The Division of Water Resources (the Division) hereby issues the attached NPDES permit for the
subject facility. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
We have made the following updates to the draft permit mailed,to you:
> Monitoring requirements for total hardness have been added as the facility is also
monitoring hardness -dependent metals.
We have also made the following updates to your previous permit with no subsequent changes from
the draft permit mailed to you:
> The limit for flow has been removed.
> A monthly average and daily maximum turbidity limit of 50 NTU has been set, along with
weekly turbidity monitoring, as the receiving stream is impaired for turbidity.
➢ The monitoring requirements for calcium, iron, magnesium, and manganese have been
removed as water quality standards do not exist for these permits.
➢ The monitoring requirement for ammonia nitrogen has been removed as the facility does not
use chloramines.
> The monitoring frequencies for copper, zinc, and fluoride have been reduced from twice a
week to quarterly to align with quarterly toxicity monitoring.
> Section A. (3) has been added to require electronic submission of effluent data. Federal
regulations require electronic submittal of all discharge monitoring reports (DMRs), effective
December 21, 2016.

➢ An updated outfall map has been included.
The NC 2007-2014 Water Quality Standard (WQS) Triennial Review was approved by the NC
Environmental Management Committee (EMC) on November 13, 2014. The US EPA subsequently
approved the WQS revisions on April 6, 2016 with some exceptions. The NC Division of Water
Resources NPDES Permitting Unit is required to implement the new dissolved metal standards in
all permits public noticed after April 6, 2016.
The new standards for most metals include acute standards. Further, the freshwater standards for
several metals are expressed as the dissolved form of the metals, and seven metals have hardness -
dependent equations. As a result, the NPDES Permitting Unit will need site -specific effluent
hardness data and instream hardness data, upstream of the discharge, for each facility monitoring

these metals in order to calculate permit limitations. Effluent hardness sampling has been added to
this permit at a monitoring frequency of quarterly. Upstream hardness sampling has been waived
due to the zero flow conditions of the receiving stream. See Section A (2.) Effluent Limitations and
Monitoring Requirements.
Please note that Muddy Creek is listed as an impaired waterbody on the North Carolina 303(d)
Impaired Waters List. Addressing impaired waters is a high priority with the Division, and instream
data will continue to be evaluated. If there is noncompliance with permitted effluent limits and
stream impairment can be attributed to your facility, then mitigative measures may be required
No later than December 21, 2016, federal regulations require electronic submittal of all discharge
monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such
submittals, then permittees must submit DMRs electronically to the Environmental Protection
Agency (EPA). The final NPDES Electronic Reporting Rule was adopted and became effective on
December 21, 2015.
The requirement to begin reporting discharge monitoring data electronically using the NC DWR's
Electronic Discharge Monitoring Report (eDMR) internet application has been added to your final
NPDES permit. [See A. (3)] For information on eDMR, registering for eDMR and obtaining an

If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within
thirty (30) days after receiving this letter. Your request must take the form of a written petition
conforming to Chapter 150B of North Carolina General Statutes, and you must file it with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless
such a demand is made, this permit shall remain final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Resources or
any other Federal, State, or Local governmental permits that may be required.

requirements, and other conditions set forth in Parts I, II, III and IV hereof.
This permit shall become effective April 1, 2017.
This permit and authorization to discharge shall expire at midnight on June 30, 2019.

All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked, and as of this issuance, any previously issued permit bearing this number is
no longer effective. Therefore, the exclusive authority to operate and discharge from this
facility arises under the permit conditions, requirements, terms, and provisions included
herein.

a design potable flowrate of 48.0 MGD
This facility is located at the Neilson Water Treatment Plant at 2725 Frye Bridge
Road near Winston-Salem in Forsyth County.
2. Discharge from said treatment works via Outfall 001, at the location specified on
the attached map into an unnamed tributary to Muddy Creek [ 12-94-(0.5)]
currently classified C waters in subbasin 03-07-04 [HUC: 0304010113] of the
Yadkin Pee -Dee River Basin.

