On behalf of our client, Mr. Jack Stocks, this letter is to verify that documentation concerning the jurisdictional
limits of the Waters and Wetlands of the US/NC for the referenced project was hand delivered to the US Army
Corps of Engineers, Wilmington District, Wilmington Field Office, on January 25, 2007. Proof of receipt by the
Corps of Engineers is confirmed by the attached checklist executed by Mr. Tom Farrell. Copies were also
delivered to your office on the same date. Determinations were made utilizing the US Army Corps of Engineers'
YR 87 Wetland Delineation Manual and findings were subsequently surveyed by Mark A. Stocks, PLS, PC, and
depicted on the aforementioned map.
This correspondence is regarding a parcel North of and adjacent to Old Lennon Road, South of and adjacent to
Timber Creek, near Supply, Brunswick County, North Carolina., bainS more accuratiely described by a map
prepared by Mark A, Stocks, PLS, PC (Wilmington, North Carolina) and identified as Tract l of the Lucy J.
Lennon Division, dated December 29, 2006.

Results of field surveys indicate that too many stormwater projects are not performing as intended and
some of the problems have been with swales, so there is reason to adhere more closely to the rule and
burp design guidelines. Some of your swales were significantly over the 1 acre per 100 ft of swale
length, for example swale # 11 is 8.84 acres for —1201f and #13 - 5:100. Is there another measure
that you have provided to meet the intended goal of infiltration on the swales with large drainage
areas? Are you meeting the other design requirements on the swales such as'<5% longitudinal slope

I just noticed a note on plan #C3, under the scour hole detail, that you are not providing level
spreaders on swale 9, 11, or 13. If the stormwater outlets drains to wetlands or surface waters, then a
level spreader is required. It appears that swale i 1 and 13 on both plans C 1 and C2 drain to wetlands
or surface waters. It is best to call out the level spreader on the plan where the swale is located, which
is C 1 and C2.
In reference to your note below about the due date: the required due date is set by express process
which requires additional information to be submitted ,,,vithin 5 working days of the notice. An
extension to March 8, 2007 to provide the additional information for this project is allowed per your
request below.

manual for many years but has not been the basis for review. The historical review of these projects
has been for 100' of 5•'1 swale length period. We have relied on these historical reviews in the design
of the project.

The Wilmington Regional Office received a Stormwater Management Permit Application for Timber Creek`.
Plantation on February 9, 2007. A preliminary review of that information has determined that the application is not d ,
complete. The following information is needed to continue the stormwater review:
JV Provide length of swale to be approximately 100 feet per acre of drainage area. Reference the
April 1999 BMP section 5.6 and the rule section 15 NCAC 2H.1008 (g)(2).
Provide note on the plans that the walking trail and elevated walkway in the wetland and/or
..A'K surface water areas are constructed of raised, open wood decking (or the equivalent) with a detail
on the plans.

Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action
pursuant to NCGS 143-215.6A.

Timber Creek Plantation is a proposed 110.99 acre residential subdivision of one hundred and
ninety six lots. Approximately twenty four acres will be disturbed for the construction of roads,
swales, basins and clubhouse area. Each lot will be allocated 5,000 sf each (980,000 sf total)
with 393,312 sf of roads and 35,973 sf for the clubhouse area. This is a total of 1,409,285 sf and
28.89% impervious.
Runoff will be treated by 5:1 grass swales of 100 ft minimum length. Overflow will discharge to
Timber Creek, a tributary of the Lockwood Folly River. Sedimentation control will be by
constructed basins, silt fence, vegetated swales, construction entrances, energy dissipators and
sheet flow of existing heavy vegetation.

I have enclosed the wetland map and upland/ wetland determination forms concerning the aforementioned
property that will be reviewed in the field by The US Army Corps of Engineers, Wilmington District's
regulatory agent. Upon their review and concurrence, verbal approval of our jurisdictional determination
by this agent will grant Mr. Stocks the ability to move forward with a sediment and erosion control plan,
until the Corps is once again allowed by the federal government to sign wetland determination maps this
verbal approval is sufficient. The Corps currently has the same map that you now have and as soon as a
meeting onsite can be scheduled with the Corps and our jurisdictional determination is approved we will
contact you with this information.

This office has received a soil erosion and sediment control plan for the project listed above which
was submitted as required by the North Carolina Sedimentation Pollution Control Act (G.S. 113A-57 (4)).
The Act requires that all persons disturbing an area of one or more acres of land must obtain approval of a soil
erosion control plan prior to the commencement of the land -disturbing activity (G.S. 113A-54(d) (4)).
The review period for an express review.is three days from receipt of a complete plan. If additional
information is requested, it must be submitted within five working days of receipt.
Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to
the approval of an erosion and sediment control plan is a violation of the Act.
We have performed a preliminary review of your submitted plan and have determined that additional
