This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983, and as subsequently amended. Please note the following changes from the previous permit (as indicated in the draft) have been finalized: • Updated address of facility on Cover. • Quarterly monitoring for total nitrogen and phosphorus has been added. This change is consistent with an effort to gather data about nutrient loading in this portion of the watershed. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made. this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Land Resources or any other Federal or Local governmental permit that may be required. ATC Information: • None in file Basinwide Plan Information: • Water quality in the upper Yadkin River at Patterson and Wilkesboro has improved over the last decade, but sedimentation continues to be an issue. Numerous streams draining the Blue Ridge Mts. have good or excellent water quality. (This discharge is into the Yadkin in the upper portion of the Yadkin's watershed.) • Nearest ambient station (02111000) is near Patterson (just upstream of discharge). Yadkin in this area is supporting uses. Correspondence: • 3 NOVs issued for BOD violations in 1996 and 1 in 1997. • 1997 Compliance inspection report noted that a dosing tank problem had been repaired, but distribution lines needed attention. DMR Review: • Flows typically 0.004 MGD. • TSS fluctuates, normally less than 20 mg/1; some exceptions in 1996. • BOD5 fluctuates, levels more controlled in 1997 (below 30 mg/1). • No fecal monitoring. • Temperatures okay. • Ammonia usually less than 15 mg/1. General Comments: Currently facility does not monitor for fecal. Calculations indicate does not need a limit, but for facility should be monitoring. Ammonia toxicity calcs. show no limit necessary (conc. above 35 mg/1). Facility does discharge to Trout waters; however, does not appear to use chlorine for disinfection. Division policy is to require a TRC limit for all dischargers to Tr waters, but I will footnote that monitoring only applies if chlorine used to disinfect.