1. No later than December 21, 2016, the permittee shall begin submitting discharge monitoring
reports electronically using the NC DWR's eDMR application system [see A. (3)].
2. The Division shall consider all effluent TRC values reported below 50 µg/ 1 to be in compliance with
the permit. However, the Permittee shall continue to record and submit all values reported by a
North Carolina certified laboratory (including field certified), even if these values fall below 50 µg/ 1.
3. Parameters should be monitored in conjunction with toxicity test.
4. Ceriodaphnia dubia 7-day pass/fail test @ 90%. See Condition A. (2.) for toxicity testing
requirements. Toxicity testing should be performed during the months of January, April, July and
October, and sampling should coincide with sampling for parameters covered by footnote 2.
ALL SAMPLES COLLECTED SHOULD BE FROM A. REPRESENTATIVE DISCHARGE EVENT.
THERE SHALL BE NO DISCHARGE OF FLOATING SOLIDS OR VISIBLE FOAM IN OTHER THAN
TRACE AMOUNTS.

A. (2) CHRONIC TOXICITY MONITORING (QUARTERLY)
[15A NCAC 02B.0500 et seq.]
The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in
the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February
1998, or subsequent versions.
The effluent concentration defined as treatment two in the procedure document is 90%. The
testing shall be performed as a Ceriodaphnia dubia 7day pass/fail test. The tests will be
performed during the months of January, April, July and October. Effluent sampling for this
testing shall be performed at the NPDES Permitted final effluent discharge below all treatment
processes.
All toxicity testing results required as part of this permit condition will be entered on the
Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using
the parameter code TGP3B. Additionally, DWQ Form AT-1 (original) is to be sent to the following
address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences
Section no later than 30 days after the end of the reporting period for which the report
is made.
Test data shall be complete and accurate and include all supporting chemical/physical
measurements performed in association with the toxicity tests, as well as all dose/response
data. Total residual chlorine of the effluent toxicity sample must be measured and reported if
chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity
monitoring is required, the permittee will complete the information located at the top of the
aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number,
county, and the month/year of the report with the notation of "No Flow" in the comment area
of the form. The report shall be submitted to the Environmental Sciences Section at the address
cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required,
then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly
test requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North
Carolina Division of Water Quality indicate potential impacts to the receiving stream, this
permit may be re -opened and modified to include alternate monitoring requirements or limits.

If the Permittee monitors any pollutant more frequently than required by this permit, the
results of such monitoring shall be included in the calculation 86 reporting of the data
submitted on the DMR 86 all AT Forms submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as
minimum control organism survival, minimum control organism reproduction, and
appropriate environmental controls, shall constitute an invalid test and will require
immediate follow-up testing to be completed no later than the last day of the month following
the month of the initial monitoring.

A. (3) ELECTRONIC REPORTING OF MONITORING REPORTS
[NCGS 143-215.1 (b)]
Federal regulations require electronic submittal of all discharge monitoring reports
(DMRs) and program reports and specify that, if a state does not establish a system to
receive such submittals, then permittees must submit monitoring data and reports
electronically to the Environmental Protection Agency (EPA). The final NPDES Electronic
Reporting Rule was adopted and became effective on December 21, 2015.
NOTE: This special condition supplements or supersedes the following sections within
Part II of this permit (Standard Conditions for NPDES Permits):
• Section B. (11.) Signatory Requirements
• Section D. (2.) Reporting
• Section D. (6.) Records Retention
• Section E. (5.) Monitoring Reports
1. Reporting Requirements [Supersedes Section D. (2.) and Section E. (5.) (a)1
Effective December 21, 2016, the permittee shall report discharge monitoring data
electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR)
internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each
month and submitted electronically using eDMR. The eDMR system allows permitted
facilities to enter monitoring data and submit DMRs electronically using the internet.
Until such time that the state's eDMR application is compliant with EPA's Cross -Media
Electronic Reporting Regulation (CROMERR), permittees will be required to submit all
discharge monitoring data to the state electronically using eDMR and will be required to
complete the eDMR submission by printing, signing, and submitting one signed original
and a copy of the computer printed eDMR to the following address:

