DWR has the same concerns as the USACE:
1. Verification of Jurisdictional Areas
2. Sufficient documentation of avoidance and minimization.
3. Analysis of indirect impacts to wetlands both above and below the project site.
In addition, since the project has a high density of Built Upon Area and there is no local stormwater requirements the
Division will review the proposed stormwater management plan as part of the 401 review.
4. Please provide a complete stormwater management plan for review. Please ensure that it includes all
appropriate supplemental forms, O&M agreements, calculations, engineering drawings, etc., that complies with
the requirements of the State Stormwater Program. The Stormwater Design Manual and applicable forms may be
found on the DEMLR's website at https://deq.nc.gov/about/divisions/energy-mineral-land-resources/energy-
mineral-land-permit-guidance/stormwater-bmp-manual. In addition, please also submit the application form
SWU-101 (attached). However, the $505 application fee and last two signature pages of this form may be
omitted.
Please submit all information in detail by April 15, 2022 or the Division will consider the application incomplete and
finalize it's decision process.

I regret to hear you're leaving but wish you the best in future endeavors.
I'll put together some more thorough responses soon, but given the short timeframe for you to download your
familiarity to Robert, I wanted to send along some thoughts:
1) I still need the JD application for this site — none was ever submitted,
2) If you're draining what we'll assume is a jurisdictional feature into what would be a non -jurisdictional
stormwater pond, that would likely be a total loss to at least the upper feature and possibly the lower one too,
and
3) The current project appears to be buildable with no impact to any of the areas we're assuming are
jurisdictional. Everything appears to be driven by an area reserved for future use. This wouldn't allow us to
document need, avoidance, or minimization.
This isn't a complete list; but again I wanted to enable you to discuss with the team before your departure. I will be on
leave starting tomorrow and through this Friday, returning to the office on Monday the 21'

Good Morning, JC:
This project appears to intend to create as much upland as possible with no details of what is proposed or why the
impacts are necessary. We require additional information, detailing what is proposed on the site, before verifying your
use of Nationwide Permit 18 for impacts to likely waters of the US.
1) The site plan provided is illegible / text is difficult to read when zoomed in. Please provide a clear copy of the
site plans for our review (flattened and reduced, please). See attached site plans, hopefully they have resolved
the readability issues.
2) The wetland impact proposed is identified in the PCN application as needed for a building pad. However, the
area occurs within a narrow projection northwest from the LOD. Please provide details of the building proposed
in this location, the need for this impact, how the impact was minimized, and what measures are proposed to

protect remaining wetland. Would temporary impacts be required for construction in this area? Existing
topography constraints require that this area of WA-1 be impacted in order to provide necessary grading for
ditches and piles, to minimize disturbance during construction, and for the installation of necessary erosion
control measures. Drainage area including that of WA-1 is conveyed through pipes and treated thru the
stormwater BMP, then discharged to WA-2, and eventually through an existing Culvert beneath the roads, as
replicated from the pre-existing drainage pattern and site conditions. In addition silt fence protection, reinforced
silt fence protection around wetlands, and site -wide perimeter protection with silt fence rock outlets will be
utilized.
3) All three exhibits depicting wetlands on -site show different shapes and extents of these features. Please provide
as accurate a boundary as possible on all exhibits and send in a JD or delineation concurrence request with
sufficient detail to establish any jurisdiction over these resources. See attached Topo and Aerial. FYI there are
some wetlands flagged outside the project boundary that will not be impacted, they are depicted to provide
context to the onsite wetlands.
4) The application states that 'Chemical and physical connectivity between the northern and southern wetlands
would be preserved via the construction of temporary diversion ditches, draining around the proposed building,
into stormwater retention basins that would then overland flow into the southern wetland'.
1) Please provide more detail about the temporary diversion ditches, and what any permanent connection
would look like. Temporary ditches will remain in place until final grades and the building envelope is
completed, these ditches will then be developed into permeant stormwater features in order to convey
stormwater runoff away from the building and parking lots. This water will be routed into stormwater
detention ponds prior to release into W2
2) Does the project intend to route flow from a wetland into a stormwater BMP? Flow from the northern
most wetland (W1) will flow via a drainage feature, similar to current conditions and following
topography, and into the southernmost wetland (W2). This wetland will drain to the southwest via
an existing culvert, under the existing road and into a drainage feature and offsite wetlands.
3) Please clarify how overland flow would provide connectivity of waters of the US. Overland flow derived from
impervious surface runoff and sheet flow will be collected via diversion ditches and stormwater drains that
flow into stormwater detention basins which will release stormwater via a level spreader or slope drains
which then overland flows into W2.

I have reviewed your PCN requesting a 401 Certification for the above referenced project and need clarification and/or
additional information. Please submit the requested information below within 30 days of receipt of this Notification by
selecting the More Information Response using this submittal form (you may also send me an email once the form has
been submitted).
1) Your wetland delineation map indicates that there are wetlands that are connected via an "upland
ditch". Please provide documentation that the USACE has confirmed your delineation;
2) Please clarify whether this project is speculative or if it is being built to specification of a user;
3) Provide a plan view of the site and infrastructure (roads, utilities, stormwater, etc.) for the entire proposed
development, overlaid on the stream and wetland delineation. This plan is necessary to evaluate avoidance and
minimization measures and potential indirect impacts for the project.;
4) You have indicated that this project meets the definition of Low Density for stormwater purposes. The Division
requires a complete site development plan in order to evaluate this response.
Please note that responses to the questions above may prompt additional information requests to allow full evaluation
of the proposed project
