However, if I'm mistaken or things have changed, please advise and I can walk that back. However, NMFS still needs to be addressed. Please see below. 1) Please note that though all structures would be below ground with no permanent change to floodplain contours, a floodplain development permit may still be required by the Town of Clayton. Use of our verification will be contingent on the project's compliance with the National Flood Insurance Program. 2) On August 26th, we conducted a pre -application meeting with the Town (Rich Copola), as well as Craig Crowther and Lee White with Gannet Fleming. During that call, we advised that the outfall design should be shared as soon as possible so that coordination with the NMFS can be initiated. Please provide a scaled version of the exhibit, "Clayton WRF 30" Outfall Temporary Shoring" so I can begin that coordination. I will also need this information to consider work within Navigable waters. 3) I also suggested during the pre -application meeting that a nationwide permit 39 would be appropriate, though I'm flexible on that. The reasoning was so they could include details of the force main (gifted to the Town by Novo Nordisk) feeding into the new facility (which we discussed being included in the application) via a shared pump station with Grifols, and any temporary impacts associated with utility line access. The construction of the outfall is tentatively scheduled to begin on 5/2/2022 and be completed by 7/29/2022 as noted on the attached Page 39 of the WRF project schedule. The force main you reference as discussed by Gannett Fleming in the 8/26/2021 pre -application meeting is the "East Clayton Industrial Area" (ECIA) force main. The ECIA is intended to serve the industrial area of Clayton which includes Grifols and Novo Nordisk and will eventually connect to the future gravity sewer line conveying flow to the Neuse WRF which was permitted under the NWP 58 for the Little Creek Transmission Improvements project (SAW-2020-00777) issued 3/24/2021. The ECIA force main is still in the planning stages. Currently the final alignment of the easements to be acquired has not been finalized. The environmental delineations and survey work needed for the engineering design has not and cannot be conducted until the final alignment and easements have been determined. Therefore, the engineering design of the ECIA force main sufficient to determine impacts to wetlands, streams and riparian buffers for construction will likely not be completed until late 2022. The stream and wetland impacts for the construction of the ECIA force main will be permitted once the alignment and design have been completed. Therefore, the ECIA force main should not be included as part of this application due to the uncertainty of when the ECIA design will be completed. In regard to the use of an NWP 39 or NWP 7, the applicant defers to the USACE's preference.
