Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as
subsequently amended). This permit contains no significant changes from the draft permit sent
to you on June 6, 2006.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required. If you have any questions concerning this

All previous NPDES Permits issued to this facility, whether for operation or discharge
are hereby revoked. As of this permit issuance, any previously issued permit bearing
this number is no longer effective. Therefore, the exclusive authority to. operate and •
discharge from this facility arises under the permit conditions, requirements, terms,
and provisions included herein.
Kinder Morgan Southeast Terminals, LLC
is hereby authorized:
1. to continue operating an existing stormwater treatment Water Pollution Control
System consisting of:
• truck loading -rack drains
• groundwater remediation discharge (treated)
• waste holding tank (with optional pump -out for offsite disposal
• secondary containment (bermed area) for surface storage tanks and
piping (with discharge to onsite pond)
• new oil / water separator component between the new Transmix process
unit and the retention pond
• retention pond with manual control valve (discharging to dry ditch)
The facility is located at the Kinder Morgan Southeast Terminals, Greensboro
Terminal, 6907 West Market Street, Greensboro, Guilford County, and
2. discharge from said treatment facility through. Outfall 001 at a specified
location (see attached map) into an unnamed tributary (UT) of the East Fork of
the Deep River, a waterbody classified as WS-IV waters within the Cape Fear
River Basin.

1. Flow- During periods of no flow, the Permittee shall submit a monthly
Discharge Monitoring Report (DMR) indicating "No discharge". Flow
shall be monitored with each discharge event and may be monitored in
one of four ways:
a) measure flow continuously;
b) calculate flow (see Attachment A. (4.) Rational Equation) based on
total rainfall per unit area draining to the outfall; exclude built -
upon areas (best method for facilities with large runoff -collection
ponds);
c) estimate flow at 20-minute intervals during the entire discharge
event; or
d) report flow based on discharge pump logs.
2. Oil and Grease - Where possible, the grab sample for oil and grease
should be skimmed from the surface of a quiescent (calm water) zone.
3. MTBE - See Part A. (2.) for other requirements relating to MTBE
4. Acute Toxicity (Fathead Minnow, 24-hour), Annually [see Special Condition A. (3.)].
Units: mg/L = milligrams per liter

MTBE = methyl tertiary butyl ether
There shall be no discharge of floating solids or foam visible in other than trace amounts.
The permittee shall not discharge tank solids, tank bottom water, or the rag layer.
The peiiuittee shall not discharge tank (or pipe) contents following hydrostatic testing unless
benzene concentration is less than 1.19 pg/L and toluene concentration is less than 11
µg/L•

SPECIAL CONDITIONS
A. (2.) MTBE MONITORING ^ SPECIAL CONDITION
For the protection of public health, oil terminals discharging to waters classified as water
supply (WS) waters shall monitor Methyl Tertiary Butyl Ether (MTBE) for the duration of
this permit.
The Division anticipates that an MTBE regulatory criterion or Water Quality Standard will be
established during the coming permit cycle. For the next cycle of permit renewals, the
Division expects to apply this criterion or standard to MTBE data collected during this
permit cycle. Should the permittee's MTBE data indicate discharge in excess of this criterion
or Water Quality Standard, an MTBE limit will be added to the permit monitoring
requirements at renewal.
Outfa11 001. Based on data submitted by the Permittee over the previous permit cycle, the
Division has reduced Monthly monitoring to Quarterly. If MTBE is detected at Outfall 001,
the Permittee shall immediately resume Monthly monitoring for MTBE, and the Permittee
shall submit to the Division an MTBE Action Plan to identify the sources of MTBE
contamination. This Action Plan is due to the Division within 180 days of the first detection
of MTBE.

EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
• SPECIAL CONDITIONS
A. (3.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)
24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste
treatment. The permittee will conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit. The annual test requirement must be performed and
reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the.toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

A. (4.) FLOW MEASUREMENT RATIONAL
The Rational Equation: Q=KuCIA, where:
Q = flow (peak flow rate (cfs or m3/sec)
Ku = units conversation factor = 1.008 for U.S. standard units
(usually ignored because it is so close to 1), or 0.278 for SI
units
C = dimensionless runoff coefficient for the watershed, loosely
defined as the ratio of runoff to rainfall
I = intensity of rainfall taken from the intensity -duration-
- frequency curves for the specified design return period at
the time of concentration, tc (in/h or mrri/h). tc = time of
concentration (time after the beginning of rainfall excess
when all portions of the drainage basin are contributing
simultaneously to flow at the outlet) .
A = area of tributary watershed (acres or km2)
The rational equation is used to calculate the runoff from a region, given:
• the runoff coefficient which accounts for infiltration and
other potential losses in the region,
• the rainfall intensity to the region,
• the time it takes for runoff to travel from the region's upper
reaches to its outlet, and the region's drainage area.

