This letter transmits a Notice of Violation and assessment of civil penalty in the amount of $2,036.57 ($2,000.00 civil penalty
+ $36.57 enforcement costs) against Aqua North Carolina Inc.
This assessment is based upon the following facts: a review has been conducted of the Sanitary Sewer Overflow (SSO)
5-Day Report submitted by Aqua North Carolina Inc. This review has shown the subject facility to be in violation of the
requirements found in Collection System Permit No. WQCS00147 and G.S. 143-215.1(a)(1). The violation(s) that occurred
are summarized in Attachment A to this letter.
Based upon the above facts, I conclude as a matter of law that Aqua North Carolina Inc. violated the terms, conditions or
requirements of Collection System Permit No. WQCS00147 and G.S. 143-215.1(a)(1) in the manner and extent shown in
Attachment A. In accordance with the maximums established by G.S. 143-215.6A(a)(2), a civil penalty may be assessed
against any person who violates the terms, conditions or requirements of a permit required by G.S. 143-215.1(a).

Based upon the above findings of fact and conclusions of law, and in accordance with authority provided by the
Secretary of the Department of Environmental Quality and the Director of the Division of Water Resources, I, Scott
Vinson, Regional Supervisor, Raleigh Regional Office hereby make the following civil penalty assessment against Aqua
North Carolina Inc.:
$2,000.00 For 1 of the 1 violations of Collection System Permit No. WQCS00147 and G.S. 143-215.1(a)(1) for
Sanitary Sewer Overflow(s) resulting in a discharge without a valid permit.
$2,000.00 TOTAL CIVIL PENALTY
$36.57 Enforcement Costs

Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken into account the Findings of Fact and
Conclusions of Law and the factors set forth at G.S. 143B-282.1(b), which are:
(1) The degree and extent of harm to the natural resources of the State, to the public health, or to private property
resulting from the violation;
(2) The duration and gravity of the violation;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;
(5) The amount of money saved by noncompliance;
(6) Whether the violation was committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs over which the Environmental
Management Commission has regulatory authority; and
(8) The cost to the State of the enforcement procedures.
Within thirty (30) days of receipt of this notice, you must do one of the following:

Option 2: Submit a written request for remission or mitigation including a detailed justification for such
request:
Please be aware that a request for remission is limited to consideration of the five factors listed below as they may
relate to the reasonableness of the amount of the civil penalty assessed. Requesting remission is not the proper
procedure for contesting whether the violation(s) occurred or the accuracy of any of the factual statements contained in
the civil penalty assessment document. Because a remission request forecloses the option of an administrative hearing,
such a request must be accompanied by a waiver of your right to an administrative hearing and a stipulation and
agreement that no factual or legal issues are in dispute. Please prepare a detailed statement that establishes why you
believe the civil penalty should be remitted, and submit it to the Division of Water Resources at the address listed below.
In determining whether a remission request will be approved, the following factors shall be considered:
(1) whether one or more of the civil penalty assessment factors in NCGS 143B-282.1(b) was wrongfully
applied to the detriment of the petitioner;
(2) whether the violator promptly abated continuing environmental damage resulting from the violation;
(3) whether the violation was inadvertent or a result of an accident;
(4) whether the violator had been assessed civil penalties for any previous violations; or
(5) whether payment of the civil penalty will prevent payment for the remaining necessary remedial actions.
Please note that all evidence presented in support of your request for remission must be submitted in writing. The
Director of the Division of Water Resources will review your evidence and inform you of his decision in the matter of
your remission request. The response will provide details regarding the case status, directions for payment, and
provision for further appeal of the penalty to the Environmental Management Commission's Committee on Civil Penalty
Remissions (Committee). Please be advised that the Committee cannot consider information that was not part of the
original remission request considered by the Director. Therefore, it is very important that you prepare a complete and
thorough statement in support of your request for remission.
In order to request remission, you must complete and submit the enclosed "Request for Remission of Civil Penalties.
Waiver of Right to an Administrative Hearing, and Stipulation of Facts" form within thirty (30) days of receipt of this
notice. The Division of Water Resources also requests that you complete and submit the enclosed "Justification for
Remission Request."

