The Project Engineer was CH2M Hill. The contractor was: Pizzagalli Construction Company and the original construction contract was for $10,255,000. The assistance of Jim Nagle, P.E. and others with CH2M Hill, John Tarreto and others with Pizzagali Construction Company, and Mr. Mike Lamberth, Cliff Webb, and Mr. John Vest with the Town of Mooresville is greatly appreciated. Congratulations, construction was completed ahead of the original scheduled completion date of 10/1/2011. Construction began on 5/4/2010. The FINAL progress meeting was held on 5/11/2011. The FINAL site visit and construction inspection was on 5/11/2011. The FINAL Change Order was dated 5/23/2011. The Engineer's Certification was dated 6/1/2011. Construction was 100% complete on 7/15/2011, Project was completed 78 Days Ahead of the Scheduled completion date of 10/1/2011. They were just touching upon previous discussions to have ultimate discharge to Lake Norman, and whether DWQ would entertain. Sounds like they want to retain the 7.5 MGD discharge to Dye Creek, and put new outfall (10 MGD or less) to Lake Norman. Still reviewing reuse potential. IBT issues might drive process. They said Catawba Riverkeeper was on board with proposed discharge. We don't see any huge red flags at this time, and said we would get back with them next week. Any MRO concerns? " If an has not been applied for in accordance with the requirements of the NPDES permit during the term of the permit, the permit will be considered void upon expiration and future actions will be considered as a new application." • This section requires that an ATC permit be applied for (does not mention "obtained") within the NPDES permit term, otherwise the NPDES permit will be considered void upon expiration. Based on this, I think you would need to go through SEPA, then apply for NPDES permit upon FONSI determination, then submit ATC application within permit term. If NPDES permit is issued but there is no subsequent ATC application, it could open legal challenge to NPDES permit at next permit renewal. This would be unusual, but it's possible. Generally we are operating on the flip side- where the permittee needs to start construction ASAP, and is doing whatever they can to expedite SEPA/NPDES permitting/ATC issuance. • I'm also attaching recent comments received from Catawba Riverkeeper concerning the proposed permit renewal for Hwy 150 WWTP, which discharges to Lake Norman. I can envision similar comments to a proposed Town of Mooresville discharge to Lake Norman. If you have further questions, feel free to call or email. I've read the State Statute 15A NCAC 2H.01398, and understand it to state that, if we were to obtain an NPDES permit for a new discharge to Lake Norman, we would have to have received (not just applied for) an Authorization to Construct prior to expiration of the NPDES permit. As I understand our conversation, you had stated that an NPDES permit is valid for 5 years. 1
