Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum
of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,
1994 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714).
Unless such demand is made, this decision shall be fmal and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect
the legal requirements to obtain other permits which may be required by the Division of Water
Quality or permits required by the Division of Land Resources, the Coastal Area Management Act
or any other Federal or Local governmental permit that may be required.

SUPPLEMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A. (2) CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant
mortality to Ceriodaphnia dubia at an effluent concentration of 2.1%.
The permit holder shall perform at a minimum, Quarterly monitoring using test procedures outlined in
the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or
subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised -February 1998) or subsequent versions. The tests will be performed during the months of
February, May, August, and November. Effluent sampling for this testing shall be performed at the
NPDES permitted final effluent discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below
the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the
two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test
Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the
highest concentration having no detectable impairment of reproduction or surviyal and the lowest
concentration that does have a detectable impairment of reproduction or survival. The definition of
"detectable impairment," collection methods, exposure regimes, and further statistical methods are
specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -
February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter
code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3
(original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate
signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if
chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the
report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to
the Environmental Sciences Branch at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring
will be required during the following month. Should any test data from this monitoring requirement or
tests performed by the North Carolina Division of Water Quality indicate potential impacts to the
receiving stream, this permit may be re -opened and modified to include alternate monitoring
requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following the month of the initial monitoring.

A. (3) VARIANCE FOR 24-HOUR STAFFING REQUIREMENT
The permittee's request for continuation of the variance to Rule 15A NCAC 2H.0124(4), which requires
24-hour staffing at wastewater treatment plants (WWTP) by certified operators, has been reviewed and
approved by the Division with the following conditions:
1. The WWTP shall be staffed 24 hours, 7 days per week whenever the WWTP is receiving flow for
treatment and there must be at least one certified operator on each shift. On -site staffing by
certified WWTP operators is not required during periods of complete influent flow diversion to the 3.2
MGD holding basin.
2. A certified WWTP operator shall be on call when the WWTP is not staffed. This operator shall report
to the WWTP in the event the facility needs to receive flow, if an alarm condition exists, or if unusual
conditions are observed at the facility during the periods of influent flow diversion.
3. When the WWTP is not staffed during periods of flow diversion, the WWTP shall be checked once
every 8 hours by the plant security personnel, and documentation shall be made of each visit.
4. Maintain and operate the computer system that monitors the influent screw lift pump and the
aeration basin blower.
5. This variance shall remain in effect until April 30, 2012. A request for renewal of this variance, if
necessary, should be submitted with the permit renewal application.
6. This variance may be rescinded at the discretion of the Director.

SUMMARY
Miller Brewery facility is a brewing and packing facility for malt beverages. The process includes
brewing, fermenting, aging and packing. Wastewaters generated during the process are treated in
a 5.2 MGD activated sludge wastewater treatment facility. The treatment system consists of bar
screen, grit chamber, neutralization, equalization, aeration basins, secondary clarifiers, and
polishing lagoons.
The current permit was issued on July 2003 and expires on April 30, 2007. The permit includes
two outfalls. Outfall 001 is the discharge from the process wastewater treatment plant. Outfall
002 is the discharge from the carbon filter backwash. In the permit renewal application package
Miller Brewery is requesting to eliminate outfall 002. The facility implemented water reuse
utilizing the backwash water. Excess water that can't be reused will be send to the process
treatment system. Outfall 002 will be eliminated from the permit.
Miller Breweries also requested to include the exemption from 24-hour/7-day staffing granted on
September 2003. The exemption will be included in the permit.
Waste Load Allocation (WLA) The last waste load allocations was completed in 1996. Limits
for BOD and TSS were based in proposed effluent guidelines. The guidelines were never
finalized and the limits were modified in 2003 based on BPJ. The BOD monthly and daily limits
were based on concentrations of 38 mg/1 and 92 mg/1 respectively. TSS monthly and daily limits
were based on concentrations of 56 mg/1 and 135 mg/1 respectively. Current permit limits are
16481b/day monthly average and 3990 lb/day daily maximum for BOD and 2429 lb/day monthly
average and 5855 lb/day daily maximum for TSS. The permit includes monitoring for ammonia,
DO, temperature, pH, total zinc, total nitrogen and total phosphorus. The existing permit limits
are deemed appropriate.