If you wish to contest any statement in the attached assessment document, you must file a petition for an administrative
hearing. You may obtain the petition form from the Office of Administrative Hearings. You must file the petition with
the Office of Administrative Hearings within thirty (30) days of receipt of this notice. A petition is considered filed
when it is received in the Office of Administrative Hearings during normal office hours. The Office of Administrative
Hearings accepts filings Monday through Friday between the hours of 8:00 a.m. and 5:00 p.m., except for official state
holidays. The petition may be filed by facsimile (fax) or electronic mail by an attached file (with restrictions) - provided
the signed original, one (1) copy and a filing fee (if a filing fee is required by NCGS §150B-23.2) is received in the
Office of Administrative Hearings within seven (7) business days following the faxed or electronic transmission. You

A faulty automatic transfer switch at the Neuse River Parkway pump station caused 100,000 gallons to surcharge from a
manhole upstream of the pump station and into the Neuse River, a class WS-V; NSW in the Neuse River Basin. Increased
nutrients and pathogens to surface waters 11 water quality standard violations.

Aqua North Carolina, Inc. (Aqua) offers the following response to the above -referenced Noticc of Violation
and Intent to Issue Civil Penalty, which was issued for power outage, pump station equipment failure on
September 29, 2021 for Sanitary Sewer Overflows 5-Day Report.
Aqua's Response:
Aqua appreciates the opportunity to provide additional information on this event. Our
investigation into this Sanitary Sewer Overflow found that the generator automatic transfer
switch (ATS), and one of two digital inputs on the Omni Beacon alarm monitor had failed
ultimately contributing to the SSO occurrence. Our records prove that the generator was
inspected and serviced by our third -party vendor just last May. Records show that the Aqua
technician was performing his required visits to this site as well as performing the tasks
associated with these visits. Records also show that the telemetry was in working order when
the technician last tested it during his required visit. The only anomaly related to this situation
are the power "blips" that Duke power was experiencing in the area of this lift station at the
time of this overflow event. Therefore, Aqua is unable to identify and correct an internal root
cause for this overflow event. Aqua believes that the power" blips" confirmed and experienced
by Duke power, caused the full transfer of power to fail when the Lift Station called for it and
ultimately caused this unfortunate sewer overflow. As an additional mitigation factor, please
note that the wastewater treatment plant operator noticed a reduction in the daily flow at the
wastewater treatment plant that morning and notified the collection system team to start the
investigation. They immediately began the investigation and stopped the SSO almost
immediately. This prompt and diligent action by Andy Stevens, the ORC at the Neuse Colony
Wastewater Treatment Plant, reduced the time during which the SSO could have occurred, and
is exemplary of a good operator fully performing his duties. Based upon our investigation, no
operator made any error, and all appropriate operation and maintenance of the system were
completed.

This Notice of Violation / Notice of intent to Enforce (NOV/NOI) Is being issued for the noted violation. Pursuant
to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed
against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any
permit issued pursuant to G.S. 143-215.1.
This office requests that you respond to this Notice, in writing, within 10 business days of its
receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other
actions taken to prevent the recurrence of similar situations. The response to this correspondence will be
considered In this process. Enforcement decisions will also be based on volume spilled, volume reaching surface
waters, duration and gravity, impacts to public health, fish kills or recreational area closures. Other factors
considered In determining the amount of the civil penalty are the violator's history of non-compliance, the cost of
rectifying the damage, whether the spill was intentional and whether money was saved by non-compliance.

Per G.S. 143-215.1C(b), the responsible party of a discharge of 1,000 or more of untreated wastewater to surface waters
shall issue a press release within 24-hours of first knowledge to all print and electronic news media providing general
coverage in the county where the discharge occurred. When 15,000 gallons or more of untreated wastewater enters surface
waters, a public notice shall be published within 10 days and proof of publication shall be provided to the Division within 30
days. Refer to the reference statute for further detail.
The Director, Division of Water Resources. may take enforcement action for SSOs that are required to be reported to
Division unless it is demonstrated that:
1) the discharge was cause by sever natural conditions and there were no feasible alternative to the discharge; or
2) the discharge was exceptional, unintentional, temporary and caused by factors beyond the reasonable control of the
Permittee and/or owner, and the discharge could not have been prevented by the exercise of reasonable control.
Part II must be completed to provide a justification claim for either of the above situations. This information will be the basis

Upon inspection of the Lift Station, the pumps were in the on position but the lift station was not operating . An Aqua
Utility Technician put the generator transfer switch in the off position and then back into the on position. At this time
Aqua started receiving alarms, both high level and power failure. and it was verified that we had power to the pumps and
floats again. The generator was also displaying a high temperature alarm, making the generator inoperable. The
investigation found that the generator, the automatic transfer switch (ATS), and one of two digital inputs on the OmniBeac
alarm monitor had failed. During the routine lift station inspection on 9/29/2021, the Operator dropped station power and
observed the Generator start and transfer to Emergency power. At some point during this test, the generator had shut do
due to various faults and the ATS failed to transfer back to Normal power. The OmniBeacon has two digital inputs for Higi
Level; one powered which was working and one dry -contact which was not working. While the powered input was functioi
without power. it could not indicate the high level condition.

