Dear Mr. Keaton:
This correspondence is in reference to the Wildlands Cane Creek Umbrella Mitigation
Bank, Bethel Branch Mitigation Site. The site includes unnamed tributaries in the Cape
Fear River Basin, Cataloging Unit (03030002), and is located in Chatham County, North
Carolina. The purpose of this letter is to transmit comments provided by the NC
Interagency Review Team (NCIRT) during the review of the annual monitoring report
(see attached) and to confirm the Year 3 credit release for this mitigation site.
Pursuant to the site’s Umbrella Mitigation Banking Instrument and the site-specific
Mitigation Plan, the following mitigation credits shall be available for sale provided the
annual monitoring report demonstrates interim performance standards are being met:
10% of the total enhancement and/or restoration Stream Mitigation Units
(SMUs) associated with year 3 annual monitoring (520.2 Warm Water SMUs)
15% of the total enhancement and/or restoration Wetland Mitigation Units
(WMUs) associated with year 3 annual monitoring (0.471 Riparian Riverine
Wetland WMUs)
Based on a review of the data provided for the stream and wetland restoration on the
site, we confirm that you have satisfied the above requirements, and 520.2 Warm Water
SMUs and 0.471 WMUs are now available for sale. To date, 3,121.2 SMUs (60% of the
total SMUs) and 2.041 WMUs (65% of the total WMUs) have been released for sale.
Please review the comments provided by the NCIRT during their review of the
monitoring report. While it is not necessary to provide a response to specific comments
at this time, please be sure to address the issues raised in future monitoring report
submittals.

SUBJECT: ActionID # SAW-2016-02365, NCIRT Review Comments on the Wildlands
Cane Creek Umbrella Mitigation Bank, Bethel BranchYear 3 Monitoring Report
Erin Davis, NCDWR:
1.The UT3 channel vegetation cover is concerning. DWR is glad that additional live
stakes were installed to aid in shading. If the in-stream vegetation is not identified
as an invasive species, DWR would recommend MY4 be the last year of
herbicide control in order for the IRT to properly evaluate how this system is
naturally trending, unless a formal adaptive management plan is proposed.
2. DWR appreciated the level of detail provided in the monitoring report narratives,
particularly the areas of concern and adaptive management sections.
3.DWR recommends watching sweet gum densities in MY4 and MY5 to determine
if thinning would benefit site species diversity and planted stem success.
Casey Haywood, USACE:
1.65 elm were recorded in VP1, recommend only counting volunteers that are over
12 inchesin height.
