Describe the attachments or comments: Violations: The original permits granted by the USACE and the NCDWR (attached) did not account for permanent impacts resulting to Big Branch from the sewer line crossing. At the time of the original permit submission, engineers anticipated that the sanitary sewer line could be installed below the stream bed. During construction, the sanitary sewer was installed above grade due to the elevation of the existing offsite sanitary sewer line and was run at a minimum slope to be able to install the sewer line as low as possible, resulting in an NOV due to unpermitted permanent impacts. This permit application addresses the permanent impact caused by the sewer line within the footprint of the stream bed. We are seeking a revision to the original DWR Permit and a NWP 18 for Minor Discharges from the USACE. The written submission shall contain a description of the noncompliance, and its causes; the period of noncompliance, including exact dates and times, if the noncompliance has not been corrected, the anticipated time compliance is expected to continue; and steps taken or planned to reduce, eliminate, and prevent reoccurrence of the noncompliance. The Division may waive the written submission requirement on a case -by -case basis. 4. Protective Fencing The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15 NCAC 02H .0500.