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due
to the facility being physically located in an area where less than 10 percent of the
households have broadband access, then a temporary waiver from the NPDES electronic
reporting requirements may be granted and discharge monitoring data may be submitted
on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms approved by the Director.
Duplicate signed copies shall be submitted to the mailing address above. See "How to
Request a Waiver from Electronic Reporting" section below.
Regardless of the submission method, the first DMR is due on the last day of the month
following the issuance of the permit or in the case of a new facility, on the last day of the
month following the commencement of discharge.

Starting on December 21, 2020, the permittee must electronically report the following
compliance monitoring data and reports, when applicable:
• Sewer Overflow/Bypass Event Reports;
• Pretreatment Program Annual Reports; and
• Clean Water Act (CWA) Section 316(b) Annual Reports.
The permittee may seek an electronic reporting waiver from the Division (see "How to
Request a Waiver from Electronic Reporting" section below).
2. Electronic Submissions
In accordance with 40 CFR 122.41(1) (9), the permittee must identify the initial recipient
at the time of each electronic submission. The permittee should use the EPA's website
resources to identify the initial recipient for the electronic submission.
Initial recipient of electronic NPDES information from NPDES-regulated facilities means
the entity (EPA or the state authorized by EPA to implement the NPDES program) that is
the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)].
EPA plans to establish a website that will also link to the appropriate electronic reporting
tool for each type of electronic submission and for each state. Instructions on how to
access and use the appropriate electronic reporting tool will be available as well.

Electronic submissions must start by the dates listed in the "Reporting Requirements"
section above.
3. How to Request a Waiver from Electronic Reporting
The permittee may seek a temporary electronic reporting waiver from the Division. To
obtain an electronic reporting waiver, a permittee must first submit an electronic
reporting waiver request to the Division. Requests for temporary electronic reporting
waivers must be submitted in writing to the Division for written approval at least sixty
(60) days prior to the date the facility would be required under this permit to begin
submitting monitoring data and reports. The duration of a temporary waiver shall not
exceed 5 years and shall thereupon expire. At such time, monitoring data and reports
shall be submitted electronically to the Division unless the permittee re -applies for and is
granted a new temporary electronic reporting waiver by the Division. Approved electronic
reporting waivers are not transferrable. Only permittees with an approved reporting
waiver request may submit monitoring data and reports on paper to the Division for the
period that the approved reporting waiver request is effective.

All eDMRs submitted to the permit issuing authority shall be signed by a person
described in Part II, Section B. (11.)(a) or by a duly authorized representative of that
person as described in Part II, Section B. (11.)(b). A person, and not a position, must be
delegated signatory authority for eDMR reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an
eDMR user account and login credentials to access the eDMR system. For more
information on North Carolina's eDMR system, registering for eDMR and obtaining an
eDMR user account, please visit the following web page:

Certification. Any person submitting an electronic DMR using the state's eDMR system
shall make the following certification [40 CFR 122.22]. NO OTHER STATEMENTS OF
CERTIFICATION WILL BE ACCEPTED:
"I certify, under penalty of law, that this document and all attachments were prepared
under my direction or supervision in accordance with a system designed to assure that
qualified personnel properly gather and evaluate the information submitted. Based on my
inquiry of the person or persons who manage the system, or those persons directly
responsible for gathering the information, the information submitted is, to the best of my
knowledge and belief, true, accurate, and complete. I am aware that there are significant
penalties for submitting false information, including the possibility of fines and
imprisonment for knowing violations."
5. Records Retention 'Supplements Section D. (6.)1
The permittee shall retain records of all Discharge Monitoring Reports, including eDMR
submissions. These records or copies shall be maintained for a period of at least 3 years
from the date of the report. This period may be extended by request of the Director at
any time [40 CFR 122.41].