Instream monitoring:
Miller monitors temperature and DO upstream at the Highway 14 bridge and downstream at the
Highway 700 bridge. Data collected is within normal parameters for temperature and DO.
Whole Effluent Toxicity:
The permit includes a chronic toxicity test (ceriodaphnia dubia) at an effluent concentration of
2.1%. The facility has passed all the tests for the period of 2003 to 2006.
Reasonable Potential Analysis (RPA):
Reasonable potential analysis was completed for total Zinc. The allowable concentrations are 67
µg/1 for the acute value and 2339 µg/l for the chronic value. The maximum predicted
concentration is 199.8 µg/1. There is reasonable potential to exceed the acute value. Since zinc is
an action level standard, no limit will be implemented. Monitoring on a monthly basis will
remain in the permit.
Primary Pollutant Analysis:
Miller Brewery is not classified as a primary industry therefore it is not required to complete a
priority pollutant scan for the permit renewal application.
Regional Office Correspondence
A staff report from the Winston-Salem Regional Office was received on December 12, 2006. RO
staff recommends the permit be reissued.
SUMMARY OF PROPOSED CHANGES
• Eliminate outfall 002 — This outfall was eliminated by implementing a reuse system
for the filter backwash.

Mr. Sterling A. Weaver (149 Sunset Boulevard,
Beaufort, SC 29907) has applied for renewal
of NPDES permit NC0060623 for the Stone
Highway Mobile Home Park WWTP in
Rockingham County. This permitted facility
discharges 0.015 MGD treated wastewater to
an unnamed tributary to Buffalo Creek in the
Roanoke River Basin. Currently, BOD,
ammonia -nitrogen, and total residual
chlorine are water quality limited. This
discharge may affect future allocations in
this portion of the Roanoke River Basin.
Vulcan Construction Materials, LP (P0 Box
4239, Winston Salem, NC 27511-4239) has
applied for renewal of NPDES permit
NC0027987 for the Stoneville Quarry WWTP
in Rockingham County. This permitted
facility discharges treated wastewater to an
unnamed tributaryto Buffalo Creek in the
Roanoke River Basin. This discharge may
affect future allocations in this portion of the
Roanoke River Basin.

Please find enclosed Miller Breweries East, Inc.'s application for the
renewal of its NPDES discharge permit. Per the permit application and
previous correspondence, the following information is for your
consideration:
Outfall #002
Per correspondence from the Division of Water Quality upon issuance of the
renewed permit in September 2003, the division stated that Outfall #2 total
residual chlorine levels exceed water quality action criteria. It also stated
that Miller Breweries East would have a future limit of 17 ppb upon renewal
of the permit.
To address this future permit limit, Miller Breweries East is eliminating
Outfall 002. A project is in process to capture the backwash water from the
carbon purifiers which is the source of outfall 002 and reuse it in the utilities
department. Any excess water that may be generated due to low production
will be routed for treatment to the brewery's wastewater treatment plant. As
indicated on the application, this project is scheduled for completion in
March 2007. As such, a renewal of permitting for Outfall 002 is not
included in this application.

In further correspondence from September 2003, the renewal for the
exemption from the 24-hour/7-day staffing requirement was also granted. It
is included in the existing permit as Special Condition A (4). Miller
Breweries East, Inc. is requesting that this condition be renewed with new
permit issuance.

Permit No. WQ0001347, dated August 26, 2005, to Miller Brewing Company for the distribution,
marketing/land application of a residual containing waste products which meet exceptional quality
standards.
This permit shall be effective from the date of issuance until July 30, 2010, shall void Permit No.
WQ0001347 issued April 9, 1999, and shall be subject to the conditions and limitations as specified
therein. Please pay particular attention to the monitoring and reporting requirements contained in this
permit. Failure to establish an adequate system for collecting and maintaining the required operational
information will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, NC 27699-6714. Unless such demands are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

continued operation of a process residuals program for the distribution and marketing of residuals which
meet exceptional quality standards throughout the State of North Carolina, consisting of the distribution
of 10,000 dry tons per year of residuals from the sources listed in Condition II 2, with no discharge of
wastes to the surface waters, pursuant to the application received on September 30, 2003 and in
conformity with the project plan, specifications, and other supporting data subsequently filed and
approved by the Department of Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until July 30, 2010, shall void Permit No.
WQ0001347 issued April 9, 1999, and shall be subject to the following specified conditions and
limitations:
I. PERFORMANCE STANDARDS
1. The distribution residuals program shall be effectively maintained and operated as a non -
discharge system to prevent the discharge of any wastes resulting from the operation of this
program.
2. This permit shall become voidable in the event of failure of the residuals program to
adequately protect the assigned water quality standards of the surface waters and
groundwaters.
3. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to
surface or groundwaters resulting from the operation of this program.
4. In the event that the residuals program is not operated satisfactorily, including the creation of
nuisance conditions, the Permittee shall take any immediate corrective actions as may be
required by the Division of Water Quality (Division).