Comments:
The Aqua Utility Technician completed his daily Lift Station PM checks by pulling the high level float and making sure he
aot both an audible and visible alarm (alarm buzz and flashing light at panel). and telemetry message. He records all Lift
Station readings for the impulse meter and time clock for both lift station pumps and the generator in the lift station lop
book. The readings were in line with previous checks. The technician turned off main power at transfer switch by putting t!
transfer switch into the off position for approximately 15 seconds until the generator engaged (audible click followed bi
the generator starting up). Then, he turned the transfer switch back into the on position and locked it in place with a
padlock. The generator came on and ran as normal. The technician verified that the generator completed its cycle and
shut off. The technician stated that he received the normal call out alerts while performing his checks (high level, power
failure). He acknowledged those and received no further alarms from the lift station.

Our generator service contractor was onsite on 9/30/2021 and found that the generator unit shutdown in red stop alarm fc
high engine temperature immediately after it ramped up to 1800 rpm. This alarm was caused by a faulty HET shutdown
switch. The tech performed trouble shooting of all components in the de -energized ATS to verify the sequence of operatio
is correct. Found that no components were damaged, ATS is working as designed at this time. Fail condition not
duplicated.

How was the SSO remediated (i.e. Stopped and cleaned up)?
Aqua staff started the remediation and a 3rd party environmental contractor (Chase Environmental) completed the
remediation. Chase Environmental also came back the following day for further evaluation of the area to insure no further
impacts to the environment. Aqua is currently awaiting the final report from Chase Environmental and will send a copy to
your attention once received.

In accordance with your application received April 24, 2018, we are forwarding herewith Permit No.
WQCS00147, dated May 10, 2018, to Aqua North Carolina, Inc. for the operation and maintenance of the
subject wastewater collection system.
This permit shall be effective from May 10, 2018 until April 30, 2026 and shall be subject to the conditions and
limitations specified herein. It is your responsibility to thoroughly review this permit. Please pay particular
attention to the monitoring and reporting requirements in this permit and any special conditions.
Changes have been made to the boiler plate language of the permit. Most of the changes are for clarification
purposes, however Condition 1(3) has been removed. The Department of Environmental Quality (DEQ)
believes that condition was included erroneously in previous permits. It was included based on proposed
rulemaking by EPA which was never promulgated and, in the continued absence of Federal regulations, DEQ
lacks authority to include such language in a permit. DEQ will continue to exercise enforcement discretion
when evaluating sanitary sewer overflows that may be considered to be beyond the reasonable control of the

For purposes of permitting, the collection system is considered to be any existing or newly installed system
extension up to the wastewater treatment facility property or point of connection with a separately owned
sewer system. The collection system is considered all gravity lines, pump stations, force mains, low pressure
sewer systems, STEP systems, vacuum systems, etc. and associated piping, valves and appurtenances that
help to collect, manage and transport wastewater to a wastewater treatment plant under the Permittee's
ownership or maintained and operated by the Permittee through a perpetual legal agreement. Satellite
systems are systems tributaryto the Permittee's collection system but those collection systems are not owned
or maintained by the Permittee. The system description provided on Page 1 of this permit Is meant to provide
a general idea about the size of the system and may not be all inclusive of the collection system at the time of
permit issuance or afterward.

A discharge of wastewater to the environment from the Permittee's wastewater collection system prior to
reaching the wastewater treatment facilities is referred to herein as a Sanitary Sewer Overflow (SSO). The
evaluation of enforcement options after an SSO will be determined considering all relevant information
available or requested of the Permittee. Compliance with all conditions of the permit as well as all statutes
and regulations pertaining to the wastewater collection system must be maintained or appropriate
enforcement actions may be taken as noted in Condition VI(2).
A reportable SSO is an SSO greater than 1,000 gallons to the ground or an SSO of any amount that reaches
surface water (including through ditches, storm drains, etc.). Reporting requirements including the required
verbal report and written report to the appropriate regional office are referenced in Condition IV(2). Form

A notice of deficiency (NOD), notice of violation (NOV), civil penalty, and/or a moratorium on the addition of
waste to the system may be issued if adequate justification for an SSO is NOT submitted to the regional office.
In order to submit a claim for justification of an SSO, you must use Part II of form CS-SSO with additional
documentation as necessary. DWR staff will review the justification claim and determine if enforcement
action Is appropriate. Please be advised that the information needed to justify a spill is very comprehensive.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within thirty days following the receipt of this permit.
This request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC
27699-6714. Unless such demands are made, this permit shall be final and binding.
