The pond in the woods behind this address is not one of the stormwater management BMP's for this development. We
have never done any work on this pond. This pond does not have anything to do with the NCDEQ Stormwater permit for

I was out last week, and �o 4rn just now geiting ,o nay emails. Th- re is a long history with this -Pc,+-.d, but to my
knowledge it has been redesiGned and installed as intended. The engineer certified that this was the case (see bciov-!). i
am not sure of the "repcir" that is needed?
this system was originally designed —2006 as an infiltration basin. That system failed, and in 2015 the berm blew out
into the w lands. (It was a siE,,riificant breach.) We worked wi'Lh the engineers to try to get the oriLinal design to ra'ori:,
but the wu`I-er table was too high. It 1had to be redesigned as a wot pond rather than an infiltration basin. Trey made it
as large as they could, giver the 'act 'Chat all of the homes were already constructed and there wasn't more land
available to make it as large z,E. v,,o v. oUId have liked. The pond is intended to settle sediment and other pollutQrs 'LS
before the water is s ischGrLed to the wetlands/streams. The State does not have any regulatory authority over flooding,
and so the pond does not serve as. flood control.

This afternoon the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) received a call from the Property Manager, Elizabeth Parker of Atlantic Shores Management.
She has reported a sinkhole in Yard Inlet #3 (YI-3 on the plan below). Her contractor had told her that
the box has failed. He recommends digging it out to seal it. The project is currently in-house pending
review for permit transfer. Please address this situation, and otherwise get the project ready for the
upcoming transfer inspection. Please respond by May 15, 2019. If you need an extension to complete the
work, please let me know.

2H .1003 and North Carolina General Statute 143-214.7, including the operation and maintenance of the

Please also note that any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the stormwater rules is subject to enforcement action as set forth in
NCGS 143 Article 21, including the assessment of civil penalties of up to $25,000 per day.