5. Diversion or bypassing of the untreated residuals or leachate from the residual treatment
facilities is prohibited.
6. All leachate must be reused as a wetting agent for the processing of residuals or routed to the
head of the treatment plant.
II. OPERATION AND MAINTENANCE REQUIREMENTS
1. The residuals treatment facilities shall be properly maintained and operated at all times.
2. No residuals other than the following are hereby approved for distribution in accordance with
this permit:

3. All residuals shall be adequately stored to prevent leachate runoff until treated. The finished
product may be placed on a concrete pad, placed under shelter or covered until such time as it
is distributed to the buyer. If an alternate storage site is to be used, approval must be obtained
from the Division.
4. No other residuals other than those specified under Condition II 2 above may be distributed.
The Permittee shall request and obtain a permit amendment from the Division for each
additional residual source prior to acceptance of that residual.
5. For a residual to be sold or given away in bags or other container for application to the land,

6. Upon classification of the facility by the Water Pollution Control System Operators
Certification Commission (WPCSOCC), the Permittee shall employ a certified residuals
operator to be in responsible charge (ORC) of the residuals program. The operator must
hold a certificate of the type classification assigned to the residuals program by the
WPCSOCC. The Permittee must also employ a certified back-up operator of the
appropriate type to comply with the conditions of 15A NCAC 8G .0202.

7. Adequate provisions shall be taken to prevent wind erosion and surface runoff from
conveying pollutants from the residuals treatment area onto the adjacent property or into
any surface waters.
8. A label shall be affixed to the bag or other container in which residuals that are sold or
given away for application to the land, or an information sheet shall be provided to the
person who receives the residuals sold or given away in an other container for application
to the land. The label or information sheet shall contain the following information:
a. The name and address of the person who prepared the residuals that is sold or given
away in a bag or other container for application to the land.
b. A statement that application of the residuals to the land is prohibited except in
accordance with the instructions on the label or information sheet.
c. A statement which identifies that this material shall be prevented from entering any
public or private water supply source (including wells) and any stream, lake, or river.
d. Residuals shall not be applied to any site that is flooded, frozen or snow-covered.
e Adequate procedures shall be provided to prevent surface runoff from carrying any
disposed or stored residuals into any surface waters.
III. MONITORING AND REPORTING REQUIREMENTS
1. Any monitoring (including groundwater, surface water, residuals, soil, or plant tissue
analyses) deemed necessary by the Division to insure protection of the environment will be
established and an acceptable sampling and reporting schedule shall be followed.
2. Proper records shall be maintained by the Permittee tracking all residual activities. These
records shall include, but are not necessarily limited to the following information:
a. source, volume and analysis of each residuals
b. name of residuals' recipient, volume received, and intended use
3. A residual analysis shall be conducted quarterly by the Permittee for any quarter of the year
in which residuals are distributed, otherwise analysis is only required once per permit cycle
prior to permit renewal. The results of all analysis shall be maintained on file by the
Permittee for a minimum of five years. The residuals analysis shall include the following
parameters:

After the residuals have been monitored for two years at the above frequency, the Permittee
may submit a request to the Division for a permit modification to reduce the frequency of
monitoring for pollutant concentrations. In no case, however, shall the frequency of
monitoring be less than once per year when residuals are sold or given away.
4. A Toxicity Characteristics Leaching Procedure (TCLP) analysis shall be conducted by the
Permittee annually for any year in which residuals are distributed, otherwise the analysis shall
be conducted once per permit cycle prior to renewal. The TCLP analysis shall include the

After the residuals have been monitored annually for two years, the Permittee may submit a

5. Three copies of all required monitoring and reporting requirements as specified in conditions
III 1, III 2, III 3 and III 4 shall be submitted annually, for each year in which residuals have
been distributed, on or before March 1 of the following year to the following address:

7. Noncompliance Notification:
The Permittee shall report by telephone to the Winston-Salem Regional Office, telephone
number (336) 771-4600, as soon as possible, but in no case more than 24 hours or on the next
working day following the occurrence or first knowledge of the occurrence of any of the
following:
a. Any occurrence with the distribution program which results in the land application of
significant amounts of wastes which are abnormal in quantity or characteristic.