On the basis of thorough staff review and appli-
cation of NC General Statute 143.21, Public law
92-500 and other lawful standards and regula-
tions, the North Carolina Environmental Man-
agement Commission proposes to issue a Na-
tional Pollutant Discharge Elimination System
(NPDES) wastewater discharge permit to the
person(s) listed below effective 45 days from
the publish date of this notice
Written comments regarding the proposed per-
mit will be accepted until 30 days after the
publish date of this notice. All comments re-
ceived prior to that date are considered in the
final determinations regarding the proposed
permit. The Director of the NC Division of Wa-
ter Quality may deride to hold a public meet-

receive a significant degree of public interest.

This permitted facility discharges treated

quality limited, which may affect future alloca-
tions in this portion of the Cape Fear River Ba-

NPDES Permit Number NC0000795, Kinder Mor-
gan Southeast Terminals LLC, Greensboro Ter-
minal 1 has applied for a permit renewal for a
facility located in Guilford County discharging
treated wastewater into an Unnamed Tributary
of the East Fork Deep River in the Cape Fear
River Basin. Currently, no parameters are water
quality limited., however this discharge may af-
fect future allocations in this portion of the re-
ceiving stream.
NPDES Permit Number NC0022209, Motiva En-
terprise LLC, Greensboro Terminal has applied
for a permit renewal for a facility located in
Guilford County discharging treated wastewa-
ter into an Unnamed Tributary of Long Branch
Creek in the Cape Fear River Basin. Currently, no
parameters are water quality limited, however
this discharge may affect future allocations in
this portion of the receiving stream.
The City of High Point (P.O. Box 230, High Point,
NC 27261) has applied for renewal of NPDES
permit number NC0081256 for the Frank L.
Ward WTP in Guilford County. This permitted
facility discharges treated wastewater to in the
Richland Creek in the Cape Fear River Basin.

Introduction
Kinder Morgan Southeastern Terminals — Greensboro Terminal 1 (herein referred to as Kinder
Morgan or the Permittee) requires a National Pollutant Discharge Elimination System (NPDES) permit to
dispose treated wastewater to the surface waters of the state. The Permittee's 5-year NPDES permit expires
August 31, 2006 and they have requested renewal from the Division of Water Quality (the Division). This Fact
Sheet summarizes background information and rationale used by the Division's NPDES Unit to determine
permit limits and conditions.
Facility Records Review
Facility Description. Kinder Morgan operates the Kinder Morgan Southeastern Terminals —
Greensboro Terminal 1, a bulk -petroleum fuel storage and distribution center in Guilford County.
Discharge from the facility consists of hydrostatic tank -testing and maintenance wastes, and
stormwater runoff controlled by a Water Pollution Control System consisting of: loading rack drains;
oil/water separator; waste holding tank with optional offsite disposal; pumps to empty dike
containment areas through the oil -water separator; and discharge control valves. Discharge travels to
an unnamed tributary (UT) to the East Fork of the Deep River.

HISTORY AND DATA REVIEW
Facility Inspections. The Winston-Salem Regional Office has scheduled regular annual inspections
of this facility.
Waste Load Allocation (WLA). The current permit expires on August 31, 2006 and the Division
received an application to renew on February 20, 2006, which also referenced a new "Transmix"
interface -processing unit, which will be added in the Spring of 2006. On March 2, 2006 a Supplement
to the Renewal Permit was received by the Department explaining that the permittee utilizes other
licensed facilities in addition to Shamrock Environmental Allied Energy Corporation for its solids
removal and energy recovery of the same. The Division reviewed this permit, the WLA in April 1991
and the New Jordan Lake Strategy; 030602 to developed and review effluent limits and monitoring
requirements based on an in -stream waste concentration (IWC) of 100% (zero -flow receiving -stream
conditions). The Division judges these limits and monitoring requirements to be appropriate for this
renewal except as noted herein (see PERMITTING APPROACH SUMMARY).
Verifying Existing Stream Conditions. This facility discharges under "zero -flow" receiving -
stream conditions to an unnamed tributary (UT) to the East Fork of the Deep River 103-06-08], a
Class WS-IV stream within the Cape Fear River Basin. The east fork of the Deep River does not
appear on the Division's "impaired" waterbody list, i.e., is not 303(d) listed.
Discharge Monitoring Reports (DMRs) — Effluent Data Review. DMRs were reviewed from
January 2002 through February 2006. Discharges from Outfall 001 occurred episodically, but usually
several times or more per month. The Permittee reported non -discharge months as "no flow" in
accordance with the permit. The Permittee reported a maximum discharge of 0.339 MGD (July 2004).
Notices of Violation (NOVs). DMRs were reviewed from January 2002 through February 2006,
which reflected no NOVs were issued to this facility during this permit cycle.
Whole Effluent Toxicity (WET) Test. The facility has passed its annual acute toxicity test for the
past 4 years, from 2002 through 2005.
PERMITTING STRATEGIES
New SOP for Oil Terminals. The Division established renewal criteria for this permit according to
the NPDES Permitting Requirements for Petroleum Bulk -Storage 2005 Permitting Strategy, version
September 9, 2005 (2005 SOP), as amended (April 14, 2006).
Cape Fear Nutrient Strategy 2006. The Division renewed this permit in accordance with the
Supplement to NPDES Permitting Strategies for the Cape Fear River Basin, 2006 Permit Renewal
(May 10, 2006). The Kinder Morgan discharge location is governed by the Cape Fear River Basin
permitting strategy for Nutrients and oxygen demanding wastes (Subbasin 30608). Therefore, this
facility is not impacted by this new permitting strategy to monitor for Total Nitrogen and Total
Phosphorus.
Summary of Reasonable Potential Analysis (RPA). The 2005 SOP establishes 12 criteria for
renewal including those requiring a reasonable potential analysis (RPA). RPA parameters of concern
(POCs) with stream standards or criteria include benzene, toluene, MTBE and Phenols based on the
Division's review of effluent data submitted by the Permittee. The RPA concluded that no RPA exists

