Dear Mr. Sledge,
This letter is intended to provide documentation as to the completion of required quarterly
reporting under the subject consent order.
Condition 2.b.4 of the subject order stipulates that quarterly reports on the status of ash basin
dewatering work and other activities undertaken with respect to excavation of the facility's coal
ash surface impoundment are to be submitted for two years of ash excavation operations.
While Duke Energy commenced excavation in 2017, the consent order did not go into effect
until January 27, 2020. Duke Energy has completed this quarterly reporting requirement with
the submittal of eight quarterly reports. The first report was dated April 23, 2020 and covered
the period of January 2020 through March 2020. The final quarterly report was dated January
26, 2022 and covered the period of October through December 2021.
Duke Energy will be developing and submitting the required Final Seep report, Seep
Characterization report and amendment to either the groundwater corrective action plan or
closure plan in accordance with the due dates in the consent order but, as authorized by the
consent order, will not be submitting further quarterly status reports.
