Some answers: (1) Fence construction will comprise post holes and /or driving posts into ground. (2) yes, the culvert will go under the road, (3) we hereby revise our request for 291 linear feet of stream impact, and 70 feet of permanent impact (although I don't believe that the piped water would have no ecological function and should be mitigated at a lower ratio, but that's another discussion), and (4) mitigation will be at an off -site bank (we understand we need to secure the capacity /credits). I am beginning to craft an email to resource and other permitting agencies requesting comments but I want to make sure I completely understand the impacts. You provide tables that clearly enumerate wetland impacts but I am somewhat confused about impacts to streams. As you recall, the surface water within WI was classified as an intermittent stream based on the initial jurisdictional determination completed by my predecessor. That understood you mention in your write up that there would be 361 linear feet of temporary impact for fence construction. What is the nature of this temporary impact below the ordinary high water mark? Additionally, am I correct in assuming where the proposed road crosses the intermittent stream you are piping 70 linear feet of stream channel (which we would consider a loss)? I want to be clear what the impacts are so that I may give some thought to what the mitigation may need to be. Regarding mitigation, there is no mention about quality or ratios so I assume upfront that you are requesting mitigation from a local mitigation bank at a 2:1 ratio since the mitigation is coming from off -site. This reservation of credits needs to be secured before a permit decision can be rendered. I will be soliciting comments not only from resource agencies but also permitting agencies. I will need to have a modified 401 water quality certification and either a modified consistency or confirmation that the initial consistency will still apply. I look forward to getting your answers to these questions so I can continue processing the request.
