The site includes unnamed tributaries in the Cape Fear River Basin, Cataloging Unit (03030002), and is located in Chatham County, North Carolina. The purpose of this letter is to transmit comments provided by the NC Interagency Review Team (NCIRT) during the review of the annual monitoring report (see attached) and to confirm the Year 3 credit release for this mitigation site. Pursuant to the site’s Umbrella Mitigation Banking Instrument and the site-specific Mitigation Plan, the following mitigation credits shall be available for sale provided the annual monitoring report demonstrates interim performance standards are being met: 10% of the total enhancement and/or restoration Stream Mitigation Units (SMUs) associated with year 3 annual monitoring (431.8 Warm Water SMUs) Based on a review of the data provided for the stream restoration on the site, we confirm that you have satisfied the above requirements, and 431.8 Warm Water SMUs are now available for sale. To date, 2,590.8 SMUs (60% of the total SMUs) have been released for sale. Please review the comments provided by the NCIRT during their review of the monitoring report. While it is not necessary to provide a response to specific comments at this time, please be sure to address the issues raised in future monitoring report submittals. Was floodplain debris observed along this reach during monitoring visits? 2.The cattle encroachment is very concerning. DWR is glad that WEI is working with the landowner on a long-term resolution since continued encroachments can delay project closeout. 3. DWR appreciated the level of detail provided in the monitoring report narratives, particularly the areas of concern and adaptive management sections. 4.DWR recommends watching sweet gum densities in MY4 and MY5 to determine if thinning would benefit site species diversity and planted stem success. Casey Haywood, USACE: 1.The ongoing cattle encroachments at the internal crossings are concerning. It would be helpful to include photos of the internal crossings, especially if there is any damage as a result of the cattle. Appreciate the continued coordination with the landowner. 2.Please continue to monitor sweet gum to determine if thinning would be appropriate to promote the establishment of more desirable species, and to ensure they are not outcompeting the planted stems.
