Hi, Tom -
I have reviewed your request and discussed it with Wes Bell of our Mooresville Regional Office. Because the transfer as
proposed will not result in a discharge to surface waters, you may proceed at your convenience. Please notify both Wes
and me within two weeks after the work is completed and provide an updated copy of your Table 1, Wastewater Tank
Volume Estimates.
You do not need to request permission for future transfers so long as there is no release from the tanks. But, again, you
should notify us when those transfers occur and provide an updated table of tank volumes.
Let me know if you have any further questions.

Hello Mike (et all)
Please find a letter regarding the storm water that has accumulated in various tanks at the
former Crompton & Knowles plant in Lowell, NC. The letter outlines our plans to move the
water from Tank 1 into another tank so that it does not discharge through a hole cut in Tank
1 by the previous owner.
We continue to work through the process with DENR to secure a BFA on the site and hopefully
sell the property to Gaston County for the expansion of a park that is contiguous to the
property.

Stormwater/Sludge in Wastewater Tanks
Due to the presence of stormwater getting close to the bottom of the cut out section of Tank 1, on
February 3, 2015, Hart & Hickman, PC measured the total volume capacity, existing water and
sludge volume, and remaining capacity in each tank. Remaining capacity was calculated assuming
a 2 ft freeboard in each tank except for Tank 1. A summary of these measurements is provided in
the attached table. The locations of the tanks and their designations is provided in the attached
figure.
Based upon the above, Lowell Investments I is proposing to pump stormwater in Tank 1 to Tank
4. The approximate volume of water in Tank 1 is 8,700 cubic ft (65,000 gallons) and the current
excess capacity in Tank 4 is 73,400 cubic ft (550,000 gallons). These values are highlighted in the
attached table. Prior to pumping the water, we will sample the water in Tank 1 for volatile organic
compounds by EPA Method 8260, for semi-VOCs by EPA Method 8270, and for RCRA metals.
In addition, a composite sample will be collected from the remainder of the tanks for analysis of
the same parameters to provide updated analytical data for the tanks. These data will be provided
to you before the water is transferred from Tank 1 to Tank 4.
We also understand that DENR has requested sludge analytical data from the tanks. In May 2010,
Hart & Hickman collected samples of the sludge from the tanks. Seven grab samples were
collected for analysis of fecal coliform, and one composite sludge sample from all of the tanks was
collected and analyzed for pH (corrosivity), ignitability, reactivity, nitrate/nitrite, total Kjeldahl
nitrogen, ammonia, VOCs, SVOCs, metals, and toxicity characteristic leaching procedure (TCLP)
VOCs, SVOCs, and metals. The data are attached. Because there has been no wastewater
treatment since that time and the sludge was not removed after the samples were collected in 2010,
we believe that these data are representative of the current condition of the sludge. Therefore, we
do not believe that additional sampling of the sludge is warranted at this time.

This letter is to provide you with an update on the above referenced NPDES Permit and related development plans
pertaining to the site. Additionally this letter addresses our plans for storing the storm water that has accumulated
in Tank 1.
Summary of Current Redevelopment Plan for the Site:
• NC DENR is in possession of $3+mm dollars received from the Crompton & Knowles bankruptcy
proceedings to be utilized towards the site remediation.
• I have entered into conversations with Gaston County officials regarding the County purchasing the site
from me to expand Poston Park which is contiguous on two sides.
• We have agreed in principle on a price and general terms, however, nothing definitive.
• The plan is for the County to purchase the site from me, and then work with DENR to establish a Brownfield
appropriate scope of work and how the bankruptcy funds could be utilized for the sites remediation and
potentially for some limited redevelopment / restoration work.
• Part of the purchase price would include the nutrient allocation from the existing NPDES Permit.
• The Carolina Thread Trail would connect along the water frontage (a key connection).
• A few of the buildings would likely remain as public works, park and other municipal outbuildings (likely not
full office build out).
Regarding the existing NPDES Permit, Twin Rivers Utilities (Gaston County) has expressed an interest in acquiring
the nutrient allocation as part of the transaction. While the allocation is not currently needed, Twin Rivers is desirous
of protecting the allocation for allocation future growth and potentially stricter nutrient rules. The nutrient allocation
is one of the key assets associated with the site and its continued protection is critical.
Plan for Accumulated Storm Water in Tank 1
As the current owner of the site, Lowell Investments I, LLC has not had any discharges from the facility. There are
various tanks (outlined below) that have sludge that will eventually need to be removed. Prior to taking title, the
previous owner Kings Mountain Venture # 1, LLC received permission from DENR to drain the water in these tanks.
Since we acquired the site in December of 2013, rain water has filled these tanks again.

Please find a letter regarding the storm water that has accumulated in various tanks at the
former Crompton & Knowles plant in Lowell, NC. The letter outlines our plans to move the
water from Tank 1 into another tank so that it does not discharge through a hole cut in Tank
1 by the previous owner.
We continue to work through the process with DENR to secure a BFA on the site and hopefully
sell the property to Gaston County for the expansion of a park that is contiguous to the
property.
