CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY)

The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in:
1.) The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay
Procedure - Revised *September 1989) or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality
is // % (defined as treatment two in the North Carolina procedure document). The permit holder shall perform
quarterly monitoring using this procedure to establish compliance with the permit condition. The first test w 1 be
performed after thirty days from the effective date of this permit during the months of ETA cIA,/V/24'I

permit d final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B.

Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in
association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity
sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will
begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will
revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and
modified to include alternate monitoring requirements or limits.
NO 1'h: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival and appropriate environmental controls, shall constitute an invalid test and will require immediate
retesting(within 30 days of initial monitoring event). Failure to submit suitable test results will constitute
noncompliance with monitoring requirements.

•PART IV - EVALUATION AND RECOMMENDATIONS
The Feldspar Corporation has requested renewal of NPDES Permit
Number No. NC0000353.
There are no effluent guidelines for this industry and the
effluent limits were developed using production and process information
and the North Carolina Water Quality Standard for fluoride of 1.8 mg/1.
There are four companies, The Feldspar Corporation, K-T Feldspar
Corporation, Unimin Corporation -Mica Operations and Unimin
Corporation -Quartz Operations, which have similar industrial processes
and wastewater characteristics and each Company discharges or proposes
to discharge fluorides to the North Toe River. (It has been determined
that there is a maximum assimilative capacity of 574 lbs/day f
fluoride in the North Toe River at the month of Little Bear Creek. All
four NPDES Permits are interdependent on each other because the otal
assimilative capacity of the fluoride is allocated between the four
industries and all permits should be issued at the same time.
The Feldspar Corporation has requested that the limits in their
NPDES Permit remain as they are now; however, because of existing
agreements between each Company and the Division of Environmental
Management, Unimin Corporation -Mica Operations, is now proposing to
construct industrial processes which will utilize fluorides in the
process. This agreement was developed for the existing permits based
on different operational plans each Company had proposed. With Unimin
Corporation -Mica Operations exercising its option, Configuration IV, in
the existing NPDES Permits will now become the effluent limitations.
Effluent limitations and the development of these limits are
listed in the draft permit and fact sheet, respectively.
The Company also has discharges 002. and 003 where they discharge
non -contact cooling water.
It is recommended that the permit be issued.

than 10 NTU. If the turbidity exceeds 10 NTU due.to natural conditions,
the discharge shall not cause any increase in turbidity.

The effluent discharge shall at no time exhibit chronic toxicity
using test procedures outlined in:
1. The North Carolina Ceriodaahnia chronic effluent
bioassay procedure (North Carolina Chronic Bioassay
Procedures - Revised *February, 1987) or subsequent
versions.
The effluent concentration at which there may be no observable
inhibition of reproduction or significant mortality is 11%
(defined as treatment two in the North -Carolina procedure
document). The permit holder shall perform quarterly monitoring
using this procedure to establish compliance with permit
condition. The first test will be performed within thirty days
from issuance of this permit during the months of February, May,
August, and November. Effluent sampling for this testing shall be
performed at the NPDES permitted final effluent discharge below
all treatment processes.
All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Monitoring
Form (MR-1) for the month in which i. t was performed, using the
appropriate parameter code TGP3B. Additionally, DEM Form AT-1
(original) is to be sent to the following address:

Test data shall be complete and accurate and include all
supporting chemical/physical measurements performed in association
with the toxicity tests, as well as all dose/response data. Total
residual chlorine of the effluent toxicity must be measured and
reported if chlorine is employed for disinfection of the waste
stream.
Should any test data from this monitoring requirement or tests
performed by the North Carolina Division of Environmental
Management indicate potential impact; to the receiving stream,
this permit may be reopened and modified to include alternate
monitoring requirements or limitations.
Note: Failure to achieve test conditions as specified in the
cited document, such as minimum control organism survival and
appropriate environmental controls, shall constitute an invalid
tests and will require immediate retesting (within 30 days of
initial monitoring event) . Failure to submit suitable test
results will constitute non-compliance with monitoring
requirements.