for these (POCs). Resultantly, Monthly monitoring for these pollutants will continue to be Monthly
Monitoring with no limits.
EPA Method 625, MTBE, and Total Suspended Solids (TSS). Based on the Division's
review of the DMRs, the twice -annual EPA 625 scans did not detect semi -volatile organic
compounds. Therefore Method 625 was deleted from the permit, per 2005 SOP. We will
replace this test with a single parameter, naphthalene (1/Month), to detect heaver distillate
fuels like diesel and fuel oil. Total Suspended Solids (TSS) did not exceed permit limit of 45
mg/L during this permit cycle but must still be monitored monthly with a 45.0 mg/L limit per
the 2005 SOP. This SOP rationale for continuing the TSS monitoring and limit is that the
daily maximum limit is recommended as a minimum stormwater management practice.
Similarly, MTBE was not detected and 1/Month monitoring was reduced to 1/Quarter.
Because phenol was not detected during this permit cycle, reasonable potential will not be
calculated, and no phenol limit will be included — monitoring frequency will remain at
1/Month, per SOP 2005.
Permitting Approach Summary
Based on Discharge Monitoring Reports (DMRs) submitted over the last permit cycle, new permitting
strategies, and information currently available, the Division has made the following changes to the
previous permit:
• MTBE — (not detected) relaxed 1/Month monitoring to 1/Quarter monitoring; no limit.
• EPA Test Method 625 — (no parameters detected) deleted from permit per 2005 SOP
• Naphthalene — (not included in previous permit) added 1/Month monitoring; no limit.
• Phenol — (not detected) relaxed 1/Month monitoring to 1/Quarter monitoring; no limit.
• Aquatic Toxicity Testing— Change from Annual Testing to Quarterly / Oil Terminal
Guidance for Episodic Discharges
Requested changes impacted by 2005 SOP.
• BTEX changes remain at Monitoring on a Monthly schedule.
• MTBE monitoring changed from Monthly to Quarterly.
• TSS remains at Monthly monitoring with a Daily Max limit of 45 mg/L.

testing for parameter code 34694 (single compound) at both of our Greensboro, NC
facilities (NC0000795 and NC0042501), effective with our May 2006 DMR, so that we
can adhere to the State of North Carolina's guidelines and coincide with your BIMS
database system.
Ms. Phillips: Please make the applicable changes in your RIMS database for both our
Kinder Morgan Southeast Terminal permitted locations NC0000795 and NC0042501 to test
and report on our DMR's as Phenol Parameter Code 34694, beginning with our May 2006
DMR per Mr. Corporon's confirmation. (April's DMR Phenol report from NC0042501 is

Mr. Furr - the Division wants you to monitor and report "phenol" (single
compound) for all tests /both your bulk -storage facilities. The proper
parameter code for this single compound is *34694*. This is the code we
enter into BIMS to evaluate your permit compliance. If you report any
other number or value, you are likely doing yourself an injustice (it
will like be a larger value, as in "total phenols"). Ask your "monthly"
lab to provide the single compound, phenol *only* (there are many sister
compounds).

