HomeMy WebLinkAboutSW3191101_Email_20211018 Farkas, Jim J From:Farkas, Jim J Sent:Monday, October 18, 2021 4:00 PM To:Bob Griffin Subject:RE: \[External\] Cambridge Project Lincoln County If you would like to modify the Operation and Maintenance Agreement to include the french drain monitoring condition you will need to do the following: - Go to the following web address (https://deq.nc.gov/about/divisions/energy-mineral-and-land- resources/stormwater/stormwater-program/stormwater-design) and open the “O&M EZ Form” under “Forms” - To use/modify the spreadsheet, you will need to “Enable Editing” and “Enable Content”. This spreadsheet uses macros to automatically generate the required pages based on the information entered into the cover page. - You’ll need to re-enter the information from the original O&M Agreement Form (attached) into the new form. In addition to the two wet ponds, you will need to enter a “User Defined SCM”. Once all of the information is entered into the cover page you will need to click on the “Click to update O&M manual” link, this will generate the needed pages of the form. - The “User Defined SCM” page will need to be populated with the french drain O&M requirements and inspection/remediation procedures. You can look at other SCMs to get a feel for what this section should look like (I cannot tell you what items should be included, you must come up with these on your own. The proposed O&M and inspection/remediation procedures should address the concerns raised by Lincoln County and should help ensure that the capacity of the wet ponds are not impacted). - You will also need to carry over some information from the “Wet Detention Pond Design Summary” page from the old O&M Agreement to the new O&M Agreement - Once the O&M form is done, send me a PDF so that I can review/comment if needed prior to it being signed. - If the O&M Agreement is good, get the permittee (Tadd M. Miller of North Pilot Knob Road, LLC) to sign the form in the presence of a notary. NOTE: Typically, the permittee is listed as the responsible party. I don’t remember exactly why, but that was not the case here (I’d recommend changing it so that the permittee, Tadd M. Miller is listed as the responsible party since, as the permittee, he is ultimately responsible for the operation and maintenance of the site) NOTE: You may wish to get two copies of this formed signed and have the permittee keep one since the Register of Deeds usually requires an original copy when recording this document (and we require an original copy). - You will also need to complete and provide two original signed hard copies of the minor modification form (https://deq.nc.gov/about/divisions/energy-mineral-and-land-resources/stormwater/stormwater- program/post-construction, under “Application Forms”). The minor modification form will be filled out in a manner similar to the attached one (except Part A8 and Part C would be altered for this specific modification). If you like, you can send me a PDF of this form when you send the PDF of the O&M Agreement Form and I will review it prior to you getting it signed. - If Tadd M. Miller is no longer the point of contact for North Pilot Knob Road, LLC, you can complete the Permit Information Update Form (on the same web page as the minor modification form). If North Pilot Knob Road, LLC is no longer involved with the project, let me know as things may get a little more complicated (The permit will need to be transferred). Also, would you be able to provide a calculation showing how much “extra” water quality storage is available in the SCM (or a calculation showing a maximum rate of baseflow that would not negatively impact the water quality storage volume)? These calculations would go a long way in demonstrating that these french drains won’t impact the SCM. The pictures and explanation are good, but the area is currently in a drought (https://droughtmonitor.unl.edu/CurrentMap/StateDroughtMonitor.aspx?NC) and it hasn’t rained there in a couple of days so the provided information may not be demonstrative of the site in wet conditions. When speaking with Lincoln County, he had mentioned some seepage/groundwater issues with the neighboring Publix and was concerned that something similar could happen with this site. I reached out to some inspectors in our Mooresville Regional Office and they had received some complaints about the Publix site releasing groundwater into the adjoining roadway (the attached pictures were taken in August of this year when it was a bit wetter). It would be nice to have some pictures of these french drains during a wetter part of the year, but I understand that you are in a bit of a rush to get this resolved (and can’t realistically wait until the soils become more saturated) so that is why I suggested the calculations, it’ll give me something a little more substantial to base my determination on and it can be relatively quickly produced. Alternatively, you could modify the permit (with a minor modification) to add a “french drain monitoring condition” (or something similar) to the O&M Agreement form (essentially stating that the permittee will keep an eye on the base flow and fix any issues/impacts to the SCM that may arise from it). Jim, Please find attached Shield’s letter explaining the dewatering system at the project in Lincoln County. Please review and if you need any additional information, please let me know and I will gladly provide it. I attached the pictures because after scanning the letter with pictures they came out sort of dark. I think with the pictures above you can clearly see that there is no flow from any of the under-drain systems. These systems will have no impact on the stormwater BMP. Robert L. Griffin, P.E.
