Dear Mr. Nisely:
I am writing in response to the June 24, 1996 letter requesting review of the statistical
assessment for the metal requirements in your permit. As noted in the letter dated June 3,
1996, this method is outlined in the Technical Support Document for Water Quality -based
Toxics Control (EPA/505/2-90-001 PB91-127414). I have attached the pertinent pages
from the Division's DRAFT Standard Operating Procedures for toxics along with a copy of
our toxics analysis.
As outlined in the North Carolina Administrative Code T15A: 02B .0211 (4) Action Levels
for Toxics Substances, a monitoring requirement is implemented when the level of the
substance exceeds the allowable waste load allocation. As these substances are generally
not bioaccumulative and have variable toxicity, they are usually not limited unless it is
found that they have a significant causative factor resulting in toxicity of the effluent.

I am writing in response to the May 3, 1996 letter requesting review of the metals and
chloride data submitted. It is part of the Division of Environmental Management's
procedure to accept and review monitoring data that has at least eight samples and is
representative of the facility's effluent for at least a year. Once these data are submitted, a
reasonable potential analysis is performed to determine whether a parameter will receive a
limit or monitoring requirement. This analysis has been performed on the data submitted
and the following recommendations are offered for modifying your NPDES Permit

The need for a limit for each of the parameters was determined by following EPA's
reasonable potential analysis as outlined in the Technical Support Document for Water
Quality -based Toxics Control (EPA/505/2-90-001 PB91-127414). This analysis indicated
that the predicted maximum concentration exceeded the allowable for both mercury and
copper. Thus, if this evaluation was being made at permit renewal a limit of 0.4 µg/l
would have been recommended for mercury. Since copper is an action level, we typically
would not assign a limit for it unless we had evidence that it was causing toxicity. Due to
the high predicted values, more frequent monitoring should remain in the permit.
The reasonable potential analysis on the other parameters resulted in predicted values less
than the allowable. It is DEM's standard operating procedure to require quarterly
monitoring for all parameters having predicted values within 1/10 of the allowable
concentration. Following this procedure, monitoring requirements for chromium and lead
were dropped, and monitoring for each of the other parameters remained as in the current
permit.
If these changes are acceptable, we will proceed to modify your NPDES permit
accordingly. Please try to respond to us regarding the suitability of these changes by July
1, 1996. If there are any additional questions concerning this matter, please feel free to

Champion's Roanoke Rapids Mill requests a review by DEM Vfefituent test results
to see if the level of monitoring for metals and chloride can be reduced. We propose
an armual sampling.
NPDES Permit #NC0000752 states that after a period of two years of monitoring for
metals and chloride, the DEM is willing to review test results to determine if the
removal of, or reduction in, monitoring is justified. Monitoring began 4/94 and nine
quarterly rounds have been completed, so we respectfully ask for this review. A table
of data is attached for your convenience.