Facility Summary
This facility is a conventional water treatment plant with discharge of filter backwash and sludge
wastewaters with a design potable flowrate of 48.0 MGD and currently no discharge for the last permit
cycle. Because the waste flow is intermittent, instantaneous flow monitoring is permitted.

Toxicity —This permit requires Chronic Whole Effluent Toxicity (WET) testing using Ceriodaphnia dubia
to be performed as 7-day pass/fail test at 90% effluent concentration, during January, April, July, and
October[TGE3E]. Testing requirements for the past 4 %Z years have been waived as the facility has not
discharged.
Renewal Summary —
• A turbidity limit of 50 NTU was added as the receiving stream is impaired and a corresponding
turbidity monitioring frequency of weekly was added
• Iron, calcium, magnesium, and manganese monitoring requirements were removed as there are no
water quality standards for these parameters
• Removed monitoring requirements for ammonia nitrogen as the facility does not currently use
chloramines
• Upstream and effluent monitoring requirements for hardness data were added as there is hardness
dependent metals sampling for copper and zinc

The General Permit NCG590000 was signed and became effective on August 1, 2014!
NC0086762 Swann WTP — Mailed on July 2013. I don't anticipate any issues with this one qualifying for the General
Permit. It has never failed a WET test.
Joe Corporon is doing this permit renewal so you will have to contact him and ask if it can be issued as a General Permit
or not.
I have been assigned to do the permit renewals for the two below.
NC0086011 Neilson WTP — Mailed November 2013. We currently do not discharge from this permit but have
improvements planned and will start in the next 2-3 years.
A conventional WTP must demonstrate no potential for aquatic toxicity so unless they have performed three years of
toxicity testing it will have to remain under an individual permit.
NC0079821 Thomas WTP — Mailed November 2013. If you'll recall we discussed this one because it has had some issues
passing WET. This is the one that I suspected the polymer was the culprit. We have been able to discontinue the use of
the polymer without consequence on our effluent and since doing so we have passed all our WET tests, so there is hope
that this plant is moving in the right direction.
This facility has failed too many times; it will be maintained as an individual permit. Hopefully, the discontinued use of
the polymer will make a difference and it can be issued as a General Permit with the renewal after this one.

Solids Handling Plan
The Neilson Water Treatment Plant is a 48 MGD water treatment facility. Solids are
generated by manual sludge removal from sedimentation basins, backwashing filters, and
filter -to -waste after filter backwashes are completed. Solids produced from filter backwashes
and filter -to -waste is routed to a waste pump station and is then pumped to the head of the
water treatment process. Solids removed from the sedimentation basins are routed directly to
one of three residual lagoons.
Permits and Classifications:
1. The discharge from the residuals lagoons is authorized by NPDES Permit NC0086011.
The classification for the discharge is Grade 1 Physical/Chemical.
Operation:
1. The system consists of a waste station with (3) Fairbanks Morse single stage pumps rated
at 6.48 MGD each, (2) Fairbanks Morse basin sludge pumps rated at 1.0 MGD each, (2)
lagoon pumps rated at 0.65 MGD each and (3) residuals lagoons (3 lagoons at -2.0 MG).
Each residuals lagoon consists of an oval earthen lagoon with clay bottom.
2. Routine inspections of equipment will be conducted by Rodney Darr, Sr. Utility Plant
Supervisor, to ensure proper operation of equipment. Any equipment not functioning
properly will be reported through the water division's asset management program,
MAXIMO, to the appropriate support group for repair/replacement.
3. Backwash and filter -to -waste water from the plant process flows to the waste station and
then is pumped by the waste station pumps to raw water reservoir #2 at the head of the
plant treatment process.
4. All sedimentation basin and hopper blow downs are pumped by the basin sludge pumps
directly to one of three residuals lagoons.
5. The solids stream enters on one end of each lagoon and the decant is pumped from the
opposite end by the lagoon pumps to the waste station where it is returned to the head of
the treatment process.
6. Residuals lagoons are rotated with one cleaned and ready for use, one in service and one
drying at all times.
7. Residuals are removed from the lagoons and hauled to an application site which consists
of -31 acres on Cooper Road (about 1.0 mile from the Neilson WTP) by a private
contractor.

