Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This permit includes the following changes from the draft permit sent to you on January 7, 2004: ➢ Permitted flow has been corrected to 0.025 MGD, as in your previous permit. The 0.008 MGD limit in the draft permit was a typographical error. D This permit includes a TRC limit that will take effect on October 1, 2005. Per your request, this limit [and the monitoring requirements associated with it] apply ONLY if chlorine is used for disinfection. The reference to chlorine disinfection has been removed from the Supplement to Permit Cover Page, as you requested. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. As of this permit issuance, any previously issued permit bearing this number is no longer effective. Weaver, Jr. NPDES Unit NCDENR Division of Water Quality 1617 Mail Service Center Raleigh, NC 27699-1617 Dear Mr. Weaver: Re: Permit for NC0043125 Thank you for your letter of January 7 and the draft copy of the permit for our WWTP at Patterson School. I have reviewed the draft and have two requests. The draft shows our limit of flow to be .008MGD Monthly Average. Our previous permits have set this limit at .025MGD, same as the plant's rated capacity. For several years we have operated well under capacity, due to low enrollment at the school. We are trying diligently to increase enrollment and as it increases the flow will also increase. We request that the Monthly Average Flow continue to be listed as .025MGD so as to not present any obstacle to our growth. Also, concerning the new TRC requirements, we do not use chlorine in the WWTP because we have discharged directly to the Yadkin River since 1991. We had discharged into Barnett Branch up to that time, and had been chlorinating and were about to have to also dechlorinate. Looking at the long term costs of this it appeared reasonable to construct some 1100 feet of new discharge line to the Yadkin, where dilution factors made it unnecessary to chlorinate or dechlorinate. I can furnish copies of the related application and approval of this construction if you need it. I notice that on the page 'Supplement To Permit Cover Sheet' our operating components are listed, including (Chlorine Disinfection`. However, we have not used that feature since the line to the river was built in 1991. Since we do not chlorinate I request that we not have a TRC limit, as the Revised TRC Policy states in Mr. David ^oodrich`s letter of 6-19-03 to NPDES Unit Staff, for facilities that do not use chlorine. We request that we not have to monitor for chlorine weekly or at all. Monitoring would require expensive equipment we do not have and would serve little purpose if we are not adding chlorine at the plant. Weaver, Jr. We have improved the operation of this plant greatly in the last few years, following the guidance of Mr. Jim Reid with the Asheville Regional Office NPDES. Some years ago we had trouble occasionally with high BOD and TSS readings, but we improved the aeration schedule and covered the primary basin to keep out sunlight which had promoted algae growth. Now our BOD and TSS results are consistently far below our limits. I feel that we are putting better quality water into the river than what is already in it. Please consider these two requests in the permits final form. Holding costs down is all important to us, and it would be a great help to be spared the burden of chlorine monitoring. Sincerely, W. J. I had no idea this was renewal time, and I apologise for not being aware. I received no notice that it was time to reavply. For whatever help it may be to you to expedite this renewal I am also enclosing copies of all the corresoondance in my file concerning the permit just expired. There were two permit modifications issued folowing the initial permit issuance, regarding reduced monitoring frequency. We have made substantial progress in lowering the BOD and TSS at this plant during the course of the just expired permit. Mr. Jim Reid from the Asheville office has been most helpful in guiding this improvement. We are proud of this operation. I sent him to our website with instructions about which form to fill out. He's sending it in ASAP with appologies.
