Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
As per your request, the references to specific sampling months for quarterly flow sampling have been
eliminated. This does not, however, affect the requirement to sample for flow at least once per quarter. Please also
note that although the permit has been signed June 21, 2002, the effective date of the permit is September 1, 2002.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt
of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh,
North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements
to obtain other permits which may be required by the Division of Water Quality or permits required by the Division
of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may
be required.

This permit shall become effective September 1, 2002.
This permit and authorization to discharge shall expire at midnight on August 31, 2007.

During the period beginning on the effective date of the permit and lasting until expiration, the
Permittee is authorized to discharge waters, from the station sump (receiving flow from Unit 1
floor drains and wheel pit leakage) from outfall(s) serial number 001. Such discharges shall be
limited and monitored by the Permittee as specified below:

Best management practices must be employed to ensure that excessive pollutants are not
discharged to the surface waters of the State. These practices should include, as a
minimum, changing oil absorbent pads quarterly and cleaning accumulated sediment in the
bottom of the sump routinely.
Chemical wheel pit cleaning is permitted on a monthly basis. When cleaning of the wheel pit occurs,
the tailrace shall be inspected visually for foam and oil. Cleaning shall be conducted only with pre -
approved solvents. Should the Permittee wish to change cleaning solvents, a written request should
be made to the Division including the MSDS for the proposed solvent.
This permit does not limit mechanical cleaning operations which do not contribute any wastewater to
the discharge. Non -discharging cleaning operations may be conducted as often as necessary to
ensure safety and proper facility operation.
The Permittee shall obtain authorization from the Division prior to the use of any chemical
additive in the discharge. The Permittee shall notify the Director in writing at least ninety (90)
days prior to instituting use of any additional additive in the discharge that may be toxic to
aquatic life (other than additives previously approved by the Division). Such notification shall
include completion of Biocide Worksheet Form 101 (if applicable), a copy of the MSDS for the
additive, and a map indicating the discharge point and receiving stream.
Monitoring results obtained during the previous calendar quarter shall be recorded and reported on a
Discharge Monitoring Report (DMR) form and postmarked no later than the 30th day following the
completed reporting period. The first DMR is due on the 30th day of the month following the calendar
quarter in which the permit was issued. The Permittee shall confirm in uniting that BMPs have been
employed as specified in this permit with each DMR submitted.

A. (5.) SPECIAL CONDITION FOR MONITORING
In order to assess the impact of these discharges on the receiving stream, the Permittee is
required to submit four (4) data points for outfalls 001, 002 and 005 relating to oil and grease and
pH. The oil and grease and pH samples may be taken over the course of the permit life and the
resulting data shall be submitted prior to the next permit renewal.

TENNESSEE VALLEY AUTHORITY (TVA) - CHATUGE HYDRO (CTH) - NPDES PERMIT
NO. NC0027332 AND HIWASSEE HYDRO (HIH) NPDES PERMIT NO. NC0027359 -
COMMENTS ON DRAFT NPDES PERMITS
TVA has reviewed the draft NPDES permits for these facilities and offers the following
comments: •
1. The draft permits require quarterly estimates of flow to be reported for March, June,
September, and December. This requirement is not practicable for unwatering operations
because of their intermittent nature. Discharges are infrequent and may occur in months
other than those specified. TVA, therefore, requests elimination of this requirement for
these outfalls.
2. The description of Outfall 001 at CTH should be revised to read "waters from the station
sump (receiving flow from floor drains, penstock -envelope leakage, and Unit 1 wheel -pit
leakage)." Also, for consistency, we request that "dewatering sump waters" be changed to
"unwatering sump waters" in Part A (2) of the CTH permit.
3. TVA requests that "Chatuga" be changed to "Chatuge" throughout the permit.
4. TVA requests a 30-day period between the issuance date and the effective date of the
reissued permits to facilitate internal distribution of the permit.

