Your office has had certain input into the development of
the Fourth Creek Waste Water Treatment Facility now being erected on
Fourth Creek in Iredell County to serve the City of Statesville.
The plant, as I understand it, is designed with a daily capacity of
four million gallons with the effluent discharge to be directed into
Fourth Creek at an elevation of 734.36 feet.
About 1.4 miles east of the point of the effluent discharge,
downstream from that point, is a tract of land concerning which
application has been made for a permit to operate a rock quarry. The
quarry operation would be located immediately adjacent to Fourth
Creek, with the stockpiling of product and the storage of overburden
in what is described as approximately 18.5 acres immediately adjoin-
ing Fourth Creek.
Numerous citizens living immediately adjacent to and near
the proposed site for the rock quarry are opposed to its development
in that area. They have employed the undersigned to represent their
interests in avoiding the issuance of a mining permit under the
provisions of Section 74-50, et seq., of the General Statutes of
North Carolina.
In my investigation of the matter, certain questions have
arisen as to the impact, if any, which the proposed quarry operation
at a point 1.4 miles downstream from the effluent discharge may
have, or could have, upon the operation of the Fourth Creek Waste
Water Treatment Facility. Some of the questions raised in connec-
tion with the matter are as follows:

1. What is the nature and extent of the consumptive
use by the downstream industry upon the water
flow in Fourth Creek?
2. If there is to be anysubstantial consumptive
use downstream 1.4 miles from the wastewater
treatment facility, could that consumptive use
affect the waste load allocation established in
the wasteallocation model for the Fourth Creek
Waste Water Treatment Facility?
3. At what points downstream are samples to be
taken of the creek water and, if such samples
are tobe taken at a point beyond the proposed'
quarry, couldthe operation of the' quarry
itself have any influence upon Fourth Creek which
could affect the validityof the samples being
taken?
4..\Could the location of the stockpiles and the
,overburden storage area at the proposed rock
\quarry result in the silting of Fourth Creekin
the area of the quarry which could affect the
flow of the creek ' and, as a result ' thereof, have
_any impact upon the waste load allocation?
5. Could the development of the rock quarry 1.4
miles east of the Fourth Creek Waste. Water
Treatment Facility have any adverse effect upon
the' assimilative capacity'. of Fourth Creek?
We are seeking tocall to your attention the fact of the
application for the mining permit described above and to request
that your office make the necessarystudies todetermine whether
any adverse effect would result to the operation of the Fourth.
Creek Waste. Water Treatment Facilityif the quarryis in fact devel
oped'. My information is that the fact of the application for' the
mining permit was made known to your office only on August 3, 1979,
such that you would have had no reason prior to now to conduct the
investigation. requested.
Application for the mining permit was dated July 2, 1979,
under the name ofElmwoodQuarry, Inc. The application hasbeen
presented tothe Land Quality Section on the appropriateform for
that purpose. It includes a reclamation plan and a plat reflecting

thelocation of the quarry adjacent to Fourth. Creek, including the
location of the stockpiles and the waste area. I assume that a copy
of that application and the supporting documents would be available
toyou from the appropriate. agency.
I am sending a copy of this letter to the Land Quality
Section with a request that it take no action on the application for
the miningpermit until your office has had an opportunityto.inves-
tigate .the points raised herein. Please feel free to call or write'.
if you have questions about any of the matters mentioned in this
letter.
