North Carolina General Statute 143-215.613 (i) provides that: Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other document filed or required to be maintained under this Article or a rule implementing this Article ... shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed ten thousand dollars ($1D,000). Moore Street SE Southport, NC 28461 Dear Mr. Atack, November 18, 2011 Subject: NPDES Permit COC NCG060031 Representative Outfall Status Outfalls 02, 03, 04 and 06 The Division has reviewed the stormwater data that was sent for stormwater discharge outfalls 01, 02, 03, 04, 05 and 06. After reviewing the stormwater data, industrial site map, potential contamination sources in each drainage basin and secondary containment capabilities, the Wilmington Regional Office is satisfied with establishing Outfall 01 as the representative outfall for stormwater discharge outfalls 02, 03, 04 and 06. Please remember that qualitative monitoring is still required for all the outfalls regardless of representative outfall status. You are required to provide analytical monitoring for outfalls 01 and 05 in accordance with the NPDES permit NCG060031. Should you have any questions concerning this correspondence, please do not hesitate to contact this office at 910-796-7343. Please remember to update your Stormwater Pollution Prevention Plan accordingly. The granting of representative outfall status does not preclude the Division from requesting additional monitoring at any outfalls in the future or preclude the Division at any time, from eliminating representative outfall status by written notification to Archer Daniels Midland Company.
