We are forwarding you revised permit pages for Sections A. (1.) and A. (2.). You should replace your existing Section A.(1.) and A.(2.) sheets with these revised pages. Since ATU approved this monitoring revision in July, the revisions are being made effective as of July 1, 2013. This permit revision is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The changes made in the permit modification include: Modifying the Whole Effluent Toxicity test from an acute testing requirement to a chronic 7-day pass/fail Ceriodaphnia test at a test concentration of 0.25%. See footnote 4 under Section A.(1.) and Chronic Toxicity Testing Requirements under Section A.(2.). As stated previously, the Permittee is required to notify the DWQ/Surface Water Protection Section at the Mooresville Regional Office 48 hours prior to discharge to allow for their inspection or observation of the wastewater discharge. Chronic toxicity test results shall be made available to the Regional personnel upon request and submitted with monthly Discharge Monitoring Reports. All sludge and wastewaters associated with the sludge will be disposed of in accordance with state and federal regulations. Addressing impaired waters is a high priority with the Division, and instream data will continue to be evaluated. If there is noncompliance with permitted effluent limits and stream impairment can be attributed to your facility, then mitigative measures may be required. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. Upstream = approximately 2.2 miles upstream at the Stanley/Spencer Mountain Road bridge. Downstream = approximately 2.6 miles downstream at the riverbank near the Lowell WWTP. 2. The duration of discharge must be recorded in order to calculate the total discharge quantity per day. 3. A chronic 7-day pass/fail Ceriodaphnia dubia test shall be performed for each 400,000 batch after it is mixed and aerated in the equalization basin. The test concentration shall be 0.25% and each test must pass at 0.25% prior to discharge (see Special Condition A (2.)). 5. The temperature of the effluent shall not cause an increase in the receiving stream of more than 2.8°C, and in no case cause the receiving stream temperature to exceed 32°C. 6. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. 7. Refer to Color Permitting Requirements (see Special Condition A (3.)). 8. Instream sampling shall be 1/Week during a discharge period. There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit NC0005274' A. (2.) CHRONIC TOXICITY PERMIT LIMIT The permittee shall conduct a chronic toxicity test on each batch of treated wastewater transferred from tanks AT-1, • PC-2, ET-3, and SC-4 to the 400,000 gallon storage tank, after treatment but prior to discharge. Toxicity tests shall be performed using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised- December 2010) or subsequent versions. The chronic 7-day pass/fail Ceriodaphnia dubia test shall be performed for each 400,000 gallon batch after it is mixed and aerated in the equalization basin. Each test must pass at 0.25% prior to discharge. Failing is defined as either 1) a statistically significant decrease in survival of the treatment organisms as compared to the control organisms or 2) a twenty percent or greater decrease in treatment organism reproduction which is also determined to be statistically different from control organism reproduction. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during any month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently than required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Form submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. The required reporting for toxicity testing is as follows. The toxicity results are reported on the DMR with the actual AT form being mail to the Aquatic Toxicity Unit (ATU) at 1621 MSC, Raleigh, NC 27699-1621. The address is listed on the form. The lab will send additional information with the AT form to the facility, but only the AT form needs to be sent to ATU. The DMR is reported to the Central Office. ATU does not need the monthly DMR. Each time the facility prepares a 400,000 gallon batch for discharge, a sample for toxicity will need to be pulled and tested, and the test must pass at 0.25% prior to discharge. Then, the data is reported on the DMR and an AT form mailed to ATU. Therefore, only one AT form is required for each 400,000 gallon batch that is discharged. In follow up to our conversation today at 11:00, I am writing to you to provide you with the necessary written verification that the 48 hour notice requirement has been made and the the discharge will start at 7:00 am on Monday, July 29th. In addition, it is my understanding based on the summary provided by Carol below that Julie Grzyb will make the necessary modification to Permit NC0005274 to address the change in the Ceriodaphnia Testing requirements upon her return to the office on Monday, July 29th. Lastly, it is my understanding that the Effluent Aquatic Toxicity Report Fonn will be submitted twice to the Department along with the monthly DMR. Once in the month of July and once in the month of August since the discharge will be occurring during the end of July and the beginning of August for the 400,000 gallons that are presently mixed and aerated at the site. Below is a summary. Julie ----after reading the summary below, could you advise Art and Stephen and the MRO on the next steps and when they can start discharging? They were hoping to get started as soon as possible. A chronic 7-day Ceriodaphnia dubia test was conducted on samples collected on 7/9/13 and 7/11/13 from a 400,000 equalization basin that had been aerated. The critical concentration of this test is 0.25%, meaning that the Ceriodaphnia dubia have to pass the test at 0.25%. 0.25% is the critical concentration because this has been determined to be the Instream Waste Concentration (IWC), which is calculated based on a maximum discharge rate of 200,000 gallons per day into the average 10 year low flow (7Q10) of the South Fork River. The facility may discharge less than 200,000 gallons per day, but not more. For this initial test, the Aquatic Toxicology Unit had also asked that additional concentrations be tested (0.5%, 1%, 2%, and 4%) to provide some certainty that the effluent was not close to failing at 0.25%. The results of the test were very positive. The effluent passed at all concentrations, meaning that we would not expect any chronic toxicity to occur at 0.25% instream waste concentration, or even at a higher instream waste concentration of 4%. Based on this test, it is not anticipated that discharge of the Kings Mountain Venture effluent would cause toxicity to the South Fork River at a maximum discharge rate of 200,000 gallons per day. For future toxicity tests, a chronic 7-day pass/fail Ceriodaphnia dubia test shall be performed for each 400,000 batch after it is mixed and aerated in the equalization basin. The test concentration shall be 0.25%. As we understood from Art and Stephen, this will be more than 4 tests in total since one of the 4 vats contains 1,000,000 gallons. This test shall be performed for each of the 4 vats after aeration and prior to discharge (a total of 4 tests). Each test must pass at 0.25% prior to discharge. We also recommend that the first of these 4 tests be conducted as a multi -concentration test, just to provide more confidence and knowledge about the potential for toxicity in the sample. 0.25% is the critical concentration at which you must pass. Normally, for multiple concentration tests, we require that 2 concentrations be below the IWC, with one of the concentrations being one-half the IWC. However, because your IWC is such a low percentage, testing below 0.25% seems a little extreme. In this specific situation, we recommend the concentrations to be: 0.25%, 0.5%, 1%, 2%, and 4%. Conducting the multi -concentration test will provide better knowledge regarding how close the effluent is to passing or failing the limit of 0.25%. For instance, if you pass at 0.25%, would you still pass at 0.5%? Having this knowledge will just give everyone a little more confidence that the other 3 tests will also pass at 0.25%.