BACKGROUND
The Hiwassee Hydro Plant produces electricity via hydraulic turbine generation. The facility
produces an average of 1,000 megawatt -hours per day of power, with peak power generation at 2,904
megawatt -hours per day. The Asheville Regional Office notes that most of the Hiwassee River's flow is
run through the facility for power production.
The plant has five permitted outfalls as follows:
001: waters from the station sump
002: waters from the draft tube unwatering operations
003 and 004: once through cooling water from generator air and bearing cooling
005: waters from upper galley drains and Unit 2 floor drains and pit leakage
None of the outfalls contain a limit for flow and all employ Best Management Practices (BMPs)
rather than monitoring for pH, oil and grease, and temperature. Each DMR report contains a statement
affirming that BMPs are being used on site. The staff report and permit fact sheet from the previous
permit indicate that a general permit is not entirely appropriate for this facility.
Instream Monitoring and Verification of Existing Conditions and DMR Data Review
This facility discharges to the Hiwassee River (classified C) in sub -basin 04-05-02 (Hiwassee
River Basin). The facility does not currently perform instream monitoring. Discharge Monitoring
Reports (DMRs) for flow (the only monitored parameter) were reviewed from 1998 to present. Average
flows from the five outfalls are dis.la ed below:

Correspondence
The Asheville Regional Office (ARO) did not conduct any site visits to this facility over the term
of the permit. Other than the required certification from the facility that BMPs are in place, there was no
correspondence noted from 1999 to present.

PERMITTING STRATEGY
• Waste Load Allocation (WLA)
The Division prepared the last WLA in 1985. The previous and current effluent limits were
based on guidelines and water quality standards. The Division has judged previous parameters and limits
to be appropriate for renewal. The draft 2002 Hiwassee River Basinwide Water Quality Plan reports
that the receiving stream is currently supporting all designated uses and provides no recommendations
for this discharger.
Reasonable Potential Analysis (RPA)
Since toxicants are not monitored in this discharge, no reasonable potential analysis was
performed.
SUMMARY OF PROPOSED CHANGES
The Permittee has not requested any changes nor are any changes deemed necessary at this time.

A(3). EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS FOR HYDROELECTRIC FACILITIES — SUMPS AND
DRAINS AND OTHER MISCELLANEOUS WASTEWATERS
During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is authorized to discharge waters from sumps & drains (including
powerhouse sumps & drains, wheel pit drains, head cover drains and gallery sumps & drains) and other miscellaneous wastewaters (from sumps & drains associated with
hydroelectric facilities) from outfalls numbered serially beginning with 001 (specific outfall numbers shall be assigned by the permittee). Such discharges shall be limited
and monitored by the Permittee as specified below:

1: The tailrace shall be visually inspected for oil sheens when discharge occurs immediately after the lubrication of wicket gates (or other lubrication operations
which aught result in the discharge of oil and grease) at the hydroelectric facility.
2: The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units for fresh water classifications.
The pH shall not be less than 6.8 standard units nor greater than 8.5 standard units for salt water classifications.
Chemical wheel pit cleaning is permitted on a monthly basis. When cleaning of the wheel pits occurs, the tailrace shall be inspected visually for foam and oil. Cleaning
shall be conducted only with pre -approved solvents. Should the Permittee wish to change cleaning solvents, a written request should be made to the Division including the
MSDS for the proposed solvent.
Mechanical cleaning operations which do not contribute any wastewater to the discharge are not limited by this permit. Non -discharging cleaning operations may be
conducted as often as necessary to ensure safety and proper facility operation.
The permittee shall obtain authorization from the Division prior to the use of any chemical additive in the discharge. The permittee shall notify the Director in writing at
least ninety (90) days prior to instituting use of any additional additive in the discharge which may be toxic to aquatic life (other than additives previously approved by the
Division). Such notification shall include completion of Biocide Worksheet Form 101 (if applicable), a copy of the MSDS for the additive and a map indicating the
discharge point and receiving stream.
There shall be no chromium, zinc or copper added to the discharge except as pre -approved additives to biocidal compounds.
There shall be no discharge of floating solids or visible foam (other than trace amounts) in the effluent.

I went back and looked at the permit again and was confused with respect to O&G.
For sampling frequency, you noted "2" which states a visual inspection once a
quarter. With O&G limits stated in the permit, do they also sample once a quarter

Enclosed are NPDES permit renewal application packets for CTH and HIH consisting
of a completed Short Form C and a wastewater flow schematic. Based on discussions
with Tom Belnick, it is TVA's understanding that site maps are not required. The
current permits are scheduled to expire at midnight on August 31, 2002.
Discharge sampling and analysis are not required under the current permits.
Quarterly letters certifying that best management practices (BMPs) were followed are
submitted in lieu of monitoring data. TVA requests that submission of quarterly BMP
letters be continued in the renewed permits.
TVA also requests a 30-day period between the issuance date and the effective date of
the reissued permits to facilitate internal distribution of the permit. If you have any