b. Any failure of the distribution program resulting in a release of material to receiving
waters.
c. Any time that self -monitoring information indicates that the facility has gone out of
compliance with the conditions and limitations of this permit or the parameters on which
the system was designed.
d. Any process unit failure, - due to known or unknown reasons, that render the facility
incapable of adequate residual treatment.
e. Any spillage or discharge from a vehicle or piping system during transportation of
residuals.
Persons reporting such occurrences by telephone shall also file a written report in letter form
within five (5) days following first knowledge of the occurrence. This report must outline the
actions taken or proposed to be taken to ensure that the problem does not recur.
IV. GROUNDWATER REQUIREMENTS
1. Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided.
V. INSPECTIONS
1. The Permittee or his designee shall inspect the residuals storage, transport, and treatment
facilities to prevent malfunctions and deterioration, operator errors and discharges which may
cause or lead to the release of wastes to the environment, a threat to human health, or a
nuisance. The Permittee shall maintain an inspection log or summary including at least the
date and time of inspection, observations made, and any maintenance, repairs, or corrective
actions taken by the Permittee. This log of inspections shall be maintained by the Permittee
for a period of five years from the date of the inspection and shall be made available to the
Division or other permitting authority, upon request.
2. Any duly authorized officer, employee, or representative of the Division may, upon
presentation of credentials, enter and inspect any property, premises or place on or related to
the treatment site or facility at any reasonable time for the purpose of determining compliance
with this permit; may inspect or copy any records that must be kept under the terms and
conditions of this permit; and may obtain samples of groundwater, surface water, or leachate.
VI. GENERAL CONDITIONS
1. This permit shall become voidable unless the distribution activities are carried out in
accordance with the conditions of this permit, the supporting materials, and in the manner
approved by this Division.
2. This permit is effective only with respect to the nature and volume of residuals described in
the application and other supporting data.

3. This permit is not automatically transferable. In the event that there is a desire for the
facilities to change ownership or a name change of the Permittee, a formal permit request
must be submitted to the Division accompanied by an application fee, documentation from
the parties involved, and other supporting materials as may be appropriate. The approval of
this request will be considered on its merits and may or may not be approved.
4. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division in accordance with North Carolina
General Statute 143-215.6A to 143-215.6C.
5. The annual administering and compliance fee must be paid by the Permittee within thirty (30)
days after being billed by the Division. Failure to pay the fee accordingly may cause the
Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4).
6. The issuance of this permit does not exempt the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction, including but not limited to
applicable river buffer rules in 15A NCAC 2B.0200, erosion and sedimentation control
requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCG010000,
and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 2H .0500.
7. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.
8. This permit may be modified, or revoked and reissued to incorporate any conditions,
limitations and monitoring requirements the Division deems necessary in order to adequately
protect the environment and public health.

SUMMARY
Miller Brewery facility is a brewing and packing facility for malt beverages. The process includes
brewing, fermenting, aging and packing. Wastewaters generated during the process are treated in
a 5.2 MGD activated sludge wastewater treatment facility. The treatment system consists of bar
screen, grit chamber, neutralization, equalization, aeration basins, secondary clarifiers, and
polishing lagoons.
The current permit was issued on July 2003 and expires on April 30, 2007. The permit includes
two outfalls. Outfall 001 is the discharge from the process wastewater treatment plant. Outfall
002 is the discharge from the carbon filter backwash. In the permit renewal application package
Miller Brewery is requesting to eliminate outfall 002. The facility implemented water reuse
utilizing the backwash water. Excess water that can't be reused will be send to the process
treatment system. Outfall 002 will be eliminated from the permit.
Miller Breweries also requested to include the exemption from 24-hour/7-day staffing granted on
September 2003. The exemption will be included in the permit.
Waste Load Allocation (WLA) The last waste load allocations was completed in 1996. Limits
for BOD and TSS were based in proposed effluent guidelines. The guidelines were never
finalized and the limits were modified in 2003 based on BPJ. The BOD monthly and daily limits
were based on concentrations of 38 mg/1 and 92 mg/1 respectively. TSS monthly and daily limits
were based on concentrations of 56 mg/1 and 135 mg/1 respectively. Current permit limits are
1648 lb/day monthly average and 3990 lb/day daily maximum for BOD and 2429 lb/day monthly
average and 58551b/day daily maximum for TSS. The permit includes monitoring for ammonia,
DO, temperature, pH, total zinc, total nitrogen and total phosphorus. The existing permit limits
are deemed appropriate.

Whole Effluent Toxicity:
The permit includes a chronic toxicity test (ceriodaphnia dubia) at an effluent concentration of
2.1%. The facility has passed all the tests for the period of 2003 to 2006.
Reasonable Potential Analysis (RPA):
Reasonable potential analysis was completed for total Zinc. The allowable concentrations are 67
µg/1 for the acute value and 2339 µg/1 for the chronic value. The maximum predicted
concentration is 199.8 41. There is reasonable potential to exceed the acute value. Since zinc is
an action level standard, no limit will be implemented. Monitoring on a monthly basis will
remain in the permit.
Primary Pollutant Analysis:
Miller Brewery is not classified as a primary industry therefore it is not required to complete a
priority pollutant scan for the permit renewal application.
Regional Office Correspondence
A staff report from the Winston-Salem Regional Office was received on December 12, 2006. RO
staff recommends the permit be reissued.

for the filter backwash.
