This letter is in response to your letter dated July 20, 2007 requesting additional
information regarding the subject application.
Comment: Please provide a location map and a USGS 1:24,000 topographic map for the
project.
Response: Enclosed are 5 copies of a location map for the project (Sheet G 1.0), and
5 copies of the "Raleigh West" USGS 1:24,000 topographic map.
Comment: Please indicate which 404 Permit the USACE has authorized for this project.
Response: As per the attached email from James Shern, dated August 14, 2007,
USACE has determined that no 404 permit is required. Appropriate staff
and resources will be employed to ensure that Mr. Shern's other
recommendations regarding the project will be addressed.
Comment: The mitigation table under Section X for buffer impacts states "Open Water"
mitigation is needed. Please provide documentation from the NCEEP (or
another mitigation bank) indicating their willingness to accept your request to
purchase open water impacts listed in your PCN.
Response: No mitigation is necessary since no 404 permit is required.
Comment: Impact No. 1 appears to be a stream crossing. Please provide details on the
crossing, including diameter, inlet/outlet protection and aquatic life low flow
provisions.
Response:Impact No. 1 is not a stream crossing. At this location, the elevated
boardwalk crosses a drainage Swale created in the last 10 years by the
utility substation and the neighboring parking lot/commercial
development. Impact No. 1 runs parallel to North Creek.

As you have described your project, pile supported boardwalks, piers or
bridges will be used when crossing all jurisdictional areas (wetlands,
streams or open waters). Pile supported structures are generally not
regulated as fill and would not require a Section 404 permit from the Corps.
The "classroom wooden deck" over open water is not part of a greenway project
that I have permitted before. How high off the water will it be? Does that
deck have walls and a roof? Just a canopy? Neither? I am not sure it
matters but some additional details on pier spacing etc would be helpful. I
know that we have required 404 permits in the past for stilt houses that had
the piers so close together that they "functioned ad fill", but I am not sure
that is the case here...
You should have someone trained in wetland identification evaluate the route
within the asphalt sections if you have any doubt as to whether wetlands will
be crossed with a fill section.
The clearing of vegetation within 50 feet of a stream bank or pond edge as
shown on the most recent USGS topo or NRCS soils map is allowable but would
require notification to the State for a buffer authorization. I will attach
the PCN form and CC: them so they know that no 404 is required.
