Yates, Due to headcutting and erosion at Site 14, NCDOT has requested a modification to the permit for the U-3301 project in Buncombe County (SAW-2014-01633). As noted in the request, NCDOT proposes to repair the banks and add stone in bottom of the relocated stream from STA 231+55 to 231+75 (20 feet) and line the banks and bottom from STA 226+00 to 228+88 (288 feet). The USACE does not object to this modification if the work is conducted in accordance with (1) the description of your email of March 2, 2022; (2) the general and special conditions of the original permit for this project (as modified by this additional work in waters), and; (3) the following special condition: 1. NCDOT shall embed the stone/rip rap to the maximum extent practical to form a defined channel. NCDOT shall ensure that this work neither over-widens nor restricts the channel. As such, by this email NCDOT is authorized to add fill material (stone/rip rap) in the bottom of the relocated stream from STA 231+55 to 231+75 (20 feet) and line the banks and bottom with fill material (stone/rip rap) from STA 226+00 to 228+88 (288 feet). The permits covered the relocation of a stream to a newly constructed ditch at Site 14 and mitigation was provided for the impact, per Lori. A portion of the new ditch was designed with stone lined banks(STA 231+55 to 231+75) and a portion did not have stone (STA 226+00 to 228+88). The ditch flows into a driveway pipe and finally enters Dix Creek at Site 13. The ditch is headcutting where it enters the pipe and is depositing sediment into Site 13A. Some of the stones in the armored section have slid off the banks. We would like to amend the permit to allow us to repair the banks and add stone in bottom of the ditch from STA 231+55 to 231+75 (20 feet) and line the banks and bottom from STA 226+00 to 228+88 (288 feet). Detail 6 on plan sheet 20 shows what we want to do. We believe this would prevent further headcutting and sediment deposition. These actions would not impact the historic properties on the project; they are at a different location farther up the road. Thanks for your assistance. If you have any questions please call me.
