Dear Mr. Stephens:
The Wilmington Regional Office received a complete modification to the Stormwater Management Permit Application for
Magnolia Greens Master Plan on April 26, 2000. Staff review of the plans and specifications has determined that the project,
as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit
No. SW8 970104 Modification, dated April 28, 2000, for the construction of the project, Magnolia Greens Master Plan.
This permit shall be effective from the date of issuance until October 4, 2009, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in
the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office
of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall
be final and binding.

and the approved stormwater management plans and specifications and other supporting data as attached and on
file with and approved by the Division of Water QiLality and considered a part of this permit.
This modified permit shall be effective from the date of issuance until October 4, 2009 and shall be subject to the
following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data. Stormwater Management measures are 2 wet detention ponds and a
curb outlet system for the uncollected low density portions of the project.
2. This stormwater system has been approved for the management of stormwater runoff as described on page
3 of this permit, the Project Data Sheet. The subdivision is permitted for a total of 1019 lots. The built -upon
area permitted to date is: 226 single family lots @4,000 ft2 each for Sections 1-9; 76 lots @3,500 ft2 each
for Sections 11 & 12; the Clubhouse @4.2 acres which drains to the pond permitted under SW8 990628;-
Tract N (Section 8) is permitted for 21 lots @4,000 ft2; and Tract D is permitted for 67 lots @4,000 ft2; Patio
Homes I Tracts E and O (Sections 8, 9, and 10) are permitted under SW8 981008 for 99 lots @4,000 Wand
a detention pond; the West Commercial Area is permitted under SW8 980807 for 3.93 acres of built -upon
area. The Fairway 'Villas is permitted for 6.24 acres under SW8 990628; Lanvale Townhomes is permitted
for 9.75 acres under SW8 990047; and Patio Homes III is permitted for 75 lots @3,500 ft2; Future
development includes the East Commercial Area @10.57 acres; 190 Multi -family units @1,200 ft2 each
(Tract P); and 236 single family lots @4,000 ft2 each (Tracts B, C &D). Total proposed BUA is 167.67
acres.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts
of the permit. The project must maintain an overall density of 30% of less.

II. SCHEDULE OF COMPLIANCE
No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature (such as swales or curb
outlet swales) shown on the approved plans as part of the stormwater management system without
submitting a revision to the permit and receiving approval from the Division prior to construction.
2. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable
built -upon area. Once the lot transfer is complete, the built -upon area may not be revised without approval
from the Division of Water Quality, and responsibility for meeting the built -upon area limit is transferred
to the individual property owner.
3. The uncollected portions of the low density subdivision are served by a Curb Outlet System. The swales are
generally located between lots, and must be maintained with a stable, vegetated 5:1 sideslope, be a minimum
of 100' long, have a longitudinal slope of 5% or less, maintain a dense, vegetated cover, and be able to carry
the peak flow from a 10 year storm in a non -erosive manner.
4. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amnimt of buslt-upon area.
e. Further subdivision of the project area.
f Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
5. The Director may determine that other revisions to the project should require a modification to the permit.
6. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written
time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall
provide copies of revised plans and certification in writing to the Director that the changes have been made.
7. The stormwater management system (ponds and curb outlet swale system) shall be constructed in their
entirety, vegetated and operational for their intended use prior to the construction of any built -upon surface.
8. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
9. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of
this permitted facility, a certification must be received from an appropriate designer for the system installed
certifying that the permitted facility has been installed in accordance with this permit, the approved plans
and specifications, and other supporting documentation. Any deviations from the approved plans and.
specifications must be noted on the Certification.
10. Decorative spray fountains will not be allowed in the stormwater treatment system.
i 1. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior
to operation as a stormwater treatment device, and prior to occupancy of the facility.
12. Prior to transfer of ownership from the permittee to a third party such as an HOA, the stormwater
management systems must be inspected by DWQ personnel, and determined to be in compliance with all
permit conditions. Records of maintenance activities will be required.

13. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must
be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited
to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes of the pond and the swales.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
14. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DWQ. The records will indicate the date, activity, name of person performing the work and what actions
were taken.
15. Prior to the sale of any lot, deed restrictions must be recorded which limit the built -upon area per lot to the
amount as shown on the Project Data Sheet, per Section I, Part 2. The recorded statements must follow the
form:
a. "The maximum built -upon area per lot in this section is *see below square feet. This allottcd amount
includes any built -upon area constructed within the lot property boundaries, and that portion of the
right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but
is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, and coquina, but does not
include, raised, open wood decking, or the water surface of swimming pools."
b. "The covenants pertaining to stormwater regulations may not be changed or .. deleted without
concurrence of the State."
C. "Alteration of the drainage as shown on the approved plan, including the curb outlet swales, may not
take place without the concurrence of the State."
d. "Each lot shall maintain a minimum of 30' of vegetated buffer between any impervious surface on
the lot and surface waters."
* The permittee will fill in the built -upon area associated with each lot in the section per the BUA limits
as lasted in Section I. Part 2 this permit, and as shown on the summary table on the approved Master Plan
16. A copy of the recorded deed restrictions for each section must be submitted to the Division within 30 days
of the date of recording the plat, and prior to selling lots in that section. The recorded copy must bear the
signature of the Permittee, the deed book number and page, and stamp/signature of the Register of Deeds.
17. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
18. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum
of ten years from the date of the completion of construction.
19. All runoff from the impervious surfaces of the clubhouse / pro shop area, including parking lots, roads,
buildings, and pool decks, must drain into the "GolfPond" permitted under SW8 990628. Pond #3, as shown
on the Master Plan, is no longer a stormwater treatment pond.

