1) I would prefer to keep this project under a NWP 7, but ultimately it's Chris Hopper's decision. Chris originally
wanted to use NWP 39 to include the additional force main mentioned by Gannett Flemming at the pre-app,
however, that force main is at least 9 months from being designed and shouldn't be considered part of this
specific application. So I think NWP 7 is acceptable, but we'll need confirmation from Chris Hopper on which
NWP he will be issuing.
2) To date, I have not been notified of comments from USFWS or NCWRC on the Aquatic Resources report. I will
follow up with Three Oaks Engineering, who did the aquatic survey and submitted the report, to see if they've
received any comments. Chris Hopper coordinates with the USFWS as part of the 404 process, so he may have
already received USFWS' comments.

I am reviewing this project and in order to complete the review, some additional information is required:
1) From the December 16 response to the Request for Additional Information from the Corps, it appears that NWP
39 is being considered. This project was submitted under NWP 7/WQGC 4132 to DWR, and as such, has not
undergone the 30 — day Public Notice period that would be required for NWP 39/WQGC 4263. Which NWP is to
be used? If it is NWP 39, I cannot complete my review until Public Notice has been completed and would need
to know to update the application in our system and submit the project for Public Notice.
2) The cover letter states that an Aquatic Species Report was submitted to USFWS and NCWRC on 11/05/2021, the
same day the PCN was signed. Have USFWS and/or NCWRC provided comments on the report since the
submittal of the PCN?

Good Afternoon, Troy:
Based on my most recent understanding of the project, the application appears to be incomplete. However, if I'm
mistaken or things have changed, please advise and I can walk that back. However, NMFS still needs to be addressed.
Please see below.
1) Please note that though all structures would be below ground with no permanent change to floodplain
contours, a floodplain development permit may still be required by the Town of Clayton. Use of our verification
will be contingent on the project's compliance with the National Flood Insurance Program.
2) On August 26th, we conducted a pre -application meeting with the Town (Rich Copola), as well as Craig Crowther
and Lee White with Gannet Fleming. During that call, we advised that the outfall design should be shared as
soon as possible so that coordination with the NMFS can be initiated. Please provide a scaled version of the
exhibit, "Clayton WRF 30" Outfall Temporary Shoring" so I can begin that coordination. I will also need this
information to consider work within Navigable waters.
3) I also suggested during the pre -application meeting that a nationwide permit 39 would be appropriate, though
I'm flexible on that. The reasoning was so they could include details of the force main (gifted to the Town by
Novo Nordisk) feeding into the new facility (which we discussed being included in the application) via a shared
pump station with Grifols, and any temporary impacts associated with utility line access. Please explain why this
information was not included.