Dear Mr. Guerra:
Thank you for accepting this addendum to Kinder Morgan Southeast Terminal's (KMST) NPDES renewal
application for our Greensboro Terminal 1. The purpose of this addendum is to request the addition of an
oil/water separator (OWS) between the new transmix process unit and the retention pond. The oil/water
separator is a Vertical Tube Coalescing model with a 300 gallon per minute design flow, 2,455 gallon
separator operating capacity and 325 gallon oil storage capacity.
As described in the cover letter to our permit renewal application dated February 15, 2006, the transmix unit
will be constructed on a concrete slab with secondary containment. Storm water collected in the
containment will be manually released to the OWS unless there is a notable oil sheen, in which case the
operator will have the oil properly removed. The OWS will be located approximately 25 feet from the
transmix process pad and filtered effluent from the OWS will be pumped via a lift station to the facility's
retention pond.
The OWS will have two methods of transfer to the retention pond: A lift station and gravity drain. The lift
station is the main system and the gravity drain off the OWS effluent chamber can be used if the lift station is
not working properly.
It is KMST's understanding that an Authorization to Construct (AtC) will not be required, since the proposed
installation of the OWS is coincident with the renewal of the facility's NPDES permit. Please advise if I am
not correct in this regard. KMST feels that the addition of this OWS provides the terminal with an added level
of environmental protection and facilitates proper management the facility's storm water. Please do not

Dear Mrs. Bryant:
Enclosed please find one original and two copies of a NPDES Permit Application — Short
Form C (Minor Industrial) for the renewal of NPDES Permit NC0000795 for the Kinder
Morgan Southeast Terminals LLC facility located at 6907 West Market Street in
Greensboro, NC. A general site plan and a site drainage plan are also enclosed. The
facility should be referred to as the "Kinder Morgan Southeast Terminals — Greensboro
Terminal 1" on the renewed NPDES permit.
Solids produced at the facility are removed on an as needed basis by companies such
as Shamrock Environmental Corporation or Allied Energy Corporation, who
reclaim the solids for energy recovery.
A "transmix" (also known as "interface") processing unit will be added to the Greensboro
Terminal 1 facility for scheduled production in the Spring of 2006. The unit is not
expected to have a material effect on the quality of the subject discharge, since it will be
processing the same family of products already stored at the terminal. Transmix is
generated during the pipeline transportation of refined petroleum products as one product
moves behind the other in the pipeline. Transmix forms where the two products "co -
mingle" in the pipeline. The transmix processing unit will split the transmix back into
specification products, such as unleaded gasoline and other petroleum distillate fractions
through simple distillation. The unit will be constructed on a concrete slab with
secondary containment. Storm water discharge from the containment will be visually
observed and then released through a manual valve. The storm water will drain to the
lined settling pond.
After reviewing the results for BTEX compounds (Benzene, Toluene, Ethyl Benzene, and
Xylene), MTBE, Total Suspended Solids (TSS), and Oil and Grease indicated in the
monthly Discharge Monitoring Reports (DMRs) from January 2003 to December 2005, it
is noted that non -detects or "below quantifiable limits" for BTEX compounds, MTBE,

and oil and grease have been reported for the effluent samples at the terminal since
January 2003 with one exception. In June 2003 oil and grease had a result of 62.0 mg/L,
but Total Suspended Solids (TSS) and all other characteristics were non -detect. As TSS
was reported as non -detect, we believe the oil and grease result to be questionable. The
daily maximum limit for TSS is 45.0 mg/L. From January 2003 to December 2005 the
maximum result for TSS was 10.0 mg/L in July 2004, and the average result during the
three year period was 5.0 mg/L. Therefore, Kinder Morgan Southeast Terminals LLC
would like to request a monitoring frequency reduction from monthly to semiannual for
BTEX compounds, MTBE, TSS, and oil and grease.

The principle processes are bulk storage and distribution of petroleum products at a terminal facility.
The following processes/industrial areas exposed to storm water are located at the facility: truck
loading rack, vapor recovery unit, pump manifold, pump -back area, tank farm, and the proposed
Transmix processing unit.
A Transmix processing unit will be added to the Greensboro Terminal 1 facility for scheduled
production in April 2006. This unit will process Transmix from the pipeline and separate the various
petroleum products for storage in the existing tanks on site. Transmix is a by-product of refined
products pipeline operations. It is created by the mixing of different specification products during
pipeline transportation. Transmix processing plants split the Transmix back into specification
products, such as unleaded gasoline and diesel fuel. The unit will be constructed on a concrete slab
with secondary containment. Storm water discharge from the containment will be visually observed
and then released through a manual valve. The storm water will drain to the lined settling pond. Note
that the same, refined petroleum products will be processed through the transmix unit as are
