Rob and Andy,
Rob certainly pointed out my error in the indication of the use of NWP 57 for B-5318. I have been thinking so much
about overhead utility lines (for this project and on Hereford Road) to realize that the utility impacts on B-5318 are
actually underground sewer which is NWP 58. The project does appear to comply with all impact thresholds (less than
0.5 ac of wetland impacts) for NWP 58.

I didn’t have much to add to what Andy said but something caught my attention.
For starters if this is Sewer wouldn’t it be NW 58 not 57?
Secondly: Regarding the email I had sent earlier, I think your Utility impacts would trigger DWR’s public notice
th
requirement since it is over the 1/10 acre threshold that General Certification 4276 goes to written concurrence.
I just wanted you to be aware of that for your time frame purposes. There will be at least 30 days on the 401’s time
clock.

Thanks for the preliminary guidance. The permit application will include information on avoidance/minimization and
also mention the emergency response information and the overhead power lines.
Impacts in the CE (signed in 2017) were based on a typical section that has now been updated to current standards
based on roadway design guidance and input from the Town of Wake Forest regarding their desire for certain
bike/ped/trail accommodations.
We are actually working on the required update to the CE, which will be called a Consultation, that should be finalized
about the same time as the permit application is ready to go out. We have already planned on ensuring that the
jurisdictional impact numbers are reconciled with an appropriate discuss in the Consultation.

I appreciate you sending this. I know we have talked about this project several times, too. Based on the information
provided and what I remember from previous conversations, it appears this project could be permitted using RGP 50
and NWP 57.
I do remember in discussing this, one of the reason’s mentioned for building on new location was due to Emergency
personnel stating they did not want the road closed. If that is correct, I would add it into the application regarding
reasons for the new location.
Also, I don’t think the impact numbers match up with the preferred alternative mentioned in the CE (unless I missed
something). I don’t know if you all need to update your CE or not. I the permit application, you should probably just
briefly discuss (just a few bullet points), the difference in the numbers if the CE isn’t updated.
Please let me know if you have any questions, etc. I will be glad to discuss, if you think we need to. I think this is pretty
straight forward, though.

The Division is coming to the completion of engineering, planning, environmental and design issues for this project. We
met on site on September 24, 2021 to conduct the JD visit. During that visit, I was able to present the findings of a
document that thoroughly discussed the sources of anticipated stream/wetland impacts on the project and also the
demonstrated reasons for the high number of impacts for this project (see attached).

The permit drawings are currently being finalized, but have come to complete the stream/wetland summary sheet. A
screen shot of this is below:
The impacts are also broken out below:

WETLAND:
Roadway permanent wetland impacts (fill, excavation, and mechanized clearing): 0.61 ac
Utility permanent wetland impacts (mechanized clearing and excavation): 0.18 ac
STREAM:
Roadway permanent stream loss (fill): 240 linear feet
Roadway permanent stream loss (rip rap bank stabilization) 175 linear feet
Roadway temporary stream impact: 207 linear feet
Note the following:
-The Department proposes to provide mitigation for all permanent wetland impacts.
-The Department proposes to provide mitigation for all permanent stream loss due to fill. Mitigation is not proposed for
rip rap bank stabilization.
-The project does appear to comply with all impact thresholds (less than 1 ac of wetland permanent impacts and less
than or equal to 500 linear feet of permanent stream impacts) and Special Conditions of RGP 50.
-The project does appear to comply with all impact thresholds (less than 0.5 ac of wetland impacts).
Can you please confirm that the Department can use RGP 50 and NWP 57 to permit this project? RGP 50 actually
indicates that the Corps can determine, on a case-by-case basis, that the concerns for the aquatic environment so
indicate, he/she may exercise discretionary authority to override the RGP and require an Individual Permit.
