Brittany,
Regarding the subject NOI application for NCG16 coverage, which you have been holding until you hear back from me, I
went by the site earlier today and the asphalt plant is now in operation. The sedimentation control measures are still in
place including a diversion ditch leading to a basin with skimmer outlet, which discharges directly into surface waters
(unnamed tributary to Neills Creek, class WS-IV, Cape Fear River Basin). Approximate outfall coordinates are 35.4286, -
78.8200. According to the consultant, the sedimentation control measures are intended to be temporary and should be
removed upon final stabilization of the site, but the timeframe for that is unknown. I recommend that we go ahead and
proceed with issuance of coverage under the NCG16 permit. If/When the diversion ditch and the skimmer basin are
eliminated such that the site has no point source discharges, then they could request rescission of permit coverage.

Ok great,
I'm not sure about how accurate the policy for not holding applications for more than a month is. When I started at the
DEQ in Sept, there will applications that had been in review for 6+ months.
I'll hold onto this one until I hear from your office. Thanks again for the clarification,

My recommendation is to hold the application until I can verify whether or not the site will have a
point source discharge after removal of temporary sediment control measures. If our
policies/procedures don't allow for us to hold their application for another month or so and we must
finalize issuance, then go ahead and issue coverage.

Paving Co. I've read your inspection, I greatly appreciate the detail. You recommended holding the application but also
proceeding with permit issuance.
