Dear Lia,
We received attached the Reguest For More Information letter dated August 14, 2007 (DWQ EXP No.
05-1882v5) and do not agree that the project should be viewed as "Allowable with Mitigation", but rather
just "Allowable".
As noted in the attached Buffer Impact -Inset 1, the proposed non-electric utility line crossing has a
20-foot wide maintenance corridor and a 5-foot wide construction corridor for a total of 30 linear feet of
riparian buffer impacted.
The highlighted portion of the Table of Uses (noted with a star) from 15A NCAC 026 .0233 Neuse River
Basin: Nutrient Sensitive Waters Management Strategy: Protection and Maintenance of Existing
Riparian Buffers states the following:
"Perpendicular non-electric utility line crossings that disturb greater than 40 linear feet of riparian buffer
with a maintenance corridor greater than 10-feet in width" is check as just "Allowable". The proposed
Highland Creek Subdivision, Phase 2 and 4 Sewer Line falls within this category, because the impacts
are less than 40 linear feet and it will have a maintenance corridor greater than 10-feet in width;
therefore, a PCN is required but not mitigation is required.
The category that is mentioned in the August 14, 2007 Reguest For More Information letter, incorrectly
qualifies the proposed project as the following:
Perpendicular non-electric utility line crossings that disturb greater than 40-linear feet of riparian buffer
but equal to or less than 150 linear feet of riparian buffer with a maintenance corridor greater than
10-feet in width is allowable with mitigation. In this scenario, the crossing would have to be between 40
and 150 linear feet, and in which case the proposed Highland Creek Subdivision, Phase 2 and 4 Sewer
Line is not (it is less than 40 feet).
At this time we are requesting the proposed project be viewed a project that is "Allowable" with no
mitigation based on "Perpendicular non-electric utility line crossings that disturb greater than 40 linear
feet of riparian buffer with a maintenance corridor greater than 10-feet in width". Please contact me at

' Provided that, in Zone 1, all of the following BMPs for overhead utility lines are used. If all of these BMPs are
not used, then the overhead utility lines shall require a no practical alternatives evaluation by the Division.

vegetation that poses a hazard or has the potential to grow tall enough to interfere with the line is removed.
• Woody vegetation shall be cleared by hand. No land grubbing or grading is allowed.
• Vegetative root systems shall be left intact to maintain the integrity of the soil. Stumps shall remain where
trees are cut.
• Rip rap shall not be used unless it is necessary to stabilize a tower.
