Also reference the email correspondence dated July 13, 2006, submitted on your behalf by Mr. Chris Huysman of Wetland & Natural Resource Consultants, regarding changes in your plans to construct the proposed Bridges at Mint Hill. Department of the Army authorization is only necessary when there is a discharge of fill material into jurisdictional waters and/or wetlands. According to Mr. Huysman, your plans have been revised such that the proposed road crossings will be constructed utilizing bottomless arch culverts and/or bridges in a manner that entirely spans all jurisdictional features. Therefore, your development, if constructed according to these new plans avoiding all discharges of fill into jurisdictional areas, would not require DA authorization. Please be reminded that temporary coffer dams, temporary construction crossings, stream diversion structures, and any fill material placed into waters /wetlands is considered a discharge of fill material. Our February 2, 2006 verification remains in effect until March 18, 2007. Any discharge of fill material not included in the plans authorized by this verification would require further coordination and would likely require additional DA authorizations.
