Dear Mr. Dilsheimer:
On December 7, 2007, the Wilmington Regional Office received a plan revision for Stormwater
Management Permit Number SW8 060608MOD. The revisions include reallocation 600
square feet of built -upon -area from lot 36 (600 sf less) to lot 29 (600 sf more). It has been
determined that a formal permit modification is not required for the proposed changes. We are
forwarding you an approved copy of the revised plans for your files. Please replace the old
approved plan sheet C.5.1 with the new plan sheet C.5.1 stamped approved on December 17,
2007. Also, replace page 5 of 9 of the approved permit with the new pave 5 of 9, enclosed.
Please be aware that all terms and conditions of the permit issued on November 9, 2007,
remain in full force and effect. Please also understand that the approval of this revision to
the approved plans for the subject State Stormwater Permit is done on a case -by -case
basis. Any other changes to this project must be submitted to and approved through the
Division of Water Quality prior to construction. The issuance of this plan revision does not
preclude the permittee from complying with all other applicable statutes, rules, regulations
or ordinances which may have jurisdiction over the proposed activity, and obtaining a
permit or approval prior to construction.

13. The permittee shall at all times provide the operation and maintenance
necessary to assure that all components of the permitted stormwater system
function at optimum efficiency. The approved Operation and Maintenance Plan
must be followed in its entirety and maintenance must occur at the scheduled
intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of structures, orifice, catch basins and
piping.
g. Access to all components of the system must be available at all times.
14. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
15. Prior to the sale of any lot, the following deed restrictions must be recorded:
a. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW8 060608, as issued
by the Division of Water Quality under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater
Management Permit.
C. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division
of Water Quality.
e. Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Water Quality.
f. The maximum built -upon area per lot is as follows:

Deed Restrictions & Protective Covenances
In accordance with Title 15 NCAC 2H.1000, the Stormwater Management Regulations, deed restrictions and
protective covenants are required for High Density Residential Subdivisions where lots will be subdivided and
sold and runoff will be treated in an engineered stormwater control facility. Deed restrictions and protective
covenants are necessary to ensure that the development maintains a "built -upon" area consistent with the
design criteria used to size the stormwater control facility.

This allotted amount includes any built -upon area constructed within the lot property boundaries, and

All runoff from the built -upon areas on the lot must drain into the permitted system. This may be
accomplished through a variety of means including roof drain gutters which drain to the street, grading
the lot to drain toward the street, or grading perimeter swales to collect the lot runoff and directing them
into a component of the, stormwater collection system. Lots that will naturally drain into the system are
not required to pro,*

Dear Mr. Baker:
Cavanaugh & Associates, P.A. (CA) on behalf of DCNC North Carolina I, LLC, hereby submits
the following application to the NCDENR Division of Water Quality for review of a revision of
High Density Stormwater Permit SW8 060608. This existing permit was issued as a
modification for the subject development identified as 'The Villages of Turtle Creek,' which is
located in the Town of Surf City, Pender County, North Carolina on November 9, 2007.
CA is applying for the revision of this permit based on changes to the Lot BUA's for Lot 29 and
Lot 36. Both Lots are located within the same drainage area and therefore, no stormwater
infiltration basins volumes will change, rather only the associated BUAs for Lot 29 and Lot 36.
Specifically, 600 square foot of BUA from Lot 36 will be moved to Lot 29.
To facilitate your review of the enclosed documentation, the following is a list of the items
constituting the application:
1. A check made payable to NC DENR in the amount of $1,000.00 to satisfy the review fee for
review of this revised application.
2. One (1) original copy of the executed 'Stormwater Management Permit Application Form.'
3. One (1) copy of the executed `High Density Residential Subdivision Deed Restrictions and
Protective Covenances'.
4. Two (2) copies of Sheet C.5.1 with the revised BUA Table shown.

The Villages of Turtle Creek
The Express Permitting Group is in receipt of the request, received on 11/28/07, to revise the
storrriwater plan for Villages of Turtle Creek. Chris Baker will be performing the review. A submittal
date of December 7, 2007 has been established. However, Chris is familiar with the project since he
just worked on the permit. He is willing to accept the package as a "drop-off' and not require a
meeting. The fee for a Plan Revision in Express is $1,000. The check should accompany the
package. When you bring the package in, please have me or Chris paged by the receptionist so that
one of us can come to the lobby and get the submittal. This is important.