III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there
is a name change of the Permittee, a "Name/Ownership Change Form" must be submitted to the Division
of Water Quality accompanied by appropriate documentation from the parties involved, such as a copy of
the deed of trust. Other supporting materials, such as a signed Operation and Maintenance plan in the case
of engineered systems, will also be required. The proj ect must be in good standing with D WQ. The approval
of this request will be considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the P.ermittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this Division,
such as the construction of additional or replacement stormwater management systems.
5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuance or termination does not stay any permit condition.
6. Permittee grants permission to staff of the DWQ to access the property for the purposes of inspecting the
stormwater facilities during normal business hours.
7. The approved plan set consists of the April 28, 2000, revised Master Plan, Patio Home I site plan with pond
1 details, Pond 5 detail sheet, and the Clubhouse / Pro Shop Site Plan. The permittee will swap out the
required plans and replace outdated sheets with the revised ones.

ATTACHMENT A
1. Deed Restriction Requirements
The following statements must be recorded for all low density projects and for all projects that involve the
subdivision and selling of lots or outparcels:
1. i do more than square feet of any lot, including that portion of the right-of-way between the
edge of pavement and the front lot line, shall be covered by impervious structures, including
asphalt, gravel, concrete, brick; stone, slate or similar material but not including wood decking or
the surface of swimming pools. This covenant is intended to insure continued compliance with the
stormwater permit issued by the State of North Carolina. The covenant may not be changed or
deleted without the consent of the State.
2. No one may fill in, pipe, or alter any roadside Swale except as necessary to provide a minimum
driveway crossing.
NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot
number, size, and the allowable built -upon area for each lot.
For commercial projects that have outparcels or future development the following statements must also be
recorded.
3. The connection from the outparcel or future area into the stormwater system must be made into the
forebay such that short -circulating of the system does not occur.
4. All built -upon area from the outparcel or future development must be directed into the permitted
stormwater control system.
5. Built -upon area in excess of the permitted amount will require a permit modification prior to
construction.
For curb outlet systems, the following statement in addition to items 1 and 2 above must be recorded:

IV. STORMWATER COLLECTION SYSTEM MAINTENANCE REQUIREMENTS
Mowing will be accomplished as needed according to the season. Grass height will not exceed six inches
at any time.
2. Accumulated sediment and trash will be removed from the collection as necessary. Swales and
ditches will be reseeded or sodded following sediment removal.
3. Eroded areas of swales and ditches will be repaired and reseeded. Swales and ditches will be revegetated as
needed based on the monthly inspections.
4. The collection system, including catch basins, curbs cuts, velocity reduction devices, and piping, will be
inspected monthly or after every significant runoff producing rainfall event. Trash and debris will be
cleared away from grates, curb cuts, velocity reduction devices, and piping.
5. The collection system may not be altered in any way without prior approval from NCDENR Division of
Water Quality.

On March 24, 2000, the Division received a letter from Mr. Joseph Causey regarding the overbuilding
on his lot in Section 10 of Magnolia Greens. He requested that I provide some method or procedure to allow
him to continue with his project. As explained in my phone message to you, individual engineered systems
designed to accommodate the BUA overages are not allowed. Your only recourse is to modify the permit. The
State cannot force you to accommodate his request - that is entirely up to you. There is sufficient unused built -
upon area in Magnolia Greens to allocate additional BUA to Mr. Causey's lot (his letter does not indicate
exactly how much more he would need), and maintain compliance with the overall low density requirement.
However, you may have other plans for that overage amount for future development. ,
As stated in my phone message, this is entirely up to you. If you decide to proceed, the proper method
is to submit a permit modification with new deed restrictions so that the lot can be identified in the permit. As
I'm sure this situation will come up again, I will be reviewing any modifications for additional BUA on single
family lots to make sure that no pockets of high density are being created.

