US Hwy 64. The effluent composite
sampling location is established at the parshall flume immediately below the chlorine injection point. Instream sampling requirements are provisionally
waived in light of the permittee's participation in the Yadkin -Pee Dee River Basin Association. Should participation in the Association cease, all
instream sampling requirements are immediately reinstated. Should instream sampling be reinstated, grab samples shall be collected 3/week during the
months of June, July, August, and September and weekly during the remainder of the year.
2. The monthly average effluent CBODS and Total Suspended Solids concentrations shall not exceed 15% of their respective influent values (85% removal).
3. The daily average dissolved oxygen concentration in the effluent shall not be less than 5.0 mg/L. Effluent samples shall be taken prior to entering the 5
mile outfall line.

SUPPLEMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A (2). CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) — 30.0 MGD
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant
mortality to Ceriodaphnia dubia at an effluent concentration of 76%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the
"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or
subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised -February 1998) or subsequent versions. The tests will be performed during the months of
January, April, July and October. Effluent sampling for this testing shall be performed at the NPDES
permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the
permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two
following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the
highest concentration having no detectable impairment of reproduction or survival and the lowest
concentration that does have a detectable impairment of reproduction or survival. The definition of
"detectable impairment," collection methods, exposure regimes, and further statistical methods are
specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -
February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter
code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3
(original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later

concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature.
Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the
facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow"
in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address
cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring
will be required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water
Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include
alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later than
the last day of the month following the month of the initial monitoring.

I have just reviewed a letter to you from Stan Webb with the City of Winston Salem
dated October 7th. The WSRO has no problems with their request for the monitoring
amendment.

Muddy Creek WWTP (NC0050342)
City of Winston-Salem/Forsyth County
Our Muddy Creek Wastewater Treatment Plant's dechlorination facility is located near
the effluent outfall pipe at a point about one mile below the flow metering flume. We are
unable to collect flow proportional effluent monitoring samples downstream of
dechlorination because of the distance between this location and the metering flume.
Data was submitted to the Winston-Salem Regional Office that indicates that there is no
difference between flow proportional samples collected at the plant's parshall flume and
"time" composite samples collected just downstream of the dechlorination site. We
requested and received a permit amendment via a letter from Dave Goodrich on January
20, 2004 that allows us to collect our composite sample at the flume. A copy of this letter
is attached for your convenience.
The plant's NPDES permit that became effective on August 1, 2004 did not include the
language authorizing us to collect our composite effluent sample at the flume. I believe
this is just an oversight and I request that DWQ send us a letter amending our existin&_
permit to allow us to collect composite effluent monitoring samples for the 001 outfall at
t e umir:—`"
I also request that this amendment allow us to collect "grab" 002 effluent monitoring
sa sat the metering flume_foc_a1Lparameters except feca f coliform bacteria, total-,_
residual chlorine, temperature and dissolved oxygen. These samples will be taken at the
discharge point.
We ask that we be allowed to collect grab samples for certain 002 effluent grab samples
at the flume because the flow discharged at the 001 and the 002 outfalls comes from the

same pipe and there is no difference between the concentrations of CBOD, TSS,
Ammonia, Total Nitrogen, Total Phosphorus, Conductivity and pH in grab samples taken
from the 001 and the 002 discharges.
The location where the 002 outfall actually discharges lies in a floodway about 225 yards
below the flume and this area is frequently inundated by flood water during times when
the 002 outfall is actually discharging. This makes the collection of monitoring samples
either extremely dangerous or impossible.
We feel that collecting monitoring samples at the flume for parameters whose
concentrations will not be affected by the short transit to the 002 discharge point will
enable us to always perform some monitoring when the 002 outfall is actually
discharging.

During the past several months discussions have been ongoing between your agency and the Division of Water
Quality staff concerning the location of the "effluent" composite sampling location regarding the Muddy Creek
WWTP (NC0050342). Based on the information you have provided to Steve Tedder of our Winston Salem
Regional Office and the studies conducted, .this office concurs with your request to establish the effluent sampling

States: If it is emonstrated tote satisfaction of the Director that any of the tests and measurements, sampling
points, or frequency of sampling requirements, as required in this rule for a particular SIC group, are not
applicable to the discharge of a particular water pollution control facility, or if it can be demonstrated that the
objectives of this section can be achieved by other acceptable means, then such requirements may be waived or
modified to the extent the director determines to be appropriate." Under this authority such demonstration has
been accomplished and thisletter approves the newly established effluent sampling point for the subject
wastewater treatment facility.