8. Once the sludge has dried, it is spread on the application site and a grass cover is planted
to stabilize the area.
Monitoring and Reporting Requirements:
1. Residuals generated by each source -generating facility must be analyzed to demonstrate
that they are non -hazardous. Sampling will be conducted by Rodney Darr, Sr. Water
Treatment Plant Supervisor, once per hauling event as described below.
2. An analysis is required for each residuals land application event.
3. Analyses made according to monitoring and reporting requirements must be certified for
the required parameter(s).
4. Corrosivity, ignitability, reactivity, and a Toxicity Characteristics Procedure analysis are
required with each residuals application event. The TCLP analysis includes the following

6. Data to verify pathogen reduction and vector attraction reduction of the residuals is
maintained on file for five years. The required data is specific to the stabilization process
utilized, and is also sufficient to demonstrate clear compliance with the Class A pathogen
requirements and restrictions noted in 15A NCAC 02T .1106 (a) and (b) and vector
attraction reduction requirements in 15A NCAC 02T .1107 (a).

7. Proper records are maintained tracking all residuals activities. These records include the
source, volume, analysis, and recipient of the residuals.
8. Three copies, per application event, of all required monitoring and reporting requirements
are submitted annually before March 1, to NC DENR-DWQ.
Performance Standards:
1. The pollutant concentrations in any residuals that are land applied to any land application

2. If residuals are sold or given away, one of the Class A pathogen requirements in 15A
NCAC 02T .1106(b) must be met. Aerobic digestion is used to satisfy this requirement.
Application Requirements:
1. Bulk residuals are not applied under the following conditions:
i. If the residuals are likely to adversely affect a threatened or endangered species.
ii. If the application causes prolonged nuisance conditions.
iii. If the land fails to assimilate the bulk residuals or the application causes the
contravention of surface water or groundwater standards.
iv. If the land is flooded, frozen, or snow-covered or is otherwise in a condition such that
runoff of the residuals would occur.
v. During a precipitation event or within 24 hours following a rainfall event of 0.5
inches or greater in a 24-hour period.
vi. Within the 100-year flood elevation, unless the bulk residuals are injected or
incorporated within a 24-hour period following the residuals application event.
vii. During a precipitation event or within 24 hours following a rainfall event of 0.5
inches or greater in a 24-hour period.

viii. If the slope of the land is greater than 10 percent when the bulk residuals are surface
applied, and if the slope of the land is greater than 18 percent when bulk residuals are
injected or incorporated.

x. If the land does not have an established vegetative cover.
xi. If the vertical separation of the seasonal high water table and the depth of the
residuals application is less than one foot.

Spills and Noncompliance Notification:
1. The Winston-Salem Regional Office, telephone number (336) 771-5000, will be notified
within 24 hours or the next working day following the occurrence or first knowledge of
the occurrence of any of the following:
i. Any occurrence with the distribution program which results in the land application of
significant amounts of wastes which are abnormal in quantity or characteristic.
ii. Any failure of the distribution program resulting in a release of materials to receiving
waters.
iii. Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate residual treatment.
2. Persons reporting such occurrences by telephone shall also file a written report in letter
form within (5) days following first knowledge of the occurrence. This report must
outline the actions taken or proposed to be taken to ensure that the problem does not recur.
