Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: * Existing conditions on the properties consist primarily of agricultural and wooded land with some rural residential structures. Specifically, there are three (3) wetland features (W1-W3), one (1) intermittent stream (SB), one (1) perennial stream (SC), and one (1) pond (Pond 1) located on the property. Perennial stream 'SC' bounds the northeast of the property. 'SB' is located near the center of the property just below 'Pond 1' and features adjacent wetlands 'W1-W3'. 'SB' flows northeast before its confluence with 'SC'. The general land use in the vicinity of the project is agricultural with some residential structures as well as some woodland. Mitchell Mill Road bounds the property to the East and Rolesville Road bounds the property to the West. 4b. These impacts are still shown and quantified on the attached impact maps, but are not included within the impact table above. E. Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: S&EC completed a wetland delineation and Neuse River buffer evaluation for the entire property so that natural resources could be identified, and impacts could be minimized to the maximum extent practicable. Impact area 1A is proposed permanent wetland impacts for lot excavation. This impact is necessary to make sure that the stormwater is able flow from the adjacent lots downhill to the wetland to keep it sustainable. Compensatory mitigation @ 2:1 ratio has been proposed to offset permanent wetland impacts. Impact area 1 B is proposed permanent and temporary wetland impacts for an SCM/SCM outlet. These impacts are necessary for the adjacent SCM to treat stormwater and filter it back into the adjacent wetland. The SCM was placed in this location based on the surrounding topography and will only impact a small top potion of the wetland drainage. A riprap dissipator will be utilized at the end of the SCM outlet to minimize wetland impacts to the maximum extent practicable. Compensatory mitigation @ 2:1 ratio has been proposed to offset permanent wetland impacts. Impact area 2 is proposed permanent and temporary wetland impacts and permanent buffer impacts for a road crossing. This road crossing is necessary to connect the western and eastern portions of the development. A culvert will be utilized to provide hydrologic connectivity between Wetland 2 and the pond. Retaining walls and a riprap dissipator pad will also be utilized to minimize impacts to the maximum extent practicable. Compensatory mitigation @ 2:1 ratio has been proposed to offset permanent wetland impacts along with @ 3:1 ratio for Zone 1 and @ 1.5:1 ratio for Zone 2 permanent buffer impacts. Impact area 3 is proposed permanent wetland impacts for a road crossing. This road crossing is necessary to connect the northern portion of the development with the southern portion. The crossing has been strategically placed as far west of the wetland and at the top of the wetland drainage. Compensatory mitigation @ 2:1 ratio has been proposed to offset permanent wetland impacts. Impact area 4 is proposed permanent and temporary wetland, permanent and permanent -no permanent stream, and permanent buffer impacts for a road crossing. This road crossing will occur perpendicular to the stream and is necessary to connect the northern portion of the development with the southern portion. Retaining walls/end walls will be utilized as well as a riprap dissipator to reduce flow velocities and minimize stream degradation. Compensatory mitigation @ 2:1 ratio has been proposed to offset permanent wetland impacts. Impact area 5 is proposed permanent -no permanent loss and temporary stream impacts for a utility crossing. This impact is occurring perpendicular to the stream to minimize impacts to the maximum extent practicable. Compensatory mitigation @ 1:1 ratio has been proposed to offset permanent -no permanent wetland impacts. Impact area 6 is proposed temporary stream and wetland as well as permanent buffer impacts for a greenway crossing. The crossing will utilize a boardwalk to cross over the stream at a perpendicular angle to minimize impacts to the maximum extent practicable. Impact area 7A is proposed temporary stream impacts for a utility crossing. The crossing will occur at a perpendicular angle with the stream to minimize impacts to the maximum extent practicable. Impact area 7B is proposed permanent Zone 1 buffer impacts for a utility crossing. We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The Mitchell Mill property project is a residential development. Additionally, the project is located within the town of Wake Forest ETJ, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area, in addition Best Management Practices may be required that control nitrogen if diffuse flow cannot be achieved; 2) the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements. We anticipate that the DWR will advise us if any additional information is needed. 4. Sewage Disposal (DWR Requirement) 4a. Is sewage disposal required by DWR for this project?* • Yes No N/A 4b. Although current inventory is high, the letter is not a guarantee of availability as credits will be sold on a first come, first serve basis.
