The Division of Water Quality (the Division) hereby issues the attached NPDES permit for the
subject facility. We issue this permit pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
Changes to Your Previous Permit. The Division understands that you have made no significant
alterations to your facilities during the previous permit cycle except to add ethanol storage and
mixing. We have therefore made minimal changes to your permit by updating your facility map and
treatment -component description, and have added parameter codes to the effluent monitoring page
for your convenience [see Supplement to Cover Sheet and Section A. (1.)].
We have also replaced your monthly monitoring for Phenol (single compound) to Total
Recoverable Phenolics (parameter code 32730; monitor Monthly, no limit) in accord with new
permitting guidance for water supply (WS) waters [see Section A. (1.)].
Change to the Permit Draft. The Division has removed previous Special Condition A. (2.) for
Methyl Tertiary Butyl Either (MTBE). While you must continue to monitor MTBE, the Division will
evaluate future compliance based on new surface -water standards for Human Health (1500 µg/L),
and for discharges to Water Supply (WS) waters (19 µg/L).

If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within
thirty (30) days after receiving this letter. Your request must take the form of a written petition
conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the
office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714.
Unless such a demand is made, this permit shall be final and binding.
This permit is not transferable except after notifying the Division of Water Quality. The Division
may require permit modification, or revocation and re -issuance. Please note that this permit does
not affect your legal obligation to obtain other permits required by the Division of Water Quality,
the Division of Land Resources, the Coastal Area Management Act, or other federal or local
governments.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
Kinder Morgan Southeast Terminals, LLC
is hereby authorized to:
1. continue operating an existing Surface -Water Pollution Control System for stormwater in proximity
to above -ground storage tanks (ASTs), surface bulk -storage of petroleum hydrocarbon fuels in
excess of one million gallons and ethanol, utilizing
• diked areas (secondary containment of ASTs and piping)
• truck loading -rack drains
• groundwater remediation treatment and discharge
• waste -holding tank (with optional pump -out for offsite disposal)
• oil / water separator
• settling pond (with outfall)
• discharge control valve, manually operated, normally closed (a
point -source discharge)
located at the Kinder Morgan Southeast Terminals, Greensboro Terminal 1, 6907 West Market
Street, Greensboro, Guilford County, and
2. discharge from said treatment works via Outfall 001, a location specified on the attached map, into
an unnamed tributary (UT) of East Fork Deep River [stream segment 17-2-(0.3)], a waterbody
currently classified WS-IV* within Subbasin 03-06-08 of the Cape Fear River Basin.

Footnotes:
1. Flow — During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring
Report (DMR) indicating "No discharge". Flow shall be monitored with each discharge event
and may be monitored in one of four ways:
a) measure flow continuously;
b) calculate flow [see section A. (3.)] Rational Equation) based on total rainfall per unit
area draining to the outfall; exclude built -upon areas (best method for facilities with
large runoff -collection ponds);
c) estimate flow at 20-minute intervals during the entire discharge event; or
d) report flow based on discharge pump logs.
2. Oil and Grease - where possible, the grab sample should be skimmed from the surface of a
quiescent (calm water) zone.
3. Acute Toxicity (Fathead Minnow, 24-hour), annually [see Special Condition A. (2.)].
Units: mg/L = milligrams per liter
µg/L = micrograms per liter
MTBE = methyl tertiary butyl ether
Conditions:
• The Permittee shall discharge no floating solids or foam.
• The Permittee shall discharge no tank solids, tank bottom water, or tank rag layer.
• The Permittee shall not discharge tank (or pipe) contents following hydrostatic testing unless benzene
concentration is less than 1.1914/L and toluene concentration is less than 11 µg/L.

A. (2.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)
24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste
treatment. The permittee will conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit. The annual test requirement must be performed and
reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

The rational equation is used to calculate the runoff from a region, given:
• the runoff coefficient which accounts for infiltration and other potential
losses in the region,
• the rainfall intensity to the region,
• the time it takes for runoff to travel from the region's upper reaches to its
outlet, and the region's drainage area.

analyses (— 29 %) recorded in BIMS as "mg" instead of " pg," I went to Central Files to
review the DMRs. After review, I conclude that the DMR are correct. Therefore, this is a
DWQ data entry error — BIMS units do NOT match the DMRs in Central Files.
o Phenol (single compound) has been changed to Total Recoverable Phenolics [code 32730]
to address chlorinated phenols, in accord with discharge to WS waters. No [single] phenol
was detected during the previous permit cycle.
• RPA run on existing database — revision for final pending receipt of amended DMRs.
• Permittee requested that renewal reflect their recent storage and use of ethanol (see Permittee's letter
dated July 30, 2008); added ethanol to the facility description (see Supp to Cover Sheet); revised
Supp to Cover Sheet to reflect new stream data; added parameter codes to effluent Table, A. (1.).

Dear Ms. Sprinkle:
Kinder Morgan Southeast Terminals, LLC (KMST) is requesting the renewal of our NPDES
permit NC0000795 for our Greensboro 1 Terminal, located at 6907 West Market Street in
Greensboro, NC, Guilford County.
Enclosed, please find one original and two copies of a NPDES Permit Application Short Form-
C (Minor Industrial) for the renewal of NPDES Permit NC0000795. A topographic map
documenting the latitude and longitude of the subject outfall is also enclosed.
The terminal now stores denatured ethanol in aboveground storage tanks and blends the
denatured ethanol with gasoline at the loading rack.
The Greensboro 1 Terminal only discharges storm water and therefore, does not generate
sludges or solids at the facility. All petroleum contact waters and petroleum tank bottoms
are transported to a KMST approved treatment and disposal facility.