DESIGN NARRATIVE
I. GENERAL:
The project site 15 located within the Magnolia Greens subdivision within Brunswick
County, North Carolina. The area affected by this modification lies entirely within the
permitted area of Magnolia Greens (5W8 9701 04). Drainage considerations are to be
in accordance with DEM stormwater requirements.
The intent of this project 15 to construct a corporate meeting center and additional
parking lots at the existing clubhouse facility for the golf course.
Stormwater project 5W8 970104 15 a master plan and permit for the Magnolia Greens
Plantation. This 15 a low density protect based on built upon area, but 15 considered a
"high density Subdivision" due to pockets of higher den5itfe5 and due to curb and
gutter collection systems throughout the Magnolia Greens Plantation. To demonstrate
that this project 15 indeed low density, a complex BUA tracking chart 15 included on the
Stormwater master Plan summarizing the built upon areas for all stormwater projects
within Magnolia Greens and projecting built upon area for future projects.
It is also the intent of this project to update the Stormwater Master Plan, the
application governing this plan, and the master Low Density Supplement. Specifically, all
of Section 7 (at the end of the road formerly called Rubra, now named Cherrywood
Lane) has been deleted from the plan. The BUA associated with Section 7 was included
in the Phase I, Single Family column of the BUA tracking chart. This column has been
rev15ed. A patio home community (Patio Homes III, 5W8 991 13G) has been proposed
in its place and will be a stand alone stormwater project. A new column has been added
to the plan to include Patio Homes III against the overall, projected BUA for the
development.
Future multi -family section K and M have also been deleted from the BUA tracking chart.
Section M has Simply been abandoned (to allow for the additional parking at the
clubhouse), while section K has been combined with the East Commercial Area (General
Permit 5W8 0001 23) and a revised BUA projected for this Site.
Future 51ngle family section D has also been revised. The additional nine holes of golf
has dramatically reduced the scope of Section D. The project 15 currently in design,
and new projections for BUA have been included in this Master Plan Revision.
finally, the column for the Clubhouse, Site has also been revised to include the increased
BUA proposed with the new parking and meeting center. As you can See, the overall
density for the project (including existing, proposed, and projected built upon area) 15
well below the 30% low density threshold, coming in at an estimated 18.23%.
2. EXISTING SITE:
Site topography in the area is relatively flat with slopes typically less than ( I ) one -
percent. Vegetation consists primarily of grasses and minor ground cover within the
area of the improvements. Subsurface soils are typically a mixture of sands, silty sands
and organics.
3. PROPOSED IMPROVEMENTS:
Improvements proposed include the construction of 3 new parking lots on the east side
of Linkwood Circle at the clubhouse and a new corporate meeting building located north
and west of the existing clubhouse facility.
4. STORMWATER TREATMENT CONSIDERATIONS:
Infiltration within the golf course will be promoted wherever possible. Runoff from cart
paths will flow to the golf course and infiltrate or will flow overland through natural
vegetation for a distance not less than 30 feet before commingling with runoff from
other areas.
This will hold true for that portion of the clubhouse that drains to the golf course and
for the proposed building behind the clubhouse. All of the area west of the clubhouse
building drains to a large golf course pond that also Serves as supply for the golf
irrigation system. The built upon area from the clubhouse draining to the golf course
includes approximately half of the clubhouse building, the proposed meeting center
building, the clubhouse patio, and an undetermined amount of golf course cart path. The
drainage basin for the golf course pond is well below the 30% threshold for low density
development, and there is very little chance that runoff from this area will ever reach any
surface waters of the State. The golf course pond must be supplemented with several
Of five supply wells Just to maintain sufficient water level and volume to supply the
irrigation system. The water pumped from the pond is aggressively filtered before use
in irrigation to protect the tiny nozzles of the irrigation spray heads. The filters are
periodically back washed to maintain efficiency.
The balance of the built upon area at the clubhouse site drains to a sub -surface storm
drain collection system. The system outlets to a wet detention basin, formerly
Permitted under 5W8 970104 for stormwater treatment. The outlet of this pond now
flows to another wet detention basin, permitted for treatment under 5W8 990G28 (The
Fairway Villas at Magnolia Greens). As stormwater ponds in series 15 not an acceptable
form of treatment, the second basin has been designed to treat runoff from all built
Upon areas within its drainage area, including all of the area encompassed by the
collection system at the clubhouse. The pond at the Fairway Villas 15 considered an
offsite treatment facility for the collected stormwater runoff from the clubhouse site.
(Note: A permit modification 15 being submitted concurrently with this project to update
5W8 99OG28. An engineer's certification of the treatment pond is included with that
submittal.) In addition to the Stormwater Master Plan, a site specific stormwater plan
has been generated for the clubhouse Site detailing the impervious area draining to the
collection system and, ultimately, to the offsite source. The BUA tracking chart on the
site specific plan refers specifically to the offsite source. The clubhouse column in the
BUA tracking chart on the Stormwater Master Plan includes all of the impervious area at
the clubhouse, including that which drains to the collection system and that which drains
to the golf course.
